소방사범 체포영장 집행 사례분석

체포제도는 수사 초기단계에서 죄를 범하였다고 의심할 만한 상당한 이유가 있는 피의자를 구속에 선행하여 수사관서 등 일정한 장소에 인치(引致)하여 단기간에 걸쳐 신체의 자유를 제한하는 제도이다. 체포영장 제도는 구속영장 이외에 피의자를 체포하는 경우에 법관에 의한 감독과 통제를 통하여 수사의 필요성과 인권보장의 조화를 기하기 위한 것으로 인정된다. 소방사범의 체포영장은 집행과정에서 피의자 인권침해의 소지가 있고, 집행과정에서 전문성이 떨어지는 등의 문제점이 지적되고 있다. 따라서 본 연구는 위험물안전관리법을 위반한 사건과 소방시설설치유지및안전관리에관한법률을 위반한 사건에 대한 소방사범 체포영장 집행 사례분석을 통해 나타난 문제점을 바탕으로 개선방안을 도출하는데 목적이 있다. 연구의 결과, 전문수사인력과 체포장구를 확보하고 광역 특별사법경찰관제를 도입하여 소방사범처리에 특별사법경찰관의 직무역량을 강화시켜야 할 것이다. An arrest system is the act of depriving a person of his or her liberty in a certain place like an investigation office for a short period of time, before imprisoning the suspect. An arrest warrant system, besides a imprison warrant, is recognized as the need of an investigation and guarantee of human rights through supervision and controled by a judge. During the implementation process of a fire-criminal arrest warrant, issues such as the infringement of a suspect’s human rights and lack of professionalism are being indicated. Therefore, the purpose of this study is to suggest improvement on fire-safety measures based on the drawbacks indicated by the analysis of fire-criminal arrest warrant execution for non-licensed hazardous material storage and handling. The result of the study shows that by securing an expert investigation force and arrest equipment, and introducing the metropolitan special judicial police system, the job capability of the special judicial police needs to be reinforced when dealing with fire-criminals.

의용소방대 조직 활성화 방안에 관한 시론적 연구

Volunteer fire department is a private firefighting organization which is set up in Seoul, metropolitan cities, city/eup/myeon to assist firefighting service. It actively participates in prevention and aid of various disasters as well as in fire prevention/extinguishment to protect people’s lives and property and to promote regional development. In short, it is a nonpaid,voluntary, private service organization; it is composed of residents in the area who have spirit of service and sacrifice,wish to join, and work in their own occupation while assisting firefighting work. Yet, voluntary fire department ofsuch nobility and sincerity has not been vitalized, and accordingly, studies regarding this issue have been conducted infirefighting organizations and academia. Therefore, purposes of this research are 1) to analyze issues of current situationthrough looking at basic training for new volunteer firefighter, unification of power to appoint and dismiss captain andcrews of the volunteer fire department, volunteer fire firefighters with a few good people, and vitalization of female volunteerfirefighters; and 2) to propose vitalization measures based on the findings above. 의용소방대는 소방업무를 보조하기 위하여 특별시, 광역시, 특별자치시 · 도(이하 시 · 도) 시 · 읍 · 면에 설치된 민간 소방조직이다. 화재예방 · 진압은 물론 각종 재난의 방지와 그 수습에도 적극 참여하여 주민의 생명과 재산을 보호하고 지역 발전을 도모하기도 한다. 그러므로 그 지역에 거주하는 주민 중에서 봉사와 희생정신을 가지고 희망하는 자로하여금 자신의 생업에 종사하면서 소방업무를 보조하고 있는 무보수의 자율적 민간봉사 조직이다. 이러한 숭고하고 참된의용소방 조직이 활성화 되지 않아 이에 대한 연구가 소방조직 및 학계에서 조심스럽게 진행되어 왔다. 따라서 본 연구역시 의용소방대 조직의 활성화 방안을 시론적으로 연구함에 있어 신임 의용소방대원 기본 소양교육실시, 의용소방대장및 대원의 임면권 일원화, 의용소방대원의 정예화, 여성의용소방대원의 활성화 등을 통한 의용소방대의 현 실태의 문제점을 분석하고 이에 대한 활성화 방안을 제시하고자 한다.

소방공무원의 효율적인 전자결재시스템 활용방안에 관한연구

Rapid development of Information Technology(IT) requires new changes in overall official sections, and government also makes effort to promote the productivity and efficiency of official sections with IT. Objectives of this research are to evaluate the management of Electronic Approval System and to present the efficient way of using Electronic Approval System. In this research, we presented that the efficient use of Electronic Approval System requires systematic education, improvement of approval procedure, stability of system, improvement of system operation speed and connection with other official department. 정보통신기술(IT)의 급속한 발전은 공직사회 전반에 새로운 변화를 요구하고 있으며, 정부도 정보기술을 토대로 공공부문의 생산성과 효율성을 진작시키기 위해 부단히 노력하고 있다. 본 연구의 목적은 전자결 재시스템의 운영에 관한 사항을 평가하고, 운영상 나타난 문제점을 바탕으로 효과적인 활용 방안을 제시 하는 데 있다. 연구의 결과를 통해 효율적인 전자결재시스템의 활용을 위해 체계적인 교육, 결재업무절차 의 개선, 시스템 안정, 시스템 처리속도 개선, 기관별 시스템 연계 등을 제시하였다.

소방공무원 공개채용 시험과목 조정에 관한 연구

The duty of fire officials are very complicated and various that a subject replacement for the fire officials' public examination for service is being required. The purpose of this study i s to investigate the actual conditions of the fire officials' public employment system and find out current problems of it, to reconsider the speciality of the examination based on them, and to suggest a subject replacement for the examination to evaluate the duty accomplishment ability. This study presents not only assuring the speciality of fire officials but also the desirable plans to execute the Fire Relating Act effectively by replacing introduction of political science with fire service administration and adding the Fire Relation Law which is more connected on the local fire officials public written examination for service with duty. 소방공무원의 업무는 매우 복잡하고, 다양한 양상을 띠고 있으며 고도의 전문성이 요규되는 소방공무원의 공개채용 시험과목조정의 필요성이 제기되고 있다. 본 연구의 목적은 소방공무원 공개채용에 있어 소방공무원 공개채용제도의 실태를 분석하고, 문제점을 도출하여 이를 바탕으로 소방공무원 공개채용의 전문성 제고와 직무수행능력 평가를 위한 시험과목 조정(안)을 제안하는 데 있다. (지방)소방사 공개채용 필기시험 과목 중 행정학개론을 소방행정학으로 대체하고 소방업무와의 연계성을 고려하여 소방관계법을 추가함으로써 소방공무원의 전문성 확보는 물론 효과적인 소방관계법 집행을 위한 바람직한 방안을 제시하고자 함.

의용소방대의 사회적 자본 영향요인 분석

A Volunteer Fire Brigade is a voluntary social services organization that performs various assistance works in fire fightingactivities such as fire fighting and rescue of human lives on a part-time basis. Recently, it has also assumed an importantrole in the creation of security culture of local society. Besides, it provides diverse service activities related to securityof local society. However, as this kind of volunteer fire brigade organization is not in a vigorous state, research for animprovement is being carried out in earnest. As part of a vitalization plan of the volunteer fire brigade, an attempt wasmade in this research to present an activation plan of the volunteer fire brigade through formation of social capital. Accordingly, efforts were made in this research to investigate and analyze an awareness of social capital among the volunteersand to present on this basis a plan for formation of social capital for the volunteer fire brigade of local society. As aresult of the research, it turned out that social norm has the major effect on the formation of social capital for volunteerfire brigade. Therefore, it is our belief that an independent statute should be established to nurture and develop volunteerfire brigades. And when strong mutual trust among the volunteers are formed and efforts for devotion to local society aremade on this basis, the security level of local society will be enhanced further. 의용소방대는 화재진압 및 인명구조 등의 소방 활동의 보조업무를 비상근적으로 수행하며, 자발적인 사회봉사활동을하는 조직이다. 최근에 들어서는 지역사회의 안전문화 조성을 위한 역할도 수행하고 있다. 또한 지역사회의 안전과 관련된 다양한 봉사활동을 하고 있다. 이러한 의용소방대 조직이 활성화가 되지 않아 이에 대한 연구가 활발하게 진행되어왔다. 본 연구 역시 의용소방대 조직의 활성화 방안으로 사회적 자본 형성을 통한 의용소방대 활성화방안을 제시하고자한다. 따라서 본 연구는 의용소방대원의 사회적 자본 인식을 조사하고, 분석하여 이를 토대로 지역사회 의용소방대의 사회적 자본 형성 방안을 제시하고자 한다. 연구의 결과 사회적 규범이 의용소방대 사회적 자본 형성에 가장 많은 영향을미친 것으로 조사되었다. 따라서 의용소방대를 육성·발전시키기 위한 독립된 법령 제정되어야 하고, 의용소방대원 간의 강한 신뢰가 형성되어 조직전체의 신뢰를 기반으로 지역사회에 헌신한다면 지역사회 안전의 수준은 매우 높아질 것이다.

소방의 날 변역(變易) 필요성에 관한 시론적 연구

기념일이란 정부가 각종기념일 등에 관한 규정에 의거하여 축하하거나 기릴만한 일이 있을 때, 해마다 그 일이 있었던 날을 기억하고 기념하는 날을 말하며, 각 기관에서는 기념행사 또는 이에 준하는 행사를 함으로서 당해기념일의 의의를 높이고 새로운 발전과 성숙을 모색하는 의미 있는 날이기도 하다. 그러나 지난 2012년 11월 9일 제50주년 소방의 날을 맞이한 기념행사의 역사를 되돌아보면 과연 11월 9일이 소방의 날로써 유의미한 날인가 하는 것을 의심하게 한다. 본 연구의 목적은 소방의 날이란 역사적으로 언제부터, 왜, 무엇을 기념하기위해서 제정되었나를 재조명 해 보면서 만시지탄의 감은 있으나 모든 국가기념일(법정기념일)이나 다른 나라의 소방 기념일처럼 유의미한 기념일이 될 수 있도록 소방의 날 변천과정을 살펴보고 소방의 날에 부합되는 기념일을 모색하여 소방공무원들의 긍지와 보람을 가질 수 있는 소방의 날 변역(變易)의 필요성과 새로운 소방의 날을 제언(提言)하였다. 각 가관별 국가별·소방의 날 제정에는 그 기관단체 국가별로 기념할 만 한 객관적인 이유와 동기가 충분하다고 사료되나 우리나라의 소방의 날은 단지 긴급전화번호가 119라는 이유만으로 그 날을 소방의 날로 제정하였다는 것을 지적하면서 성숙된 소방조직으로서 새로운 소방의 날은 먼저 소방이라는 용어가 역사적으로 처음 사용된 날, 두번째로 우리나라 소방조직(관아)이 처음 창설된 날, 세 번째로 우리나라 소방방재청이 개청된 날 등으로 변역되어야 한다고 제언 하였다. Anniversary means the day to remember and celebrate what should be congratulated or honored every year based on government's regulation about all kinds of anniversaries, etc. On the dates, each institution significantly improves meaning of the anniversaries and seeks new development and maturation by holding the anniversary event or other events. However, if looking back on the history of anniversary event for the 50th firefighting day on Nov. 09, 2012, we cannot help being doubtful if Nov. 09 is significant day as a firefighting day. The purposes of this research are to shed new light on the time, reason and object of firefighting day historically, examine changes of firefighting day so that it can be significant day like all of national anniversaries(legal anniversaries) or firefighting day of other countries in spite of repenting of the missing a chance and suggest the necessity to alter firefighting day which is suitable for firefighting day firefighting officers can possess pride and rewarding by seeing the anniversary suitable for firefighting day and new firefighting day. For the enactment of firefighting day by each institution and each country, there are sufficiently objective reasons and motives which can celebrate by the institution and each country. But, this research suggested that new firefighting day of matured firefighting organization should be altered to firstly the day to use the word of firefighting in our history, secondly the day when Korean firefighting organization(government office) was established for the first time, thirdly the day Korean National Emergency Management Agency was inaugurated, etc. by indicating that our firefighting day was enacted by only the reason emergency number is 119.

긴급구조 정보시스템 활성화 방안에 관한 연구

인구의 도시집중화, 건축물의 고층화·밀집화·지하심층화로 재난 발생시 그 피해가 더욱 커지면서 재 난에 대한 대응책 마련은 정부의 중요한 과제 중 하나로 대두되고 있다. 본 연구의 목적은 긴급구조정보 시스템의 사용자 측면, 시스템 측면, 조직적 측면에 관한 사항을 평가하고, 운영상 나타난 문제점을 바탕 으로 긴급구조정보시스템의 활성화 방안을 제시하는 데 있다. 이를 위해 사용자 측면에서는 긴급구조정보 시스템의 접근과 조작 방안, 시스템 측면에서는 신속성과 안정성 제고 방안, 조직적 측면에서는 의사결정 및 조직성과 기여 방안 등을 제시하였다. As population has been gravitating to the city and buildings have been getting higher, closer and deeper, the damage is getting greater and taking countermeasures against disaster is rising one of the major government's projects. The aim of this study is to suggest a utilization plan of the emergency rescue information system based on the operating problems after valuating user part, system part and organization part of the system. As result, facility plan for access to emergency rescue information system and operating on user part, raing plan of rapidity and stability on system part, decision making and organization and contribution plan on organization part are suggested.

의용소방대 조직 활성화 방안에 관한 시론적 연구

119 구급업무의 정책논쟁분석

지난 몇 년 전부터 삼풍백화점 붕괴사고, 씨랜드 참사사고, 인천호프집 화재사고 등 대형사고가 국내외에서 번번히 발생되었다. 화재사고, 가스폭발사고, 교통사고, 산악사고, 각종질병 등 많은 사고가 발생할 때마다 국민들은 119 구급서비스를 원했던 결과 작년 한 해만 해도 일일 평균 2,608명을 구급처치하고 가까운 병원으로 이송하였다. 그러나 양질의 구급서비스를 제공하여 국민의 귀중한 생명을 구조하고 보호하여야 하는 119구급대원이 행할 수 있는 응급 처리를 하거나 단순 이송만으로 소임을 다하는 사례가 있을 수 있어 차제에 119구급 대원이 행할 수 있는 응급 구조사의 업무제한은 마땅히 완화(응급구조사가 구급차 및 장비를 이용해서 응급처치를 행할 경우에 한하여)내지 폐지(선진국의 대부분 나라에서도 응급 구조사의 업무범위내에서 응급처치만 실시함)되어야 한다고 제안한다. Since a few years ago, great disasters have often took place in domestic and abroad, such as Sampoong Department store collapse, Sea-land disaster accident, Incheon Hof fire accidents. Whenever a lot of accidents occurred such as fire, gas explosion, traffic accident, mountain accident, various disease, people required 119 first aid service. As the result, even for the last year, average 2,608 person per day were temporary treated and carried to near hospital by 119 system. But first-aid team or first grade EMT(emergency medical technician) that should provide high quality service and save important lives, might have negatively treated or made their duty only for simple transfer, when they were imminent of emergency case in every kind of accident spot. Because they worried about medical dispute for "task restriction for EMT" decided by medical lows or rules of first aid. So it was proposed that "task restriction for EMT" should be mitigated or released in the possible range on this occasion.
