흡연규제의 정당성 문제

본 논문의 목적은 흡연규제의 정당성 여부를 검토하는 것이다. 이러한 목적에 따라 연구자는 밀의 위해원칙에 따라 흡연의 자유를 가정하는 입장을 제시하고, 흡연자의 흡연 행위에 대한 이성적 판단의 문제와 흡연 중독으로 인한 흡연자의 자발성 훼손 문제를 근거로 흡연규제의 정당성을 옹호하는 구딘의 입장을 제시하였다. 덧붙여 연구자는 이러한 구딘의 비판에 대한 두 가지 반론을 제시하였는데, 첫째 흡연자의 심리적 요인을 강조하는 사피로의 입장, 그리고 둘째 중독성 행위에 대한 부정적 판단을 전제하고 흡연 중독문제에 접근하는 구딘의 관점을 비판하는 오디의 입장을 제시하였다. 이에 따라 연구자는 위해원칙에 근거한 흡연의 자유를 옹호하는 논변이 부적절함을 밝힘으로써, 흡연 문제에 대한 국가적 차원의 관리와 규제 노력을 강조하였다. The aim of this thesis is to examine the problem in justification of smoking bans. With this purpose, I presented the argument for supporting free smoking on the basis of Mill`s harm principle. And I showed Goodin`s critic against this argument, which pointed out smoker`s irrational decision about smoking and smoker`s damage of autonomous decision ability to quit smoking caused by nicotine addiction. In addition, I presented two critics against Goodin`s argument for evaluating the appropriacy of the Goodin`s argument and these critics also have limits. The one is Shapiro`s critic about smoker`s psychology, and the other is Oddie`s critic about the relation between an addiction and the value. In this context, I proved it is inappropriate simply to support free smoking without social control based on Mill`s harm principle, and emphasized national efforts to solve smoking problems.

동물권 옹호론과 영장류 실험에 대한 윤리적 검토

리간, 싱어, 레이첼스 등이 주장하는 것처럼, 동물에게 도덕적 지위를 부여하는 입장 그 자체는 일정정도 설득력을 지니고 있다. 그러나 이것이 곧바로 동물실험을 금지한다는 주장을 함축하지는 않는다. 비록 우리가 동물을 우리의 도덕적 배려의 대상으로 인정한다 하더라도 그것이 동물과 인간을 동등하게 취급할 것을 함축하는 것은 아니기 때문이다. 결국 구명선의 예가 암시하고 있듯이 우리가 동물을 실험에 사용하는 것은 인간을 실험에 사용할 것인지 동물을 실험에 사용할 것인지의 선택 상황에서 동물을 선택하는 것으로 파악할 수 있다. 이런 입장에 대해 싱어는 종차별주의를 운운하며 반대할 가능성이 있지만 싱어 자신이 내세우는 “동물해방”이나 “이익의 평등한 고려 원칙” 역시 구명선의 상황을 염두에 둔다면 동물실험 자체를 전면 금지하는 논거로 사용될 수는 없다. 리간의 극단적 주장 역시 동물에게 인간과 동등한 내재적 권리를 인정하는 주장으로 확대할 수는 없어 보인다. 또한 동물권을 주장하면서도 레이첼스는 동물실험을 금지하는 입장을 취하고 있지는 않았다. 따라서 우리는 동물권 옹호론이 곧바로 동물실험 반대론이 되지 못함을 확인할 수 있다. 결국 문제는 최대한 동물의 도덕적 지위를 존중하여 동물권을 보호하면서도 어떤 제한된 조건에서 동물실험이 수행되도록 할지 살피는 일이다. 특히 본 논문에서는 영장류 실험에 대한 다음과 같은 윤리적 고려사항을 제시하였다. 첫째, 현실적으로 영장류 실험 목적이 추구할 만한 가치가 있는 것인지 검토해야 한다. 둘째, 실험동물 일반의 희생을 최소로 줄어야 한다(Reduction). 셋째, 다른 연구방법을 충분히 고려하여 고등동물보다는 고통감지 능력이 떨어지는 하등동물로 대체(Replacement)하는 방법을 고려해야 한다. 넷째, 영장류의 고통을 최소화하도록 실험방법을 정교화(Refinement)해야 한다. As Regan, Singer, Rachels point out, claims for animal right sound plausible. But this does not imply prohibition of all kinds of animal experimentation because this does not mean we must equally treat a human being and an animal although we must acknowledge our moral concern for animals. Our use of animals for experimentation may be explained as a decision bewteen a human being and an animal, as the example of a lifeboat shows. Singer, who may consider the above position as speciesism, will argue against speciesism. However, his "animal liberation" or "the equal principle of equal consideration of interests" cannot serve as an argument that all kinds of animal experiemtation should be prohibited if a human being should be used instead of an animal for scientific research. Even Regan's posisition may not be extended to be a claim that an animal has the same inherent right as a human being. In addition, Rachels claims for an animal right, but does not ban animal experimentation. So, we can conclude that claims for animal right does not directly lead to an argument against animal experimentation. The important issue is about what ethical consideration is needed preserving animal right in using animals for experimentation. The following requirements are presented in this paper when we use non-human primates. First, we should review the validity of research purpose to use non-human primates. Second, we should pay a special attention to the use of non-human primates because of the risk of infection. Third, we should reduce as little the number of animals as possible. Fourth, we should try to replace higher animals into lower ones with the consideration of alternative research methods. Fifth, we should refine research methods in order to minimize pain of non-human primates.

윤리학적 비판을 통한 사회생물학의 도덕교육적 문제

본 논문의 목적은 사회생물학을 윤리학적 관점에서 비판적으로 검토하는 것이다. 본 연구는 진화론의 기본 개념과 윌슨의 사회생물학에서 나타난 이타성 개념을 확인하고, 사회생물학적 이타성을 크게 세 가지 관점에서 비판적으로 검토해 보고자 하였다. 첫째 사회생물학적 이타성에 근거한 주장은 논리적 타당성과 심리적 수용성을 구분해야 한다. 둘째 만약 사회생물학적 이타성이 심리적 수용성을 주장한다면 심리적 이기주의가 지닌 문제로부터 자유롭지 못하다. 셋째 사회생물학의 도덕에 대한 설명 방식은 과학적인 이론이라기보다는 오히려 비과학적인 것으로 간주될 수 있다. 이러한 비판적 검토를 통해 연구자는 도덕교육적 관점에서 사회생물학 속에 잠재하는 두 가지 문제점을 제시하였다. 첫째 사회생물학은 도덕적 지향성의 문제를 답하기 어렵고, 둘째 사회생물학은 유전자결정론의 함정에 빠질 위험 또는 도덕상대주의의 문제를 배태하고 있다는 점이다. The purpose of the presented study is to critically review of sociobiology in the context of moral education. According to this purpose, the author in the present study tried to confirming the concept of evolution and altruism in sociobiology and suggesting its three kinds of problems in sociobiology through critical review. Firstly, the logical validity and psychological adaptiveness should be separated on the meaning of altruism in the sociobiology. Secondly, if sociobiology claims psychological adaptiveness, then it is not free from the criticism of psychological egoism. Thirdly, the excessive explanation of morality based on sociobiology could be unscientific methods. With theses perspectives, we should realize it when we consider moral education that sociobiology may not fulfill the ultimate moral aims seeking moral betterment and sociobiology is at risk for falling gene determinism.

프롬의 사랑론에 관한 연구

본 논문의 목적은 프롬이 제시한 사랑의 의미와 실천 방법을 검토하는 것이다. 이에 본 논문에서는 프롬의 사상적 배경과 함께 그가 제시한 사랑론의 이론적 근거, 사랑론을 구성하는 주요 내용 및 프롬이 규정한 사랑의 대상, 그리고 사랑의 실천 방법을 중심으로 살펴보고자 한다. 현행 고등학교 선택 과목인 『생활과 윤리』교과에서는 ‘성과 사랑의 윤리’를 학습 주제로 제시하고 있으며, 이에 따라 현행 교육과정을 따르는 교과서들에서는 해당 영역에서 프롬의 사랑에 관한 입장을 학습 요소로 제시하고 있다. 따라서 본 논문에서 다루는 프롬의 사랑론에 대한 원전 중심의 종합적인 검토는 교과 내용 및 교수학습 과정에 기여할 것으로 기대한다. The purpose of this thesis is to exam the From's love Theory, which suggesting the meaning and practical methods of love. The current high school subject, 'Life and Ethics' presents Fromm's Love Theory in the learning subject of the ethics of sex and love. So some textbooks handles the Fromm's theory. Therefore, Specific understanding about the Fromm's theory will be expected to devote to the learning and teaching process. In this thesis, we will examine the Fromm's theoretical bases, the main idea about love and practical methods of love on his academic backgrounds.

스토아학파의 덕에 대한 이해

본 논문의 목적은 전체적인 스토아사상을 이해하는 가운데 그들이 제시한 덕의 개념을 이해하고 그 의의를 확인하는 것이다. 이러한 목적에 서 연구자는 스토아사상의 전개 과정을 간략히 소개한 후 스토아학파가 제안한 덕 개념이 지닌 두 가지 특징을 제시하였다. 3장에서는 덕 개념이 자연주의적 관점과 결합하는 방식과 자연주의적 관점에서 도덕적 정서를 포섭하고자 하는 그들의 시도를 검토하였다. 이어진 4장에서는 스토아학파가 제시한 덕의 성숙(발전)을 개인적 관점과 사회적 관점으로 나누어 제시한 후, 결론에서 스토아사상이 현대 덕 윤리에 대한 일종의 대안적 가치를 제공하며, 윤리와 자연과학의 관계 설정 등에 대한 최근의 논의에도 중요한 시사점을 제공할 수 있음을 밝혔다. The purpose of this paper is to understand the concept of virtue presented by Stoicism, and discuss the moral educational implications. According to this purpose, I briefly introduced the background and development process of the emergence of the Stoa idea in Chapter 2 and presented the characteristics of the concept of virtue proposed by the Stoa school. In the following Chapter 3, I presented how the concept of maturity of virtue can be combined with the naturalist view, and the discussion in which they embrace moral sentiments from the naturalist point of view. and in Chapter 4, I discussed the moral maturity of the Stoics by dividing their views into individual and social perspectives. Finally, I expected that these Stoa ideas have a kind of alternative value for modern virtue ethics, and that they can also provide important Insights in establishing the relationship between ethics and natural science, which is being actively discussed today.

실험동물과 윤리

본문의 목적은 동물실험에 이용되는 실험동물을 위한 실천 가능한 윤리적 접근 방향과 개 선점에 관한 기초를 탐색하는 것이다. 이러한 목적에 따라 2장에서는 서양 역사에서 발생한 동물실험의 사례와 시대적인 배경, 그리고 동물에 대한 관점의 변화에 대해서 확인해 보고자 한다. 특히 근대 계몽기에 접어들면서 활발하게 논의된 동물에 대한 철학적 검토 내용과 동 물실험에 관한 찬반론이 발생하게 된 원인을 함께 살펴보고자 한다. 3장에서는 오늘날 실험동 물에 대한 윤리적 고려가 성숙하면서 정비된 동물실험의 윤리적 원칙(3R)이 지닌 의의를 제시 하면서 동시에 3R이 실험동물에 대한 윤리적 접근법으로서는 적지 않은 한계를 지니고 있음 을 지적하고, 마지막으로 실험동물을 위한 윤리적 관점에 확립에 관하여 추가로 보완되어야 할 윤리적 쟁점을 1)동물실험의 정당성과 2)동물실험의 위험과 이익의 고려 관점에서 검토해 보고자 한다. The aim of this thesis is to examine the practical basis of ethical direction and improvement for experimental animals. With this purpose, I confirmed the animal experiment cases and historical backdrop in western history with the changing viewpoints about animals. With these, I specially examined the cause what made the difference in the animal experiment, and what were the various philosophical positions about animal of modern periods. And I found the 3R’s significance and limitation, which was followed by the growing ethical concerns about experimental animals. Besides, I examined ethical issues on the animal experiment with justification and proportionate harms&benefits concerns.

메타윤리학의 도덕교육적 함의

본 논문의 목적은 메타윤리학의 내용을 소개하고, 메타윤리학적 관점의 도덕교육적 함의 를 검토하는 것이다. 메타윤리학은 도덕의 속성, 도덕과 관련된 우리의 진술이나 태도, 도덕 적 판단의 성격 등을 탐구함으로써 규범윤리의 근거를 제공한다. 이러한 메타윤리학의 연구 대상은 크게 윤리학적인 용어 또는 도덕 판단의 가치에 관한 연구(의미론), 도덕적 사실의 존 재에 관한 연구(존재론), 도덕의 인식론적 정당화 가능성에 관한 연구(정당화론) 등으로 구분 된다. 이러한 메타윤리학적 접근의 도덕교육적 함의는 크게 세 가지로 제시될 수 있다. 첫째, 학 생들은 메타윤리학적 검토를 바탕으로 학생들이 자신이 이해하고 있는 도덕개념의 의미를 좀 더 깊이 있게 재검토할 수 있다. 둘째, 메타윤리를 이해하고 있는 학생들은 도덕과 관련 한 제 주장들이 가정하고 있는 도덕적 사실에 관한 입장들을 쉽게 구분할 수 있다. 셋째, 학 생들은 다양한 분야에서 제안되는 도덕적 주장들의 정당성 여부를 비판적으로 검토할 수 있 는 능력을 향상시킬 수 있다. 연구자는 상기에 제시된 메타윤리에 대한 이해와 메타윤리의 도덕교육적 함의를 근거로 하여 보다 발전된 도덕과 교육과정을 제안하고자 하였다. The purpose of this thesis is to introduce meta-ethics and address its moral educational implications. Meta-ethics provides us normative base by studying moral property, our statements or attitude about morality, characters of moral judgments. Meta-ethical subjects are divided into three domains mainly: semantic subject of ethical terms or moral judgements, ontological subject of moral fact, moral justification subject of empirical justification possibility. We can find three moral implications through meta-ethical approaches on morality. Firstly, students can understand moral concept more deeply by examining moral term with meta-ethical approaches. Secondly, students can easily divide moral arguments into moral positions which already have different suppositions of moral fact. Thirdly, students can improve critical thinking about plausibility on moral arguments which proposed various fields. With these moral implications, I propose some applicable sections on the current moral education curriculum.

소셜 미디어(Social Media)를 이용한 마케팅(Marketing)에 대한 윤리적 고찰

본 논문의 목적은 오늘날 확산하는 소설 미디어를 이용한 기업의 마케팅 활동에 대한 윤리 문제를 살펴보고 그 대응 방안을 모색하는 것이다. 이러한 연구 목적에 따라 연구자는 소셜 미디어를 활용한 마케팅에 대한 윤리적 고찰의 필요성을 간략히 살펴본 후, 소설 미디어 마케팅의 윤리적 문제를 1) 마케팅 영역 일반에서 일어나는 전형적인 윤리문제와 2) 소셜 미디어 마케팅 과정에서 발생하는 특수한 윤리적 문제 등으로 구분하여 각각 검토하였다. 특히 후자의 문제에 관해서는, 기업이 소셜 네트워크 서비스 등을 통해 자사 제품에 대한 다른 소비자의 긍정적 의견을 가장하여 잠재적 소비자를 현혹하는 문제, 그리고 소셜 미디어를 통해 소비자의 사생활 보호에 민감한 정보나 소비자 활동 전반에 대한 정보를 획득하여 마케팅 등에 활용하는 문제를 중점적으로 논의하였다. 이상과 같은 논의를 통해, 연구자는 소설 미디어 마케팅의 윤리적 대응 방안을 1) 소셜 미디어를 이용한 비윤리적 마케팅에 대한 제도적 관리방안 마련, 2) 윤리적 소셜 미디어 마케팅 환경의 조성을 위한 기업 및 소비자 교육 등으로 제안하였다. The aim of this thesis is to examine the ethical problems of marketing fields by using of social media, and to seek the proper countermeasures. With this purpose, At first, I presented the urgent needs and reasons for this research and reviewed the ethical problem of social media marketing with classified 1) typical problems on the marketing domain and 2) special problems on the social media marketing domain. Specially on the latter problems, I focused on two problems: first, the deceitful marketing method by disguising their rigged advertisement with the real buyers’ positive attitude and praise. second, the obtaining and using of the buyer’s private information and his/her purchasing activities on the social media. with these discussion, I emphasized as the ethical countermeasures to cope with this situation on social media marketing with two parts: to arrange the supervision plan for preventing online seller’s unethical marketing behavior on social media, to reinforce the ethics education for marketer and buyer to fomenting ethical social media marketing environment.

장애와 의료 기술의 관계에 대한 윤리적 성찰: 의료적 치료 중심에서 사회 정의의 관점으로

The aim of this thesis is to examine the meaning of disabilities related to medical technology and to suggest the necessity and new direction for better bio-ethical perspectives on disabilities grounded in human dignity. With this purposes, I divided the on disabilities with Medical Model and Social Model and examined the each contents critically. Especially, I compared the ethical problems of abortion caused by sex selection and non-disabilities selection for showing that biological bias of disabilities is prevalent on medical contexts and social recognitions on the disabled. According to this thematic development, I suggested that we should cast away prejudices on the disabilities and we should expand ethical consideration for the disabled based on universal human dignity.

인공지능이 생명의료 영역에 제기하는 윤리 문제

본 논문의 목적은 최근 급속도로 발전하고 있는 인공지능의 발전과 의료 영역에로의 도입과 관련한 윤리 문제를 검토하는 것이다. 이러한 목적에 따라 2장에서는 인공지능에 대한 이해를 위해 인공지능에 대한 개념 정의와 관련한 내용을 검토하고, 인공지능에 대한 인간의 초창기 상상의 단계부터 기술의 전문화 과정과 최근 신경망을 활용한 인공지능 기술의 접근방식에 대해서 함께 살펴보았다. 이어진 3장에서는 생명의료 분야에서 인공지능의 도입이 제기하는 윤리적 문제를 5가지 영역(의료진의 대체 가능성, 인공지능에 대한 신뢰 가능성, 의학적 발전과 인공지능의 관계, 프라이버시 보호, 공정성과 정의의 과제)으로 설정하여, 그 답을 검토해 보고자 하였다. The purpose of this paper is to examine the ethical issues related to the recent rapid development of artificial intelligence and its introduction into the medical field. In accordance with this purpose, Chapter 2 reviews the content related to the definition of the concept of artificial intelligence in order to understand artificial intelligence. From the initial stage of human imagination to artificial intelligence, the process of specialization of technology and artificial intelligence using neural networks recently We looked at the approach of technology together. In Chapter 3, I divided the ethical issues posed by the introduction of artificial intelligence in the bio-medical field into five areas (substitutability of medical staff, reliability of artificial intelligence, independent development of medical technology, privacy protection, and issues of fairness and justice) and tried to review the answers.
