침도침 시술이 견관절 질환에 미치는 영향에 관한 임상적 고찰

Objectives : The purpose of this study is to report the effect of acupotomy for patients with shoulder disease. Methods : We treated Five patients who have shoulder disease with acupotomy. To check the effect and satisfaction of acupotomy we used visual analog scale(VAS) and Five-point Likert scale. At the same time, we measured Change of shoulder range of motion(ROM). Results : After treatment pain were improved, VAS score decreased significantly to 2.5. The Likert scale point were checked 4.4, the patients were satisfied with the effect of acupotomy. Conclusions : This study shows acupotomy has useful effect on shoulder disease. An acupotomy is an alternative effective treatment modality for shoulder disease.

照海 전침의 항산화 효과에 대한 실험적 연구

Objectives : This study investigated the antioxidant effect of electro-acupuncture at KI6 on rats treated with 2,2’-azobis(2-amidinopropane) dihydrochloride(AAPH). Methods : After electro-acupuncture at KI6 on 48 rats that were given AAPH(50㎎/㎏) every day, the author observed several changes in weight, liver index, albumin, total bilirubin, LDL-cholesterol, LDH, glu- cose, GOT, GPT, SOD and catalase activity, and glutathione, NO, and MDA concentrations. Results : 1. In the KI6-EA group, the albumin level increased and LDL-cholesterol decreased compared with the control and holder groups. 2. In the KI6-EA group, SOD activity increased compared with the holder group, glutathione concentration increased compared with the control and holder groups, and catalase activity increased compared with the control group. 3. In the KI6-EA group, NO concentration decreased compared with the control and holder groups. Conclusions : This case shows that electro-acupuncture at KI6 plays a significant antioxidant role by elevating defenses against cell toxicity caused by oxidative stress and suppressing oxidative injury.

부동산금융으로서의 이행인수 : 대법원 2002. 5. 10. 선고 2000다18578판결을 중심으로

As a method of real estate financing, the buyer may borrow funds by providing security interest on the real estate to be acquired. Furthermore, if the seller has already borrowed money by establishing certain security interest over the real estate subject to the sale, the buyer may assume the seller's obligation under the loan as part of the payment of the purchase price. In this situation, the interests of relevant parties may vary: the buyer wishes to assume the obligation so that she does not have to fund the purchase price through other channel; the seller wishes to get out of the obligation under the loan when she sells the real estate; and the creditor wishes not to jeopardize her interests by change of debtor even if she holds the same security interests. The Supreme Court of Korea, through a series of decisions including the "2000Da18578" Decision, has established that, (a) the true change of debtor occurs only with the consent of the creditor; (b) without the creditor's consent, it is either (A) both the seller and the buyer are jointly liable for the loan, or (B) the seller is still the debtor under the loan, while the buyer has obligation towards the seller to perform the obligation under the loan on behalf of the seller. In case of a project of real estate development (with funding through Project Financing), the treatment of existing loans secured by the real estate is crucial. In this regard, the rules made by the Supreme Court should be re-visited. 부동산 금융의 일환으로 매매목적물인 부동산 자체를 담보로 제공하고 부동산 취득자금을 조달할 수 있으며, 이 경우 매매목적물에 이미 채무가 부담되어 있다면 그러한 채무를 부동산 매수인이 인수하는 방식도 널리 행하여지고 있다. 이러한 매매대금에 갈음한 채무 인수 약정의 경우 그 법형식을 면책적 채무인수로 볼 것인지, 중첩적 채무인수로 볼 것인지, 단순한 이행인수로 볼 것인지에 따라 이해관계자들의 법률관계가 다르게 규정된다. 이 글에서 검토한 대법원 2002.5.10 선고 2000다18578 판결을 포함한 대법원의 일련의 판결들을 검토한 결과, 대법원의 입장은 채무자의 인적 사항의 변동에 따른 채권자의 불이익을 최소화하기 위하여 (ㄱ) 채권자의 승낙이 있으면 면책적 채무인수, (ㄴ) 인수대항인 권리관계가 함께 양도되거나 인수인이 채무부담에 상응하는 대가를 얻은 때에는 병존적 채무인수, (ㄷ) 그 이외의 경우에는 이행인수에 해당한다는 것이다. 그러나 이러한 공식만으로는 모든 사안을 명확히 해결하기 어렵다. 또한 이러한 채무의 인수는 부동산 개발사업에서도 종종 이용되는데, 일반적인 프로젝트 파이낸싱 (Project Financing) 기법과 달리 시공사의 신용보강이 중요한 역할을 하는 우리나라 부동산 개발사업의 특수성에 비추어 볼 때, 이러한 채무 인수약정에 대한 시공사의 책임범위도 검토할 필요가 있다.

칼레만 부등식을 이용하여 슈레딩거 연산자에 대한 유일성 정리를 증명한다. 이를 위하여 적절한 무게함수를 도입하며, Tomas 의 정리, Sogge 의 정리 등을 이용한다. 본 연산자에 대한 유일성 정리는 연속 스펙트럼에서 고유치의 존재를 제거하는 데 사용될 수 있다.

This study was performed to evaluate the tensile bond strength and modulus of elasticity of three permanent soft denture liners (Molloplast $B^{(R)}$, Ufi Gel $C^{(R)},\;Tokuyama^{(R)}$) before and after thermocycling. And their water sorption were also evaluated. Each soft denture liner was bonded to PMMA denture base resin blocks and the tensile bond strength and modulus of elasticity were measured by using universal testing machine. For the water sorption, weight measured after immersion of sea denture liners in $37{\pm}1^{\circ}C$ water bath for 4 weeks. The results were as follows : 1. Molloplast $B^{(R)}$ had the highest tensile bond strength, while Tokuyama had the lowest tensile bond strength. There was no significant difference between $Tokuyama^{(R)}$ and Molloplast $B^{(R)}$ in the both nonthermocycling and thermocycling. There was significant difference in tensile strength of $Tokuyama^{(R)}$ before and after thermocycling(p<0.05). 2. For the modulus of elasticity, there was no significant difference between Ufi Gel $C^{(R)}\;and\;Tokuyama^{(R)}$ in the both nonthermocycling and thermocycling. There was significant difference in modulus of elasticity of $Tokuyama^{(R)}$ before and after thermocycling(p<0.05). 3 The failure modes of Molloplast $B^{(R)}$ and Ufi Gel $C^{(R)}$ were mainley adhesive type and that of $Tokuyama^{(R)}$ was mainly mixed type in case of nonthermocycling and cohesive type after thermocycling. 4. The water sorption of each soft liners was within ${\pm}2%$ in times (p<0.05) but. there was no significant difference among the soft liners in times.

한국과 프랑스의 초등학교 수학 교육과정의 비교 분석

The purpose of this research is to compare the mathematics curriculum of Korea and France in elementary level. We have found some meaningful differences. First, Korean textbooks are under control of government and aims at uniformity, whereas French textbooks aims at diversity. Second, in regards of contents, Korean textbooks are characterized as linear, formal, French textbooks are spiral, real life based.

기업에 대한 법률자문에 있어 이익충돌의 문제

변호사윤리에 있어 “쌍방대리금지”의 원칙은 분명한 당사자 대립구조를 가지는 소송사건을 염두에 두고 만들어진 것으로,소송의 경우와 같은 적대적인 상대방이 존재하지 않는 경우가 많고 계쟁물의 범위도 분명하지 않은 송무 영역이 아닌 법률자문의 경우에는 그대로 적용하기 어렵다. 법률서비스의 수요 및 공급의 변화에 따라 송무 이외의 법률서비스가 점점 확대되고 있는데, 이러한 법률서비스의 경우 그 내용에 맞는 별도의 규정을 제정하여 이익충돌을 규제하는 것이 상당하다. 2004년 영국에서는 기업인수합병(M&A)에 있어서 인수대상회사가 인수 컨소시엄을 대리하는 로펌에 대하여 이익충돌을 이유로 법률자문금지 가처분(injunction) 결정이 나온 사례가 있었는데,업계에 큰 파장을 일으켰으며, 이후 영국에서는 주로 비송무 법률서비스를 제공하는 Solicitor들을 중심으로 이익충돌회피의 무와 기밀유지의무에 대한 규정을 현실에 맞게 개정하여야 한다는 요구가 있었고 이에 따라 윤리강령이 개정되었다. 이 글에서는 위 법률지문금지 가처분 사건의 내용과 그 이후 개정된 영국의 Solicitor들에 대한 윤리강령의 대응방식을 살펴본 후, 우리의 변호사법과 변호사 윤리강령 및 윤리규칙의 해석에 있어 시사하는 바를 검토한다. 우리 법조윤리에서도 송무 이외의 법률서비스의 제공에서 의뢰인의 이익 보호는 중요한 법익이지만, 영국의 Solicitor 윤리강령과 같이 비송무사건에 대한 현실적인 별도의 규제를 마련하는 것이 바람직할 수 있으며,비송무사건에서의 이익충돌 상황을 합리적으로 규제하려면 송무 이외의 법률서비스의 본질에 대한 검토와 이해가 필요하다. More debates have been made regarding conflict of interest in legal profession as the legal market has gone through dramatic changes. The current regulations addressing conflict of interest, which are set in the Lawyers Act and the Code of Ethics by the Korean Bar Association, assumes adversary structure for every case for which a lawyer is retained. In reality, however, such adversary structure cannot be found in most legal advices not associated with litigation. Applying the same regulation on legal services related to litigation and not related to litigation might lead to results unacceptable in actual situation. There is a recent case in England where the conflict of interest issue was hotly debated. In that case, the court granted an injunction against a lawfirm prohibiting provision of legal advices to the acquirer in takeover situation where the lawfirm had given certain advices to the target company regarding its key business line. This article reviews and analyzes this case as well as the reaction taken by the Law Society of England and Wales. This article also analyzes the case in Korean perspective and discusses the necessity of a separate regulation covering conflict of interest issue for legal services in non-litigation context.
