지능형 범죄수사 시스템을 위한 범용 디지털포렌식 온톨로지

디지털포렌식은 범죄와 관련된 디지털 증거를 수집, 분석하여 범죄혐의를 입증하는 과정으로 범죄수사에서 중요한 역할을 한다. 지금까지의 디지털포렌식 온톨로지에 대한 연구는 디지털포렌식을 사이버 관련 범죄에만 적용하였거나 디지털포렌식 자체의 절차와 기법에 관한 것으로 한정되었다. 본 연구에서는 다양한 유형의 범죄수사에서 디지털포렌식을 효과적으로 활용하기 위해 전반적인 수사절차와 디지털포렌식의 연관성을 분석하여 연계 모델을 설계하고 이를 바탕으로 디지털포렌식 온톨로지를 구축하였다. 온톨로지 구축시 포렌식 분석결과의 구체적인 활용 분야를 도출하여 반영하였고, 디지털포렌식의 절차 검증과 관련된 적법성 규칙, 분석 결과 활용과 관련된 적절성 규칙을 적용하여 의사결정지원이 가능하도록 하였다. 구축된 디지털포렌식 온톨로지는 다양한 범죄 유형에 적용 가능한 지능형 범죄수사 시스템 구축시 중요한 기반을 제공하게 될 것이다. Digital forensics is the process of proving criminal charges by collecting and analyzing digital evidence which is related to the crime in question. Most digital forensic research is focused on digital forensic techniques themselves or cyber crime. In this paper, we designed a digital forensics-criminal investigation linked model in order to effectively apply digital forensics to various types of criminal investigations. Digital forensic ontology was developed based on this model. For more effective application of digital forensics to criminal investigation we derived specific application fields. The ontology has legality rules and adequacy rules, so it can support investigative decision-making. The ontology can be developed into an intelligent criminal investigation system.

이연법인세 정보를 이용한 이익조정 및 사업성과 분석

발생주의 회계 하에서는 경영자의 재량적 판단에 따라 회계 보고가 이루어질 가능성이 있으므로, 현금주의 회계에 비해 재무제표의 신뢰성이 낮게 평가될 수 있다. 본 연구의 목적은 이연법인세 계정의 증감을 통해 경영자의 이익조정가능성을 판단해 보는 실증분석을 수행하는 것이다. 본 연구의 실증분석을 위해 이연법인세자산에서 이연법인세부채를 차감한 이연법인세 순액을 이연법인세순자산으로 정의하여 이연법인세순자산이 전년 대비 증가되면 ‘1’, 감소되면 ‘0’인 더미변수를 종속변수로 사용하였다. 한편, 관심변수는 재량적 발생액과 전년 대비 총자산순이익률(ROA: Return on Assets, 이하 ROA) 증감을 사용하였으며, 로지스틱 회귀분석을 실시하여 관심변수와 종속변수 간의 관련성을 규명하였다. 본 연구의 결과는 다음과 같다. 첫째, 재량적 발생액이 클수록 전년 대비 이연법인세순자산이 감소하였다. 둘째, ROA가 증가한 경우와 당기순이익이 ‘0’보다 큰 경우에만 ROA와 이연법인세순자산 간에 상호 관련이 있는 것으로 나타났다. 이는 기업이 전년 대비 ROA가 소폭 감소하였거나 소액의 당기순손실이 발생한 경우, 경영자는 전년 대비 사업성과가 개선된 것으로 보이기 위해 소규모의 이익조정을 행했다는 의심을 갖게 한다. 본 연구의 결과, 외부 정보이용자들은 이연법인세 정보를 투자 의사결정에 활용할 수 있을 것으로 기대되며, 감독기관은 기업의 이익조정을 예방하고 적정한 보고를 유도하는 정책을 수립하는데 활용할 수 있을 것으로 기대된다. Under accrual basic accounting, financial statements may be less reliable compared to cash basis accounting. The purpose of this study is to conduct an empirical analysis to determine the possibility of profit adjustment through the increase and decrease of deferred tax accounts. For our empirical analysis, a dummy variable of "1" was used as a dependent variable when the deferred tax net assets increased from the previous year and "0" when the deferred tax net assets decreased. Meanwhile, the variables of interest were discretionary accruals and ROA variation compared to the previous year. Logistic regression analysis was performed to establish the relevance between variables. Results found larger discretionary accruals related to lower net deferred tax assets compared to the previous year. In addition, there was a correlation between ROA and net deferred tax assets only if the ROA increased and net profit was greater than "0". Study results will enable deferred tax information to be used in investment decision-making, and supervisory institutions can establish policies to prevent profit adjustments and enhance reporting standards.

배심원이 인식하는 국민참여재판의 효과성 영향 요인 연구

국민참여재판이 도입된 이후 진행된 연구를 살펴보면, 법학, 경찰학, 심리학 등 다양한 분야에서 국민참여재판 및 배심원 등에 관한 연구가 수행되었다. 그러나 대다수의 연구는 주로 법리적 측면의 질적 연구로 진행되었으며, 경험적 실증연구는 배심원 의사결정을 중심으로 실험연구 방식의 연구에 제한되어 있다. 이 연구는 국민참여재판의 시행 목적과 직접적으로 관련된 효과성에 관한 실증적인 연구를 수행하고자 실제 배심원들을 대상으로 설문한 자료를 활용하여 연구를 진행하였다. 구체적으로 배심원후보 및 배심원 147명에 대한 조사를 이용하여 절차적 공정성, 편견 그리고 민주주의 의식이 국민참여재판의 효과성 인식에 미치는 영향을 탐구하였다. 위계적 다중회귀분석을 실시한 결과, 절차적 공정성, 편견 그리고 민주주의 의식 모두 국민참여재판의 효과성 인식에 영향을 미치는 것으로 나타났다. 배심원들은 재판의 절차가 공정하다고 생각할수록, 재판에 대한 편견이 적을수록, 그리고 민주주의 의식이 높을수록 국민참여재판이 효과적이라고 판단하였으며, 이 중에서 절차적 공정성의 영향력이 비교적 가장 큰 것으로 나타났다. 이러한 결과에 따라서 국민참여재판의 목적 달성과 활성화를 위해서는 학계와 사법기관, 더 나아가 일반 국민이 가지고 있는 국민참여재판에 대한 인식을 개선시키는 노력과 함께, 참여 재판과 판결 절차의 공정성과 투명성을 개선하는 방법이 효과적 접근이라는 점을 보여준다. 분석 결과에 근거하여 연구의 의의와 함의점을 추가적으로 논의하였다. Since the participatory trial was introduced in Korea, research that has been conducted in various fields such as law, criminal justice, and psychology. However, the majority of the studies are mainly qualitative studies in Jurisprudence, and empirical and experimental studies are confined to jury decision making. This study was conducted on actual jurors to conduct an empirical study on the effectiveness directly related to the purpose of implementing the participatory trial. Specifically, using the survey data from the 147 jurors and veniremen, this study explored the effects of procedural fairness, prejudice and democratic awareness on the effectiveness of participatory trial. Hierarchical multiple regression analysis was used and, as a result, analysis showed that procedural fairness, prejudice and democratic awareness had significant effect on effectiveness of participatory trial. To be specific, jurors judged that the fairer the trial process, the less prejudiced the trial and the higher democratic awareness, the more effectiveness of participatory trial. Among them, procedural fairness has the largest influence. These results show that to accomplish participatory trial s purpose and revitalize not only need to change the perception of existing academia, law enforcement agencies, and even the private citizen in order but also increase fairness and transparency in the trial and judgment process. Implication and limitations are further discussed.

공적 부실채권정리기구의 필요성과 정책 대안 -해외 운영사례를 중심으로-

우리나라는 1997년 IMF 경제위기 극복 과정에서 공공기관인 한국자산관리공사에 부실채권정리기금을 설치하여 금융회사 부실채권을 조기에 매각하도록 하였다. 그러나 2008년 글로벌 금융위기 발생 이후 정부는 증가하는 부실채권의 신속한 정리를 위해 정부는 부실채권시장을 민간 주도로 개편한다는 계획 하에 공적기구의 역할을 축소하였다. 부실채권정리의 행태는 민간 AMC를 중심으로 부실채권을 낮은 가격에 인수하여 재매각함으로써 매각 차익을 획득하는 수익성 위주의 흐름으로 편중되고 있다. 그러나, 금융위기 상황에 직면했을 때 금융회사들을 위한 실질적이고 체계적인 구조조정을 할 수 있는 시장조성자가 필요하나, 단기적 수익을 중시하는 민간 AMC에게 시장조성자로서의 역할을 기대하기는 어려울 것으로 보인다. 따라서 금융위기 발생에 대비하고 효율적인 부실채권시장을 유지하기 위해 정부는 부실채권시장에서 민간부문의 한계를 보완하고 공정한 경쟁을 할 수 있도록, 공적기구와 전문성을 갖춘 민간 부문을 합친 혼합형부실채권정리 시스템을 고려해 볼 필요가 있다. Korea established a Non-Performing Loans Resolution fund to the Korea Asset Management Corporation, a public institution, to sell NPL of financial companies early and overcome the 1997 IMF economic crisis. However, the government reduced the role of public organizations after the 2008 global financial crisis to reorganize the NPL market led by the private sector to clean up the growing NPL quickly. As a result, liquidating NPL is concentrated on profitability-oriented trends in acquiring NPLs at low prices and reselling them, led by private AMCs. However, a market creator is needed during a financial crisis to conduct practical and systematic restructuring for financial companies. But, it is unlikely to expect a market creator for private AMCs that value short-term profits. Therefore, the government needs to consider a mixed NPL Resolution system that combines public organizations and specialized private sectors to compensate for private sector limitations and compete fairly. In effect, the mixed NPL Resolution system can prepare for the financial crisis and maintain an efficient NPL market.
