      • 생명보험계약 관련 법적 쟁점에 대한 실무적 고찰

        생명보험업계가 저금리, 저성장 경제 환경에서도 신계약 수요를 창출하기 위한 노력을 계속하는 가운데, 생명보험계약을 둘러싼 법률관계에는 다양한 법적 문제가 발생하고 있다. 보험자가 계약자의 보험료 납입 연체를 이유로 계약을 해지하려고하거나 해지한 경우에 보험자와 계약자 또는 보험수익자의 사이에서 가장 빈번하게 발생하는 분쟁은 납입최고 통지와 계약 해지 의사표시가 계약자 또는 보험수익자에게 도달하였는지 여부이다. 보험자가 보험거래의 비용을 합리적 부담하면서도 의사표시 통지 의무를 다하기 위해, 현재의 해지예고부 통지 이전에 미리 미납입 안내장을 발송하고 보험료 납입에 관한 상당한 기간을 설정하고 그 기간 내에 지급하지 않으면 최고 없이 계약을 해지한다는 내용으로 보험자와 계약자 등이 약정하는 방안을 고려할 수 있다. 최근에 다수의 생명보험회사들은 전자문서에서 전자서명으로 보험계약을 체결하는 시스템을 활용하고 있다. 이 시스템을 통하여 타인의 사망을 보험사고로 하는 생명보험계약을 전자적 방식으로 체결할 경우 타인의 서면 동의 대신 전자서명 된 전자문서에 의한 동의로 대체할 수 있는지 문제된다. 전자서명만으로는 안정성이 부족하고 전자서명 자체의 부정사용의 위험이 있다는 점에서 자신을 피보험자로 한 보험계약에 이의가 없다는 의사표시를 확인하여 전자서명을 보완할 수 있을 것이다. 또한, 보험계약자가 보험수익자를 법정상속인으로 지정하였는데 상속인이 피보험자를 살해하거나 고의로 해쳐 결극 피보험자를 사망에 이르게 한 경우, 해당 상속인이 수익자로서 보험금을 취득할 수 있는지, 취득할 수 없다면 후순위 상속인이 수익자가 되는지 문제된다. 보험수익자인 법정상속인이 갖는 보험금청구권은 상속인의 고유재산인 이상 해당 수익자가 법정상속인으로 상속결격자라고 하여 대습상속인 또는 후순위 상속인에게 수익자의 지위가 이전되는 것은 아니라고 보는 것이 타당하다. As life insurers continue to make efforts to create demand for new contracts under the low growth and low interest rate environment, various issues occur on legal relations surrounding life insurance contracts. The most frequent issue occurred between insurers and policyholders before and after insurer's termination of contract--due to the overdue payments of premium installments--is: whether the insurer's notice demanding policyholders to pay the premium within a specified period; or insurer's declaring its intention to terminate the contract, has reached the policyholders and beneficiaries. To have the insurer to reasonably bear the transaction cost and to abide by the duties to notify its intention, it can be considered that insurers and policyholders agreeing the contract which includes: noticing the policyholder beforehand in case of overdue payment, specifying the period of payment, and terminating the contract without further notice when policyholder fails to pay the premium within the specified period. Second, many life insurers have recently adopted electronic documents and electronic signature to conclude the insurance contract. An issue on altering the written consent with an electronic signature can occur when a life insurance contract on insuring someone's death has been concluded through an electronic signature. Given lack of stability and high risk of misuse, the insurers can supplement the problem with confirming the intention of the insured person that he/she has no opposition to the contract. Lastly, if the designated inheritor of the contract, intentionally murdered or harmed the policyholder to death, an issues occurs on who becomes the recipient of the insurance benefit: the inheritor or the next eligible. In this case, the benefit cannot be transferred to the representative inheritor or the next order in inheritance, just because the legal inheritor became disqualified.

        Metabolic engineering of <i>Klebsiella pneumoniae</i> J2B for co-production of 3-hydroxypropionic acid and 1,3-propanediol from glycerol: Reduction of acetate and other by-products

        <P><B>Abstract</B></P> <P>Production of 3-hydroxypropionic acid (3-HP) or 1,3-propanediol (1,3-PDO) production from glycerol is challenging due to the problems associated with cofactor regeneration, coenzyme B<SUB>12</SUB> synthesis, and the instability of pathway enzymes. To address these complications, simultaneous production of 3-HP and 1,3-PDO, instead of individual production of each compound, was attempted. With over-expression of an aldehyde dehydrogenase, recombinant <I>Klebsiella pneumoniae</I> could co-produce 3-HP and 1,3-PDO successfully. However, the production level was unsatisfactory due to excessive accumulation of many by-products, especially acetate. To reduce acetate production, we attempted; (i) reduction of glycerol assimilation through the glycolytic pathway, (ii) increase of glycerol flow towards co-production, and (iii) variation of aeration rate. These efforts were partially beneficial in reducing acetate and improving co-production: 21g/L of 1,3-PDO and 43g/L of 3-HP were obtained. Excessive acetate (>150mM) was still produced at the end of bioreactor runs, and limited co-production efficiency.</P> <P><B>Highlights</B></P> <P> <UL> <LI> <I>K. pneumoniae</I> was engineered for co-production of 3-HP and 1,3-PDO from glycerol. </LI> <LI> Co-production improved upon by-products reduction. </LI> <LI> The maximum 21g/L 1,3-PDO and 43g/L 3-HP were obtained in fed-batch bioreactor cultivation. </LI> <LI> Acetate accumulation was serious and limited further improvement of co-production. </LI> <LI> Activation of TCA cycle and ETC is suggested to reduce acetate and improve ATP supply. </LI> </UL> </P>

      • High-efficiency photovoltaic cells with wide optical band gap polymers based on fluorinated phenylene-alkoxybenzothiadiazole

        <P>A series of semi-crystalline, wide band gap (WBG) photovoltaic polymers were synthesized with varying number and topology of fluorine substituents. To decrease intramolecular charge transfer and to modulate the resulting band gap of D-A type copolymers, electron-releasing alkoxy substituents were attached to electron-deficient benzothiadiazole (A) and electron-withdrawing fluorine atoms (0-4F) were substituted onto a 1,4-bis(thiophen-2-yl)benzene unit (D). Intra- and/or interchain noncovalent Coulombic interactions were also incorporated into the polymer backbone to promote planarity and crystalline intermolecular packing. The resulting optical band gap and the valence level were tuned to 1.93-2.15 eV and −5.37 to −5.67 eV, respectively, and strong interchain organization was observed by differential scanning calorimetry, high-resolution transmission electron microscopy and grazing incidence X-ray scattering measurements. The number of fluorine atoms and their position significantly influenced the photophysical, morphological and optoelectronic properties of bulk heterojunctions (BHJs) with these polymers. BHJ photovoltaic devices showed a high power conversion efficiency (PCE) of up to 9.8% with an open-circuit voltage of 0.94-1.03 V. To our knowledge, this PCE is one of the highest values for fullerene-based single BHJ devices with WBG polymers having a band gap of over 1.90 eV. A tandem solar cell was also demonstrated successfully to show a PCE of 10.3% by combining a diketopyrrolopyrrole-based low band gap polymer.</P>

      • EV 2단 변속 구동 시스템 신뢰성 평가 기술 개발에 관한 연구

        최근 국내외 선진 완성차 업체에서 본격적으로 전기차 라인업을 확대할 계획을 발표하면서 전기차량의 구동시스템 성능 및 효율 향상 기술 개발이 활발히 진행되고 있다. 전기차 구동 모터는 전기를 이용하여 구동력을 발생하는 전장품으로 모터 축에 감속기를 연결하여 적절한 토크를 바퀴에 전달하여 차량을 구동시키는 부품이다. 본 연구에서 개발하고자 하는 2단 변속기는 전기적으로 구동되는 구동모터의 동력을 고회전의 변속비 및 저회전의 변속비로 변환하여 출력시키도록 구성된 전기자동차의 자동변속기이며 주행환경에 맞게 수동 변속 모드를 선택할 수 있도록 함과 주행 중 주행속도에 따라 자동으로 변속할 수 있는 자동 변속 모드를 부여함으로써 연비 향상 및 안정적 주행이 가능하도록 하는 것이다. 이에 개발 완료된 시제품을 장착하여 운전자의 사용조건에 부합되는 내구신뢰성을 갖도록 실제 주행 도로의 수십 내지 수백 배의 가혹도를 갖는 내구시험모드 개발을 통해 내구시험을 단축시키는 것은 초기 시장 진입 기간을 단축하여 시장 경쟁력을 강화하는데 중요한 요소로 작용하게 된다. 본 연구는 전기차용 2단변속기 시스템을 개발하는 것을 목표로 유사차량의 실도로 주행환경 데이터(Road Load Data Acquisition)를 측정 하여 차세대 전기차종의 2단 변속기 부품의 최종 성능 평가 항목 및 목표 하중을 도출하고 내구 신뢰성 평가법을 개발하였다.

        A Study on the Risk Recognition and PROTECTION of Semi-Permanent Makeup in Female Students

        Purpose: Since ancient times, the culture of putting on wounds or paints on the body like a tattoo has been carried on until now. In modern times, the interest, popularity, and market potential of semi-permanent makeup are increasing because it gives confidence and convenience as if wearing makeup. However, continuous research on safety is necessary because the risk factors for semi-permanent makeup are perceived in various aspects such as design, safety of ingredients, belief, worry, pain, and sanitary environment. Method: The researcher used the questionnaire method to construct questionnaire items with reference to previous studies. The questionnaire was constructed using a 5-point Likert scale and checklist. The questionnaire consisted of questions about demographic variables, the status of semi-permanent makeup, and risk perception factors. The subjects of this study were set as middle and high school girls and female university students from all over the country. The results were derived using frequency analysis. Results: The risk perception factors of semi-permanent makeup were design, eyebrow color, skin trouble, pain, and product and tool safety. However, there was an opinion(48.6%) that semi-permanent makeup should be performed by a beautician who is good at designing rather than a medical person. 46.4% answered that semi-permanent makeup is a type of makeup. However, as to the reasons for thinking that semi-permanent makeup should be regulated by the medical law, the highest responses were because it is more hygienic and the risk of infection is lower if it is done in a hospital and the difference in trustworthiness was the highest, and anesthetic cream was ranked next. Conclusion: According to the results of the study on risk perception and protection for semi-permanent makeup, it is recommended that a beautician with design and technology perform the procedure, but in terms of hygiene, infection, trust, and use of anesthetic cream, it should be regulated by the Medical Act. It is presumed to think that Therefore, as in the case of other countries, beauticians are allowed to perform semi-permanent makeup, but thorough education and management on semi-permanent makeup procedures, hygiene management, and safe use of products and tools are required.
