스토킹처벌법상 온라인 스토킹 행위의 유형과 적용범위에 관한 연구

이 연구는 현행「스토킹처벌법」제정 이전, 온라인 스토킹 행위에 대하여 「정보통신망법」상 유죄가 확정된 판결을 중심으로 온라인 스토킹의 유죄 인정의 쟁점과 그 유형들을 확인하였다. 이를 통해, 현행법상 온라인 스토킹의 유형과 적용범위의 한계를 파악하고, 추후 개정 시 참고할만한 근거를 제안하였다. 자료수집을 위해 2013년 이후, 「정보통신망법」제44조의7 제1항 제3호로 1심 판결문을 중심으로 총 138건을 검토하였고, 이 중 주요 판례 24건에 대하여 쟁점과 한계를 논의하였다. 검토 결과, 현행법상 ‘도달하게 하는 행위’에 대하여 우리 판례는 온라인상 게시물, 영상 등의 유통 등도 실효적으로 폭넓게 인정한 것을 확인하였다. 또한, 온라인 스토킹이 다양한 유형으로 광범위한 대상에게 이루어지고 있어, 피해자 보호의 한계를 발견하였다. 이에 따라, 개인정보를 수집·이용·게시·배포하는 행위 등을 이용한 온라인 스토킹을 규제행위에 추가할 것을 제안하였다. 나아가, 미국·독일 등 온라인 스토킹 상대방을 제3자로 규정한 것을 참고하여, 그 범위를 합리적으로 개정할 필요성도 강조하였다 This study has been conducted to suggest the direction of revision of online stalking regulations under the 「Act on Punishment of Stalking」. It was intended to find various stalking cases and the court’s judgment on them through the precedents analysis of the 「Act on Promotion of Information and Communications Network Use and Information Protection, etc」. The Korean court case site called ‘the judgment reading system’ was used for analysis purposes. Based on 「Act on Promotion of Information and Communications Network Use and Information Protection, etc」of the 138 first instance judgements convicted, finally, 24 clear precedents were used by excluding those that did not satisfy the purpose of the study. Although, the research identified that the expansion of the meaning of an “act of reaching” includes the act of posting articles on the Internet, at the same time, there are still ambiguous and unclear part of the laws that should be interpreted. Furthermore, there was a gap between the actual online stalking cases and the range of stipulated punishment. As a result, this study suggests further discussions, which include clearer criteria for interpreting the law, and definitions of determining the types of online staking behavior and the range of victims.

Purpose: The purpose of this study was to understand the degree of nursing professional intuition, major satisfaction, clinical practice satisfaction, self-leadership, and career preparation behavior of nursing college students, and to identify factors that influence career preparation behavior. Method: This study was a descriptive research study to analyze the factors affecting career preparation behavior. The data collection period was from August 03 to 30, 2020 for 4 weeks. The survey conducted an online survey of 220 students in grades 3-4 who were enrolled in 6 nursing departments located in P metropolitan city and G province, and have clinical practice experience. The collected data were analyzed using SPSS Win 20.0 program. Results: Career preparation behavior had a significant positive correlation with nursing professional intuition(r=.455, p<.001) and self-leadership(r=.539, p<.001), and major satisfaction(r=-.337, p<.001) and clinical practice satisfaction(r=-.380, p<.001) had a significant negative correlation. Self-leadership(β=.424, p<.001) was the most significant factor influencing the study subjects' career preparation behavior, nursing professional intuition(β=.170, p=.010), clinical practice Satisfaction(β=.127, p=.047), employment information(β=.122, p=.023), major satisfaction(β=.137, p=.042) in the order, these variables were found in the order of The explanatory power of the factors affecting the subject's career preparation behavior was 40.2%. Conclusion: Therefore, in order to help nursing students' career preparation behavior, a strategy to provide a variety of employment information and a strategy for nursing intervention that can improve self-leadership, clinical practice satisfaction, and major satisfaction is required.

2020년 전자서명법 개정으로 공인인증서가 폐지됨에 따라 자체 인증 기술의 도입이 필요한 실정이다. 특히나 COVID-19로 인한 비대면 상황이 지속됨에 따라 기존 아날로그 방식을 통해 대면으로 계약서를 작성하고 수립하는데 많은 비효율적 문제가 대두되었다. 디지털 전환 가속화와 비대면 거래 확대로 인한 전자 신원확인 중요성이 점차 커지고 있음에 따라 전자 서명 및 전자 봉투 방식으로 계약할 수 있는 안전한 시스템 개발을 진행하고자 한다. 이를 위해 계약 시스템의 보안 요구 사항을 도출하였으며 최종적으로 NFT 연동을 통해 안전한 계약을 진행할 수 있도록 프로세스를 설계하였다. 시스템의 동작 방식을 표현하기 위하여 DFD 등을 포함한 Diagram 형태로 나타내었으며 실제 프로토타입을 제작 후 블록체인 네트워크에 연결한 뒤 테스트를 진행하여 시스템 검증을 수행하였다. 추후 이 시스템을 통해 B2B, B2C 모델 등의 모델 기반 다양한 거래와 계약이 가능하도록 구성할 예정이며 추가적인 연구를 진행하여 사용자 측면에서 더 간편하고 안전한 환경이 될 수 있도록 고도화 시키는 것을 목표로 한다.
