        정보화 사회에서의 개인정보권의 침해와 그 구제

        In an information society, the life styles have been changed in quality as well as quantity, while a serious problem has being occurred in the area of an infringement of private information right. For instance, there seemed an critical infringement of private information right when the 720,000 items of private information revealed from the National Corporation of Health and Care in April, 2008. This study reviewed the problem of protection of private information, especially in the private information on the Internet focusing on the civil law. The right of private information includes in the personal rights and it covers from the stages of collecting information to the treatment of the information, so it should be protected by the rights such as a right of claim for damages or a right of exclusion for disturbance. This paper analyzed the types of infringement in treating information into three stages: collecting information, using or preserving information, and destroying information. As a means of rescuing the information privacy, the study also reviewed a right of claim for damages or a right of exclusion for disturbance. As a result, the claim for damages should be approved in the cases of illegal collection of personal information, violation of utilizing contract, or illegal behavior of the infringement. However, the treatment of private protection is not enough for the solution after the fact of its infringement. So, this study discussed the method of protection before the fact of infringement. In conclusion, the protection of infringement of personal information may not be sufficient by the systems in civil law mentioned above such as a right of claim for damages or a right of exclusion for disturbance. The broad and various methods for its protection should be discussed within a field of civil law.

        현행 민법상 후견제도의 문제점과 성년후견제도의 도입에 관한 고찰

        Recently, legal problems related to the elderly people have been the critical issues in ageing society of the world. Adult guardianship system is included in the area that the legal researchers should consider. In fact, according to the process of ageing society, people who cannot treat their property or personal problems have increased because of their physical or psychological disabilities. So, the social security system to protect or support for the disabled should be a critical issue. Almost all people are inclined to suffer from physical and psychological regression on the progress of aging. One of the symptoms is a general trend that they cannot stand on their feet without others` support. On the other hand, they will suffer from memory problem because of their physical regression or judgement disorder though it is not caused by serious diseases such as senile dementia or stroke. The elderly who suffer from those kinds of diseases may well be an target of various wicked crimes. A rapid progress of a nuclear family structure make the elderly isolated from the family member and excluded from economical benefits. This study focuses on the guidance of the elderly based on the social system. In current civil law system, however, a system of an incompetent person is classified as three categories relied on the rigid and monolithic standard: a minor, a quasi-incompetence, and an incompetence. The three systems, such as a quasi-incompetence, an incompetence, and guardianship system, are the major structures for the elderly and the mentally disabled. However, the current legal system has not protected the property and personality for the people of lacking communicative ability and the elderly people of physical impediment, so the guardianship should be supplemented. The legal structure for the guardianship system should be immediately established in order to support the elderly, which is separated from the system for an incompetent person. The system should value the right of the person`s own determination and be revised for practical supporting those who need the guardianship. In advanced countries, they already established a legal adult guardianship system as a way of protecting a self-determination right of the elderly and the disabled. The system also prevents them from illegal disadvantages, mistakes, or immature activities. This study, first, reviewed the problems of current legal system in quasi-incompetence, incompetence, and guardianship system. Second, it pointed out an adult guardianship system in foreign countries and discussed the introduction and the solution of the system in Korean society. Third, this paper concluded that the legal system of an adult guardianship should be enacted for an ageing society in Korea.

        경기도 일부지역 상수도서비스 향상을 위한 시민 만족도 조사

        현행 수돗물 수질검사서비스를 보다 발전적이고 적극적으로 실시하기 위해 시민들의 의견 및 수질검사서비스 만족도 관련 설문조사를 활용한 조사 및 분석으로 향후 시민들의 입장에서 수질검사서비스의 질(Service Quality) 향상을 위한 자료로 활용하고자 한다. 조사기간은 2020년 10월 26일부터 30일간이며, 연구 대상으로는 수원시 상수도사업소에 민원업무를 접수한 이용자와 수원시 및 인근지역 시민으로 유효 표본 집단 총 497명이다. 연구 방법으로는 구조화된 조사표를 이용한 전화 및 면담 설문조사로 진행하였으며, 조사항목은 수돗물 이용에 따른 만족도와 개선사항이다. 상수도서비스의 만족도를 평가하는 각각의 항목들은 Likert 5점 척도로 측정하였다(매우 만족 5점, 보통 3점, 매우 불만족 1점). 수원시 상수도서비스의 객관적 만족도 평가에 영향을 미치는 요인들을 각각 독립변수로 하여 다중회귀분석을 실시하였는데 그 결과는 유의수준 0.05로 하여 수돗물 음용요인, 수질관리 요인, 물 공급서비스 요인, 요금부과 및 납부, 업무처리 요인 등 총 5개 모두가 통계적으로 유의한 것으로 나타났다. 표준회귀계수(Beta)값을 비교해 보면 수질관리요인, 업무처리만족도, 요금부과 및 납부 순으로 나타나고 있는데 통계적 결과가 나타내는 의미는 상수도서비스에 영향을 미치는 수질관리개선노력, 상수도사업소 직원의 업무처리만족도, 수도요금 등에 대한 개별요인들의 만족도가 클수록 상수도서비스에 대한 만족도가 상승된다고 할 수 있다. 수원시의 수돗물 음용에 대한 평가에서는 수돗물을 직접 음용한다는 비율보다 정수기나 생수를 음용한다는 비율이 훨씬 높은데 이는 식수로 이용하기가 불안하고, 물맛이 좋지 않다 라는 의견이 제시됨에 따라 수돗물의 직접 음용을 높이기 위해서는 정기적인 수질검사와 수질개선 관리로 수돗물을 직접 음용해도 안전하다 라는 홍보가 필요할 것으로 생각되어진다. 수돗물 수질에 대해 신뢰한다는 수준이 신뢰하지 못한다는 의견보다 높게 나온 것은 수돗물에 대한 신뢰가 있기 때문에 향후 수돗물 수질관리 유지에 대한 노력과 보다 높은 수질개선을 위한 행정적 절차를 마련하여 안심하고 음용할 수 있는 수돗물을 안정적으로 제공하여야 할 것이다. 수원시 상수도 사업소의 종합 만족도는 업무처리 정확성이 가장 높았고, 그 다음으로 담당직원의 친절성, 전반적 만족도, 업무처리 신속성 및 담당직원 전문성으로 조사되었기에 상수도 사업소 직원의 전문성 강화를 위해 노력해야 할 것이다. In order to more develop and actively implement the current tap water quality test service, a survey on citizens opinions and satisfaction with the water quality test service will be conducted and used as data for improving the quality of the water quality test service from the perspective of citizens in the future. The survey period is 30 days from October 26, 2020, and the target is a total of 497 effective sample groups, including users of civil complaints at the Suwon Waterworks Office and ordinary citizens of Suwon. As a method, telephone and interview surveys were conducted using a structured survey table, and the survey items were satisfaction and improvements due to the use of tap water. All of the individual items constituting the satisfaction dimension of the water supply service of the respondents surveyed were measured on a Likert 5-point scale (5 points for very satisfaction, 3 points for normal, 1 point for very dissatisfaction). In order to analyze the factors influencing the overall satisfaction evaluation of water service in Suwon, multiple regression analysis was conducted with five factor scores as independent variables, and the results were statistically significant, including tap water drinking factors, water quality management factors, water supply service factors, and business treatment factors. Comparing the standard regression coefficient (Beta) values, water quality management factors, business treatment factors, rate imposition, and payment, which means that the higher the water quality management (improvement), water treatment satisfaction of employees, and water rates, the higher the overall satisfaction score. Suwon City s evaluation of drinking tap water shows that drinking tap water or bottled water is much higher than drinking tap water directly, which is unstable to use as drinking water and that it is safe to drink tap water directly in the future. The level of trust in tap water quality was higher than the opinion that there is trust in tap water, so special attention and improvement measures should be taken to supply clearer and cleaner tap water stably. Suwon-si Waterworks Office s overall satisfaction was the highest in business processing accuracy, followed by kindness, overall satisfaction, speed of business processing, and expertise of the staff, so efforts should be made to strengthen the expertise of the staff.

        民法 第366條의 法定地上權

        The main case of legal superficies in various situation is the superficies law in act 366 of civil law. The same owner of a land and a building can hold the right of employing the land for the purpose of the building as his/her own property right though the owner permits mortgage of either a land or a building. However, the other new owner who takes one of properties by the auction should take up the right of employing it as his/her own legal right. In this case the problem between a land owner and a building ower can occur. As a resulting of the auction that they have not intended before, they do not mention the agreement of making use of the separated properties such as ground right engagement contract or land lease contract. The building owner should get rid of the building when they cannot negotiate on the matter each other. Civil law provides act 366 for the right of the separated owner in order to avoid this kind of irrational dispute. The law guarantees the right of a building owner in using the land that belongs to the building, because the law interprets that the land owner has already intended to provide legal superficies for the building owner in case that the right of two properties should be separated by auction. This article studies the previous researches and iudgments related with the established conditions on legal superficies in act 366. The purpose of this article is to make a clear interpretation of the concept of legal superficies, and tries to apply it on the effectiveness in order to provide an appropriate solution in the area.

        유독물지정제도에 대한 유해화학물질관리자 및 전문가의 인식도 분석 연구

        Objectives: Poisonous substances experts engage in policymaking regarding poisonous substances, whereas poisonous substances managers perform legal duties related to poisonous substances management systems at worksites. To understand and improve poisonous substances designation systems, it is necessary to distinguish the roles of these experts and managers. We further aimed to identify problems with poisonous substances appointment systems and provide basic data for their improvement by investigating the knowledge and recognition of the need for system improvement among managers and experts. Methods: To determine the $subjects^{\circ}{\emptyset}$ awareness of poisonous substances designation systems, a selfadministered questionnaire comprised of items on general characteristics and knowledge and recognition of the need for system improvement was issued. Data were analyzed via t-tests and ANOVA using SPSS v 16.0 Results: Regarding system comprehension, managers (n=213; mean 3.28, SD 0.63) significantly differed from experts (n=35; mean 4.08, SD 0.59) (P<0.001). No differences were found in recognition of need for improvement between managers (mean 3.11, SD 0.34) and experts (mean 3.24, SD 0.31). Significant differences in comprehension were found among managers by education level (P<0.05) and company size (P<0.05). Regarding industry type, comprehension was greater in the electrical/electronic and chemical/environmental industries compared to in other industries (P = 0.066). Comprehension was higher among those with five years or more of experience compared to those with less than five years. Regarding recognition of need for improvement, managers showed significant differences by company size (P<0.05). $Experts^{\circ}{\emptyset}$ comprehension showed no differences by general characteristics, while need for improvement differed according to work experience (P<0.001). Conclusion: The study found that the bigger the company size, the higher the level of comprehension by managers and the experts. In the case of both groups, where a higher comprehension of the poisonous substances designation system was evident, they recognized the necessity of its improvement.
