수사상 경찰의 불송치 결정에 대한 절차적 통제방안 검토

수사권조정은 검찰개혁의 일환으로 검찰에 집중된 권한을 경찰에 분산하여 상호견제와 균형의 원리가 작동하도록 한다는 취지에서 실시되었다. 경찰은 수사권조정에 따라 수사개시 및 진행권에 더하여 수사종결권이라 할 수 있는 불송치 결정권을부여받았다. 경찰의 권한이 강화된 만큼 그에 대한 통제방안의 설정도 매우 중요한과제라고 할 것이다. 이 연구는 경찰에 부여된 권한 중에서도 특히 불송치 결정에 대한 통제방안이 적정하게 설계된 것인지에 대하여 검토하였다. 경찰의 불송치 결정에 대한 통제방안으로 고소인 등의 이의신청권, 검사의 90일간 사건기록 등 검토권 및 재수사요청권이 규정되었다. 먼저 이의신청권과 관련, 이의신청이 있기만 하면 일률적으로 검사에 송치토록 한 것은 합리적인 조치라 할 수없고, 이의신청 기한의 미설정, 이의신청 사건에 대한 수사주체의 혼선 등을 문제점으로 지적하였다. 다음으로 검사에 사건기록 등 일체를 송부하여 90일간 검토하도록 한 것은 형사절차상 효율성의 상실, 경찰의 내․외부 자정시스템의 형해와와 수사책임을 불명하게 한다는 문제점과 함께 검찰수사에 대한 통제와도 균형성을 잃고 있음을 지적하였다. 결론적으로 중장기적인 관점에서 법 개정을 제안하였고, 단기적인차원에서 검․경이 실무협의를 통해 취할 수 있는 방안들을 제시하였다. Adjustment of investigative power was carried out as part of the prosecution reform. The goal was to distribute the authority concentrated on the prosecution to the police so that the principle of mutual checks and balance could work. In addition to the right to initiate the investigation and the right to proceed with the investigation, the police were granted the power of non-transmission decisions, which is the right to terminate the investigation. As the police’s authority has been strengthened, setting up control measures for it is also a very important task. This study examined whether the control plan for non-transmission decisions was appropriately designed among the powers granted to the police. As a control measure for the police’s non-transmission decision, the right to file an objection by the complainant, the prosecutor’s right to review the case records for 90 days, and the right to request a re-investigation were stipulated. Regarding the right to file an objection, it cannot be said that it is a reasonable measure to send it to the prosecution uniformly as long as there is an objection, and it pointed out that the deadline for objection was not set and confusion of the investigator in the objection case. 코로나19 시기 범죄의 변화와 형사정책적 대응

이 연구에서는 ‘코로나19’라는 특별한 상황이 범죄에 어떤 변화를 가져왔는지에 대하여 살펴보고, 형사정책적 대응방안을 모색하였다. 범죄이론에 따르면 코로나19라는 감염병의 전파상황은 사회적 유대의 약화, 빈곤의 확산 등으로 인한 범죄의 증가요인을 갖지만, 한편으로 사회적 접촉과 범죄학습의 기회를 줄여 범죄감소요인을 갖고 있기도 하다. 실제의 범죄통계에서는 개별 범죄의 성격과 종류에 따라 다른 양상을 보인다. 실제 코로나19 시기에 대부분의 대면 범죄가 감소하였고 전체범죄도 소폭 감소하였음을 확인하였다. 반면, 비대면으로 실행 가능한 사이버범죄, 협박, 공갈, 스토킹 범죄 등의 증가는 매우 특징적이다. 또한 가정폭력의 세계적인 증가, 감염병 관련 혐오범죄의 등장, 코로나19 관련 범죄의 발생은 코로나19시기 또 다른 범죄발생의 특징으로서 형사정책적 대응에 변화를 요구한다. 구체적인 대응방안으로 첫째, 코로나19와 같은 재난의 발생 시기에 범죄의 변화추이를 면밀히 관찰하고 분석해 그 변화를 정책에 적시에 반영할 수 있는 범죄통계시스템의 개선이 필요하다. 둘째, 새롭게 증가하는 범죄들에 대하여 역량을 집중해 대응하고, 가정폭력과 혐오범죄 등과 관련하여 취약계층에 대한 범죄예방과 보호를 위한 노력이 필요하다. 셋째, 법집행 과정에서 세밀한 인권보장시스템을 구축해 재난대응의 적법성과 정당성을 확보해야 할 것이다. According to the theory of crime, which explains the phenomenon of crime through social change, the spread of the infectious disease called Covid-19 has an increase in crime caused by weakening social bonds and the spread of poverty. On the other hand, however, it can also reduce crime by reducing social contact and criminal learning opportunities. The actual crime statistics in this regard vary depending on the nature and type of crime. During the Covid-19 period, overall crime decreased slightly, and most face-to-face crimes decreased. On the other hand, the increase in non-face-to-face cybercrime, intimidation, blackmail, and stalking crimes is very characteristic. In addition, the global increase in domestic violence, the emergence of hate crimes related to infectious diseases, and the occurrence of crimes related to Covid-19 require changes in criminal policy responses as another characteristic of Covid-19 crime. As a concrete response, first, it is necessary to closely observe and analyze the change in crime at the time of disasters such as Corona19, and improve the criminal statistical system that can reflect the change in policy in a timely manner. Second, efforts are needed to focus on responding to the newly increasing number of crimes, and to prevent and protect crime against vulnerable groups such as domestic violence and hate crimes. Third, the government should establish a detailed human rights security system in the course of law enforcement to ensure the legitimacy and justification of disaster response.

Treatment of metastatic renal cell cancer (mRCC) is rapidly evolving since evidence concerning efficacy of novel molecular targeted drugs recently became available. But, Tyrosine kinase inhibitors achieve objective response or disease stabilization in a higher proportion of patients, but neither cure nor significant survival advantage has been shown for these agents. The role of conventional immunotherapy is still supported to the some patients in some medical centers. we will show the currently approved options available for these disease processes, including the newer agents and selected combinatorial approaches under investigation, and we attempt to identify the role of high-dose IL-2 in the context of current clinical practice. This paper provides a critical overview of the current and future role of cytokine-based immunotherapy in mRCC in light of these new developments.

A new point of view in bumper frame is proposed by tubular structure, which is a new development base on the principle of hot-stamping steel, structural design, test evaluations. As a result of the application of new bumper frame, this paper classifies the tubular ladder frame design with 6 sigma Taguchi’s quality engineering method and with 3 positive effects into rear bumper of automotive vehicles about RCAR.

High strength cold-rolled sheet steels have been used for the panels in automobiles and contributed to weight reduction of the body. TRIP (Transformation Induced Plasticity) steels have been studied for the weight reduction in automotive pans frequently because of its superior strength and ductility. In this paper, side impact analysis by substituting materials of center pillar and side sill for 60TRIP steel has been carried out considering dynamic constitutive models of auto-body materials. Finite element analysis on the side impact is simulated being based on FMVSS 214 test with LS-DYNA3D.

In this paper, side impact analysis has been carried out considering constitutive model of auto-body materials. Finite element analysis on the side impact is simulated being based on FMVSS 214 test with LS-DYNA3D. Deformed shapes and crashworthiness have been compared about quasi-static constitutive model and dynamic model during automotive collision. The analysis results with dynamic constitutive equation have small deformation of the auto-body side part in comparison with ones with quasi-static constitutive equation. Impact characteristics and safety have been assessed from investigating the deformed shapes and impact forces of an auto-body.
