        항공법의 연원과 미비점에 대한 제언 : A Study on the Korean Air Law

        This study looks at matters relating to Koreas aviation laws and identifies some improvement measures that should be taken. Aviation laws can be said to be independent in terms of legal identity because it deals with and regulates very specified and technical areas such as aircraft manufacture, airworthiness, flight rules, airspace, air transportation and their facilities, etc. At the same time, many new legal issues arise in the area calling for appropriate counter-measures and activities if the legal system is to keep in step with the ever-changing trend. Koreas Aviation law was first enacted on 7 March 1961 and has been continually revised and expanded over the years growing into an independent legal system on its own, practically speaking, out of necessity. However, it still needs to be further expanded and amended. As the new milleniums leading industry, the aviation industry will continue to develop and grow to meet the needs. But sound and systematic promotion of the industry and the changing international civil aviation requires modern advanced laws and soon. With this in mind, seven top priority issues that need to be remedied have been identified, as briefed in the following. 1. Regulations providing for civil aircraft should also apply to military aircraft for uniformity which in turn will enhance air safety in general. 2. Full consideration should be given to environmental issues such as aircraft noise abatement which only apply to international flight only and not to domestic flights. No difference should be made between the two since they equally bring harm to people and infringe upon peoples rights. 3. Penal codes for criminal acts concerning aircraft, such as hijacking, should be made more strict. 4. Matters not provided for in the Aviation Act and its related regulations should be covered by ICAO manuals to ensure. Doing so will mean clearer regulation. 5. Legal framework for aircraft accident investigation activities should be provided to ensure that all accidents are investigated efficiently and as a way of preventing accidents. 6. For a better balanced and developed air industry, laws needs to be supplemented in order to promote non-scheduled flights and commuter flights. 7. Specialty and technical personnel should be given longer assignment terms. These days, the aviation industry is more complicated than ever and is faced with rapid changes so that there are many legal issues and demands that need to be dealt with. The government should deeply concern itself with these matters to study and meet the needs because advanced aviation law system is an absolute necessity for public welfare.

        항공로의 설정및 운영상의 법적·정책적 문제에 대한 연구

        There are 24 airways in Incehon IFR, including 11 domestic routes and 13 international routes. The airways designated by ministry of Transportation and Construction are the routes for aircraft to fly being serviced by air traffic control system for flight safety. This study reviewed safety situation of existing permanent airways within Incheon IFR and temporary airways connecting North and South Korea. The study tried to identify the problems related to airway operation and to suggest solutions to the questionable area. The main findings are as follows: It is necessary to improve the existing normal airway systems and enlargement of the route. The airway A593 has to be upgraded to normal route. The temporary airways established to connect Seoul and Pyongyang also needs to be upgraded by air traffic control transfer agreement between two Koreas. 현재 인천 비행정보구역 내에는 국내선 11개, 국제선 13개 등 총24개의 항공로가 설정되어 있다. 이러한 항공로는 건설교통부장관이 항공기의 항행에 적합하다고 지정한 지구의 표면상에 표시한 공간의 길로서, 항공로를 따라 비행하는 항공기에게는 항공교통관제를 제공하여 안전운항을 지원하여 주고 있다. 그러나, 항공로(Airway)는 항공법 및 국제민간항공협약 부속서 11에서 정한 기술상의 기준에 충족되어야 하며, 운영관리도 관련 규정에 따라 적법하게 시행되어야 하나 서해 및 동해에 설정된 임시 직항로는 양국간 항공교통 관제협정의 체결이 없는 상태에서 지속적으로 사용하고 있어 유사시 국제법상의 보호를 받지 못하는 것은 물론 아국 항공기에게 필요한 조치를 취할 수 없는 여건이 될 수도 있다.따라서, 항공로의 실태분석을 통하여 제기된 문제점에 대한 개선 및 보완조치는 증가하는 항공교통량을 대비하고, 항공로 문제로 인한 항공기의 지연을 방지하며, 안전운항을 확보하기 위한 필수요건이므로 현행 항공로에 대한 법적 정책적 과제를 “정기항공로” 와 “남북간 임시직항로”로 구분하여 다음과 같이 개선대안을 제시하였다. 첫째, 정기 항공로에 대하여는, 항공로 체계의 개선 과 주변 보호공역의 확대가 필요하며, A593 Corridor 항공로는 정기항공로 로 대체 되어야 하며, 둘째, 남북간 임시 직항공로에 대하여는, 국제민간항공협약 부속서에서 정한 “항공기의 인수 인계를 위한 관제협정”을 체결하고, 유사시 안전을 보장 받을 수 있도록 가칭 “항공로의 운영 및 상호 지원에 관한 합의서”의 작성등이 필요하다.

        화물운송주선업자의 항공사 선택행위 연구

        The objective of this study is to investigate freight forwarders' airline choice behaviors in the Korean air cargo transportation market. This study identifies the major factors affecting airline choice and their relative importance by analyzing the data gathered by the survey from freight forwarders in Seoul. The questionnaire of the survey is composed of two parts; the first part is to identify the significant variables of airline choice and the second part is to gather the data about airline choice using stated preference techniques. The relative importance of major variables considered in forwarders' airline choice is estimated by the logit models calibrated with stated preference data. To strength the reliability of the analysis, this study segments the market by three routes; Seoul-Los Angeles, Seoul-Amsterdam and Seoul-Hongkong. The five major variables that are considered seriously in airline choice are reliability, space availability, frequency, cost and flight schedule. The utility trade-offs between variables are estimated by the ratio analysis of coefficients of logit model of each route, and the results of ratio analysis is interpreted as reflecting the reality of market conditions.
