For the factory automation and unmanned machine operation, it is very important to manufacture highly reliable and efficient chip breakers for optimal chip control. In this research, using the CALMA CAD/CAM SYSTEM, the manufacturing process of 3-dimensional chip breakers is established. Using the results of the cutting test of the selected chip breakers with double-step grooves, the chip breaking mechanism is schematically analysed. An expression for the chip breaking relation is derived which considers chip material behavior following LUDWIK's stress-strain curve, chip breaking criterion and the shape of chip breakers. This contains the thickness of chip, the radius of chip curl, and the mechanical properties of chip materials. It is found that the expression agrees very closely with the experimental results.

재난 및 안전관리 기본법에 대한 입법평론

사회생활과 일상적 개인생활 대부분의 면모가 고도화·복잡화된 과학기술에 의존하는 현실에서 안전관리와 재난관리는 생명과 안전의 보호에 있어 핵심적으로 중요하다. 오늘날 위험과 재난은 개인적으로 관리·해결할 수 있는 단계를 넘어 국가 등 공동체의 차원에서 관리하고 대처해야 하는 단계에 이르렀다. 이에 국가와 공동체의 차원에서 생명과 안전 보호의 헌법적 책무에서 출발하여 안전을 관리하고 재난의 발생을 최대한 방지하는 한편 재난 발생의 경우에는 피해를 최소화하고 효율적으로 대처하며 또한 엄정하고 합리적인 책임규명과 구제 및 보상과 배상을 위한 근거, 체계와 절차가 입법적으로 정비되고 효율적으로 운용되어야 한다. 우리나라의 안전관리 및 재난관리 법제로서는 국가는 재해를 예방하고 그 위험으로부터 국민을 보호하기 위하여 노력하여야 한다고 규정한 헌법 제34조 제6항을 실현하기 위해 입법한 기본법으로서 국민안전처 소관 법률인 재난 및 안전관리 기본법이 있고, 이외 안전관리와 재난관리 각 영역에 다양한 소관부처별로 대단히 많은 관련 법령이 분산되어 존재하며, 또한 각 지방자치단체의 관련 자치법규가 약 1,000개 제정되어 시행되고 있다. 제19대 국회(2012-2016)는 복수의 일부개정 법률안을 바탕으로 재난 및 안전관리 기본법(약칭 “재난안전법”)을 일부개정(법률 제13752호)하였는데, 이와 같은 2016년 재난안전법 일부개정은 국회가 안전관리와 재난관리 체계의 입법적 정비에 대한 우리 사회의 입법수요를 인지하고 이를 실제 입법에 상당 정도 반영한 결과라는 점에서 긍정적으로 평가할 수 있다. 재난안전법 2016년 일부개정 법률은 재난안전통신망 구축과 운영, 재난대응절차 수립과 위기관리 표준매뉴얼의 작성, 재난대비훈련의 계획수립과 실시, 재난발생시 대규모 인명피해가 우려되는 시설에 대한 보험 가입 의무화, 재난관리책임기관의 장 및 국가기반시설의 장 등의 재난상황 및 수습상황에 대한 국민안전처 장관에게의 직접 보고 등을 법률을 통해 규정하고, 책임자로 하여금 일정 사항을 법률의 규정에 따라 국회 상임위원회에 보고하도록 하는 등, 기존의 법률을 안전관리와 재난관리를 위한 엄정하고 체계적인 실효성 있는 입법적 대비라는 입법목적과 체계정합성의 면에서 더한층 정치하게 정비하여 입법수요에 부응하고자 하였다. 입법의 필요성과 적시성 및 내용의 체계성, 관련 법제 전반에 비춘 체계정합성 등의 면에서 적정성 있는 방향으로 기존의 법률을 개선한 입법이라고 일응 평가할 수 있으며, 이후에도 개정을 통해 지속적으로 입법적 개선의 과정에 있는 점 역시 고무적이다. 향후의 입법적 과제로서는, 우리나라의 안전관리 및 재난관리 법제가 안전관리와 재난관리 각 영역별로 대단히 많은 관련 법령이 다양한 소관부처별로 분산되어 존재하는 현황에서 개념정의의 불명확성과 일관성 부족, 담당업무와 책임 주체의 불명확성과 중복, 법령 적용의 우선순위의 불명확성 등이 입법적으로 정비 및 해결되어야 하고, 재난의 실제 상황에의 구체적 대처나 책임의 규명과 보상 내지 배상 등 관련 규정들이 보다 정비되어야 한다. 안전관리와 재난관리 법제에서는 체계 전반을 통해 안전의 철저한 관리와 위험의 사전적 예방을 최우선적으로 지향하면서 동시에 재해·재난의 실제 발생시에는 유기적 구조 속에서 현장에서의 초동 단계에서부터 책임의 규명과 복구비의 지급 및 보상·배상의 과정까지 일관되고 효율적으로 이에 대처할 수 있어야 한다. 이를 위해 정확한 관련 정보의 수집과 분석 및 공유를 위한 근거와 체계 그리고 다양한 정부 소관부처간 및 정부와 민간간 업무의 분장 및 협조체계가 명확하게 규정되어야 하며, 대규모의 복합적 재난 발생의 경우에도 정부와 공공기관이 핵심적 기능을 중단 없이 수행할 수 있기 위해 관련 법령과의 유기적 체계정합성 하에서 이를 위한 근거와 절차 규정도 입법화되어야 한다. The consolidated safety and disaster management has an increasingly crucial importance in protecting life and safety of the individuals and the community as most aspects of personal and social life relate to and depend upon advanced and complicated technologies. Such safety and disaster management is beyond and outside of the control of an individual in most contexts particularly as the risk and the disaster in recent years tend to occur at a large scale with multidimensional aspects with complicated causes. This in turn demands the consolidated and effective management of safety and disaster by the government and public institutions based upon and pursuant to the coordinated and refined legislation for the grounds for and the institutions of safety management, risk prevention, damage minimization and restoration, and liability and compensation, as mandated by the Constitution of the Republic of Korea for the obligation of the state and the government to prevent risk and protect life and safety for and of the people (Article 34(6) of the Constitution). As such, Korea has the statute bearing the nature of basic law in the area of safety and disaster management of the Framework Act on the Management of Disaster and Safety (Law No. 13752; hereinafter referred to as the “Act”), with significant number of other statutes in respective areas of safety management and disaster management under many different departments within the executive branch of the government, also with approximately 1,000 ordinances and local laws of the regional governments. The 19th National Assembly of the Republic of Korea (2012-2016) revised the Act in part in 2016 based on eight bills submitted for the partial revision of the Act. Such 2016 partial revision of the Act, as further revised in the 20th National Assembly, reflects to a considerable degree the legislative demands for the further consolidated, consistent, refined and effective statutory grounds for the safety and disaster management in the Korean society. As such, the 2016 Act has brought changes to the statutory provisions and the actual operation for and of the communications network for information and notification in the risk and disaster situations, the standard manual and protocols for disaster response and control, the general plans for the procedures and the operation of disaster prevention practice drills, the mandatory subscription of insurance for all facilities with potentially large-scale casualty in case of occurrence of a disaster, and the direct report obligation applicable to the parties responsible for immediate response and control at each facility under the direct control of the Secretary of the Ministry of Public Safety and Security of the Republic of Korea, with further obligation to report to the relevant standing committee of National Assembly as and if required. Such 2016 revision of the Act has timely and positively contributed to the heightened consistency and effectiveness both within the Act and across the relevant statutes and other local laws in the area of safety and disaster management in Korea, in response to the legislative demand. The legislative goal of the Act requires ongoing efforts, with the following challenges and tasks to be met. Particularly as the relevant statutes and local laws exist across extant fields of safety and risk and disaster with many departments within the government while also requiring close coordination between the government and the private sector, an ongoing effort is due for the clarity and consistency of the definitions of relevant terminologies and the designation of obligations and liability of respective departments and facilities, the clarification of protocol and priority in application of various relevant statutes, and the matters pertaining to liability and compensation.

South Korea’s Electoral System from Constitutional Democracy Perspectives

South Korea is currently facing a new social change of ethnic and cultural diversification due to a rapid increase in the immigrating population. Such a social change is expected to be further expedited due to ongoing globalization. From a constitutional law standpoint, such a change accompanies most fundamental issues for the law of the constitution of fundamental rights protection of minorities in a representative democracy and of the representation and participation of minorities in the political process. This paper primarily looks into in this vein the system of representation and participation in political processes by means of public elections. South Korea has a positive precedent of bringing changes into the institutions and the practices through proactive legislative efforts and decisions of the Constitutional Court, for example, in increasing the representation of women as political, social and cultural minorities in the political process at the national and local levels, through changes in relevant law and system of public elections. This precedent may serve as an exemplary model for the situation of rapid ethnic diversification and anticipated constitutional law issues of representation and inclusion of minorities into the overall constitutional-political process.

Seam seal welding on the semi-conductor package is a process for sealing the packages of semi-conductors, crystal parts, saw filters, oscillators with lid plate by seam welding. This paper present the development process of automatic seam seal welding system. In this process, the process algorithm, high precision welding current control, design of welding head, high speed and high precision feeding mechanism, user interface process control program technologies are included.

This paper studies the experimental and numerical analysis of the residual stresses on the surfaces of the high strength thick plate with 20mm thickness or more which undergoes the working of plastic bending. The hole drilling method is used for measuring the residual stress experimentally at several conditions considering the rolling directions of the plate, bending angles and bending axes. Also for comparing with the experimental results and developing the modeling technique the finite element analysis using the ANSYS package has performed. Using the result, the design for reducing the manufacturing time and cost can be achieved by changing the processes from welding to bending.
