        The highest aim in the national economic policies is to build a common welfare state. The livelihood protection system, an important way of achieving the goal, has been securely maintained in the way that the government provides the necessary protection for those who belong to the low-income bracket or have no means of living at all, and thereby ensure to them the minimum standard of living and help them stand on their feet and lead a healthy and decent life. But, in the process of its enforcement, the system itself has disclosed some flaws. So, here I present some suggestions for the improvement of the system. First, the retraining of the welfare specialists and the more scientific and systemic methods of surveying is needed to provide for more reasonable criteria for deciding the beneficiaries. Second, the licelihood pay must be substantially raised to ensure the minimum standard of living to the beneficiaries by means of the support for the housing, enlarged job-related loand, diversified job training, the substantial pay raise in the job-producing projects, and the aids for schooling. Thirdly, a new complementary system should be introcuced to amplify the welfare services and make it possible to take the rehabilitative and at the same time preventive measures. Fourthly, a new medical protection program is needed to support for the medical expenses for the treatment of the diseses which can not be covered by the insurances. And also a health protection program should be considered. Fifthly, a new organization which will take exclusive charge of the various welfare policies should be established to integrate the welfare related jobs and to satisfy the enormously incresed desire of the public for the welfare system. It is concluded that in the era of globalization, these measures, if fully implemented, together with new welfare policies and the measures for securing the money that is needed, will form the basis of the welfare services satisfying the changing public desires, and of providing a pleasant and healthy life for the whole public.

      • 기본권론이 행정법학에 미친 영향

        공법학=기본권 해석학이라는 등식이 성립할 정도로 기본권 해석이 공법학에서 차지하는 비중이 커져가고 있다. 이러한 변화는 행정법학에서 특히 두드러진다. 이 글에서는 바로 이러한 현상에 주목하여 전통적인 행정법 총론 체계를 수정할 이론적 자극원으로서 기본권과 행정법학의 관계에 주목하였다. 글의 말미에서는 행정법 총론의 개혁방향을 세 가지로 나누어 놓았다. Sie war eher auf das Problem der Eigensta¨ndigkeit der VerwalhHg eingegangen. Der koreanische Rechtsstaat hat diese U¨berliefeNng in einem sehr stark auf das Eingriffs- und Sthrankenscherna beschra¨nkten Denken besta¨tigt. Jedenfalls ist es nicht nor eine Aufgabe der Staats- und Verfassungsrechtslehre, Grundrechte und ONndrechtstheorie in fem HEttelpunkt der o¨ffentlich-rechtlichen Dfskussion zu stellen. Aurh die Vorwalhmgsrechtslehre kann dazu beitragen, durch einen gHndrechtstreuen Ansatz die Rolle der Grundrechte fu stfirken, veil auch das Verwaltungsrecht sehr stark auf das Funktionieren der Grundrechte bezogen ist. Um einen Beitrag zur Dtskussion u¨ber die GHndrechtstopoi in der Verwalongsrechtsletre zu leisten, ist diese Albeit auf die AuswirhHgen der Gnmdrechte auf die Vfrwaltungsrechts-lehre fiher eulgegangen.

      • 環境計劃을 위한 費用-便益分析에 關한 硏究

        Today the developed countries increase their public expenditure to achieve the ultimate aim: improvement of well-being of the whole society through the adjustment of resource-allocation, the distribution of income and wealth, and economic stabilization. For this, cost-benefit analysis is come into wide use as a means to induce the economic principle to guide public opinion to press the authorities concerned not to waste the insuffcient resources but to make use of it effectively for public purposes. Cost-benefit analysis, one of appraisal systems which transit all impacts into the monetary unit for the purpose of comparing substitute plannings through net benefit, has an aim to minimize cost but to maximize benefit for the purpose achievement under the given conditions by means of measuring and evaluating a certain policy with the monetary unit. This analysis, as an auxiliary method to strategies for the decision of the amount of expenditure, has been used by the authorities concerned and policy makers for many years, and it is now getting more and more important. Especially in the field of environmental management, this analysis is inevitable because the authorities as well as individuals get more and more interested in managing environment but because any other market mechanisms are available as appropriate means to appraise environmental goods and environmental externality. While such a analysis has done much for deciding public policy and for formulating and establishing the object, it has a defect such that it ignores expense bear social stratum in need of benefit, but is concerned about only governmental benefit and neglects the consequent loss. It also has technical and administrative limits such as decision of discount rate, the problem of opportunity cost and problem of distributive impartiality. In addition, effects incapable of pricing in the field of environment and a lot of various spreading effectivenesses have many limits to application of such a monetary evaluation means. Under this conditions, the application of cost-benefit analysis to maximize the complex objective function between efficiency and impartiality asks for taking into deep consideration the preference of social members and value judgement of the people.

      • 環境汚染의 效率的인 規制方案에 關한 硏究 : 經濟的 誘引策을 中心으로 As a Part of Economic Incentives

        In modern society, the aspect of pollution has been enlarged to the unreliable degree of self-purification in ecosystems; an important problem to be preserved the environmental quality has been socially issued. The reason why these environmental pollutions have been emerged can be manifested by the two economic sides as followings; First, the concept of property right of environment can't be fully established, and further more it can't be emphasized. Second, the environmental goods has the public goods characteristic. Although we can adjust the regulation-conventional regulation of environment - in other words one way of regulation to the environmental pollution. Many kinds of unsolved problems in the efficiency have been emerged, so we should introduce the economic incentives what we call it fee charge and subsidization positively and we should make proper chance to utilize it. Thus, if we want to keep our environmental clean, in managing systems, instead of relying on the former sides of regulations. We must make the long projects of efficiency and collectivity.
