최근 이동보호관찰(MOPIS)나 위치추적장치(전자발찌)의 도입 등으로 가해자에 대한 보호관찰제도가 활성화되었으나, 피해자를 중요한 존재로 인식하는 회복적 사법제도는 아직 미미한 실정이다. 회복적 사법은 뉴질랜드 마오리족의 전통적 사법을 기원으로 하여, 오늘날 ‘피해자와 가해자의 화해(Victim-Offender conciliation),’ ‘가족단위협의회(Family Group Conferencing),’ ‘양형 모임(Sentencing Circles)’의 세 가지 모델이 주로 시행되고 있고, 그밖에 금전배상(restitution), 사회봉사(community service), 보상(reparation)의 방식이 이용되고 있다. 한국 보호관찰에서도 회복적 사법이 부분적으로 실천되고 있다. 학교폭력예방을 위한 피해자와의 만남 프로그램, 교통사범 교육현장에서 교통사고 피해자 초청, 가정폭력·성구매자·성폭력행위자 수강명령에서 피해자와의 만남, 판결 전 조사 및 결정 전 조사, 사회봉사명령 등이 회복적 사법제도로서 시행되고 있다. 최근에는 소년법과 보호관찰 등에 관한 법률이 개정되어 회복적 사법 관련 조항이 강화되었다. 회복적 사법은 피해자와 가해자, 지역공동체의 관계 회복을 통하여 범죄통제와 범죄자 재활이라는 목표를 달성해야 한다. Recently, probation about the criminals is revitalized thanks to the introduction of MOPIS and Tracking Devices. Restorative Justice focused on victims, however, is not so popular yet. Restorative Justice is originated from Maori’s traditional justice. These days, three models are going into effect, which are Victim-Offender Reconciliation, Family Group Conferencing and Sentencing Circles. Besides, forms of Restitution, Community service and Reparation having been used. Restorative Justice is partially practiced in Korea. The examples of the Restorative Justice are as follows: Encountering program between offenders and victims to prevent school violence, Inviting victims of traffic accidents to the offenders-training spot, Conference between victims and offenders of domestic violence sex traffickers sexual violence who are ordered to attend a lecture, Investigation before the judgment and decision, Community service order and etc. Lately, the provisions related with Restorative Justice are reinforced, thanks to the amendment of Juvenile Act and Protection and Surveillance, etc. Act. The purpose of Restorative Justice is as follows: Crime control and Offender-rehabilitation. We have to attain this purpose by restoring the relationship among victims, offenders and local community.

거버넌스시대 기초자치단체의 대응 -구미지역을 중심으로-

This paper tried to discuss response of local government facing governance era. Governance is intended to introduce a variety of residents' participating systems to revive the citizen's society and strengthen the foundation for that purpose, thus seeking the paradigm for decentralized operation of the nation. As widely accepted, governance has many meanings connected with controling method of interdependence activity. However bureaucracy do not make decisions as one-side and vertical like past but is form of public decisions that stakeholder in policy. Firstly, we reviewed the terms of governance and policy issues and policies on governance. And also survey on actual performer associated with governance in Gumi. Next, proposals of the development of policy in governance, role of local government are made in terms of construction of governance.

2008년에 도입된 전자발찌 제도는 일부 재범으로 인하여 우려의 시선이 없지 않지만 제도가 도입된 이후 4년간 성폭력범죄자의 동종 재범률이 제도 시행 전과 비교하였을 때 1/6 수준으로 줄어드는 등 재범억제에 탁월한 효과를 보였다. 그러나 제도 도입 5년에 이르는 동안 장기간 전자발찌 착용에 따른 피로감과 스트레 스가 누적됨에 따라 전자발찌대상자들의 의무·준수사항을 위반하는 정도가 증가하는 한편 사회적 파장이 큰 재범을 일으키거나 심지어 자살을 시도하는 등 전자발찌대상자 관리가 점점 더 어려워지고 있다. 본 연구의 목적은 전자발찌대상자의 스트레스 및 우울, 자살 등 정신건강에 대한 의 식을 조사하여 이들의 심리적 불안과 일상적인 감정 상태를 파악함으로써 전자발찌대상 자를 관리하는데 도움을 주는 한편 전자발찌에 대한 후속 연구 및 정책입안의 참고자료 로 활용하게 함에 있다. 이를 위해 성폭력 및 살인범죄로 전자발찌를 착용하고 있는 대 상자와 같은 범죄이나 전자발찌를 착용하고 않고 보호관찰만을 받고 있는 사람들을 비 례할당 표집방법을 사용, 랜덤샘플링 방법으로 240명을 표본집단으로 산출하여 설문조 사를 실시하였다. 또한 설문조사만으로는 알기 어려운 전자발찌대상자의 사회인구학적 특성을 보다 심층적으로 파악하기 위하여 전국의 전자발찌대상자 중 위험경보를 일으킨 상위 20% 고위험 전자발찌대상자의 이관경보를 분석하였다. 연구결과 전자발찌대상자들은 보호관찰대상자에 비하여 스트레스 초고위험군 비율이 3배 이상 많았으며, 일상적으로 우울감과 후회, 죄책감과 짜증 반응을 보이며 20.6%가 자살에 대한 상념에 빠져 있는 등 정신건강에 심각한 문제를 보이고 있었다. 아울러 전자발찌 착용자의 평균 부착기간이 장기화 문제, 가해제 허용 문제, 사회 부 적응 문제 등 시스템 운영 및 제도상 나타나는 문제점을 정책개선 사항으로 제언하였다.

4차 산업혁명 시대의 구미국가산업단지 내 제조업의 선도방안 연구

본 연구는 4차 산업혁명 시대에 구미국가산업단지에 소재한 제조업을 대상으로 국가경제의 위상과 글로벌 경쟁에 대응한 실태와 정보, 대응수준 등을 분석한 결과, 정책적 함의와 선도적 발전 방안을 제시하는데 있고, 다음과 같이 정책적 대안을 제시한다. 구미국가산업단지를 중심으로 범 광역차원의 「4차 산업혁명 구미시위원회」를 구성하고, 「4차 산업혁명 제조업지원단」을 직속으로 둔다. 구미시가 운영 중인 「기업사랑본부」를 「4차 산업혁명 기업사랑지원단」으로 개칭하고, 하부조직으로 「제도창조부」, 「운영혁신부」, 「지원기획부」를 둔다. 제조업은 플랫폼 중심으로 경영구조를 개선하고, IoT나 AI를 바탕으로 하는 디자인, 마케팅 및 AS 등의 서비스에서 가치를 창출하기 때문에 경영의 중심을 이동해야 한다. 구미국가산업단지에 「4차 산업혁명 제조업특구」를 지정하고, 5개 단지별로 「4차 산업혁명 선도기업」을 지정하거나 유치한다. 구미중심 광역경제권을 설정하되, 구미소재 중소규모 산업클러스터가 중심이 되어 타 지역 클러스터와 연결한다. 이외에 우수한 인재 풀로서 「4차 산업혁명 전문가단」을 발족하고, 실행T/F팀 구성, 산학연관 협력네트워크를 통한 선택과 집중의 정책집행이 필요하다. This paper aims to present policy implications and sophisticated growth strategy through the analysis of the current status of the national economy and responses to global competition among manufacturing firms in the Gumi National Industrial Complex amid the Fourth Industrial Revolution. This study suggests the following policy options. “Gumi Municipal Committee of the Fourth Industrial Revolution” needs to be organized for the Gumi National Industry Complex, and “Fourth Industrial Revolution Manufacturing Support Group” should be created under the committee. Corporate Support Headquarters being operated by Gumi City should be renamed “Fourth Industrial Revolution Corporate Support Group,” under which System Creation Division, Operation Innovation Group, and Support Planning Division are placed. The management structure of manufacturing firms should be improved by focusing on a platform. As values are created in the IoT and AI based services such as design, marketing, and customer service, the focus of corporate management should be shifted. In the Gumi National Industrial Complex, the “Fourth Industrial Revolution Manufacturing Special District should be created and “Leading Business of the Fourth Industrial Revolution” for each of five complexes needs to be designated or attracted. Gumi Greater Economy Zone should be designated and a small and medium-sized industrial cluster of Gumi needs to be connected to clusters in other regions. Besides, “Fourth Industrial Revolution Specialist Group” as a talent pool needs to be launched, and a task force team should be organized for execution. Selected and focused policies should be carefully implemented through an industry and university collaborative network.
