불법어업 근절을 위한 항만국조치협정의 국내 이행력 개선방안에 관한 연구

본 연구는 불법 어업 근절에 관한 국제 규범 동향 파악 및 비준국의 항만국조치협정(이하 PSMA) 이행 현황을 조사하여 우리나라의 PSMA가 실행력을 개선할 수 있는 방안을 도출하고자 하였다. PSMA는 2016년 6월에 발효되었고, 2021년 기준 69개국이 PSMA의 당사국으로 참여하고 있다. 우리나라를 비롯한 미국, EU, 호주, 뉴질랜드, 아이슬란드, 캐나다, 태국 등이 동 협정을 비준하였다. 우리나라는 2015년에 PSMA의 당사국으로 가입하여 2016년에 동 협정을 비준하였다. 특히, 미국, EU, 호주, 뉴질랜드, 아이슬란드는 PSMA를 국내법으로 수용하여 협정의 내용을 체계적으로 이행하고 있다. 그리고 지역수산관리기구(이하 RFMOs)도 보존조치의 일환으로 당사 국에게 협정 이행을 요구하고 있다. 이러한 조치는 더욱 확대될 것으로 보이며, 효과적인 이행을 위해서는 당사국 및 비당사국간의 협력, 국내이행을 위한 제도 및 정책 개선이 뒷받침 되어야 한다. 이에 현행 체제의 PSMA의 국내 이행 현황과 국제동향을 분석·검토하여 우리나라의 PSMA 실행력을 개선할 수 있는 방안을 도출하고자 하였다. 본 연구의 결과는 PSMA 이행을 위한 국내 관련 제도 및 정책적 개선 방안과 국제적 대응방향을 제시하고자 한다. This study aims for analysing the implementation of international obligations on the eradication of the IUU fishing and the Agreement on Port State Measures to Prevent, Deter and Eliminate Illegal, Unreported and Unregulated Fishing(PSMA) by countries that have ratified it. It seeks to derive measures that can improve the execution capability of the PSMA. To control IUU fishing, PSMA entered into force in June 2016. As of now, 69 countries are participating as parties to the PSMA, and the US, EU, Australia, New Zealand, Canada and Thailand, including Korea, have ratified the agreement. The US, EU, Australia, New Zealand, and Iceland have adopted PSMA as their domestic law and are effectively implementing the contents of the agreement. Korea joined PSMA in 2015 and ratified the agreement in 2016. In order to implement the agreement, the domestic legal system was revised and the responsible organization was designated. For the effective implementation of PSMA under the current system, it is necessary to cultivate professional manpower for implementation, establish information exchange systems, and strengthen domestic and international cooperation along with system revision. The results of the study aim to improve the legislative improvement of the relevant domestic legislation and international response directions for the implementation of the Port State Action Agreement, and to enhance its execution power, which is distributed to international norms, and to establish a basis for compliance fishing.

This study aimed to establish the public interest functions of fisheries and fishing villages, which is intended to help introduce and expand the public-purpose direct payment system in the fisheries sector. Firstly, this study looked at trends related to the public interest functions of domestic and foreign cases in similar fields in order to get implications for establishing public service functions in fisheries and fishing villages. Secondly, three criteria were defined for establishing the public interest functions of fisheries and fishing villages. Thirdly, the public interest functions of fisheries and fishing villages were defined through prior research, analysis of overseas cases, and consultation with experts in the fields of fisheries and fishing villages. As a result, the six public interest functions and the 14 detailed functions were defined. Finally, this study established a direction for preserving and improving the public interest functions of fisheries and fishing villages, and presented strategies for achieving them.

Entering 21st century, the problem of agricultural underdevelopment in Korea would be solved when many-sided effort - consideration of regional peculiarities, rearing of farming family, consideration of present-day life demand, educational and cultural environmental development, inducement of neighborhood participation - could be achieved successfully. This complex point of view is very important for solving knotty problem like underdevelopment of the rural areas in Korea. If it can be worked systematically, efficient use of country, maintenance of food supply and promotion of regional culture would tie achieved. This study suggests conceptional goals for modern farming town development planning in Korea.
