        해상유류오염의 보상책임제도에 관한 연구

        The earth has been threatened by environmental pollution. Particularly the issue of the oil pollution damage became a major concern in worldwide after Torrey Canyon disaster. Moreover, such oil pollution bring about a serious environmental contamination and a large amount of economics losses. Therefore the purpose of this paper is to analyze the prevention law of oil pollution and the compensation regime of oil pollution damge from ships, and for this purpose this paper concentrates on ‘1992 CLC’ and ‘1992 FC’. Marine pollution has become a major occupation of the international community. At the same time, ship-generated marine pollution has presented all sector of the shipping industry with one of the most significant challenge. Accordingly, for the purpose of prevention and compensation for oil pollution damage, this paper suggest as follows: Firstly, establishment of compensation fund on Korea’s own Secondly, most important is the national-wide awareness about the dangers of environmental deterioration.

        컨테이너 육상운송기업의 협력사 인간관계가 기업운영에 미치는 영향에 관한 실증연구

        The purpose of this study is to confirm the impact of human relations between main contract transportation firms and subcontracted transportation companies on Company operations. This research likewise intends to take in the whole situation of the Container transportation market. The research model and hypotheses have been developed based on literature review and working-level interviews with a questionnaire survey conducted with departments of 131 subcontracted transportation companies. The collected data were analysed with structural equation modeling by examining the hypothesized relationships and mediating effect. The results of research are as follows: First, business place management, supporting transportation and truck dispatching in subcontracted transportation companies has a positive effect on efficient management. Second, business place management of subcontracted transportation companies has a positive effect on stable management. Third, human relations between main contracted transportation firms and subcontracted transportation companies has a partly mediating effect on relationships between supporting transportation, truck dispatching and an efficient management. human relations has a perfectly mediating effect on relationships between supporting transportation, truck dispatching and a stable management. and it is clear from the findings that container transportation market situations and distinctiveness.

        급속모래여과에서 PAC 피복에 의한 초기 유출수의 탁도 개선

        The purpose of this research was to describe the mechanisms and prevention of initial degradation in turbidity of the sand filter effluent. The method used was by adding a coagulant (PAC) to the sand filter after backwashing as a means of reducing turbidity. It was found that adding 80 mg/L of PAC solution to the sand filter was very effective in improving the initial effluent turbidity. A turbidity removal efficiency of 99 % was observed in the initial term period as compared to a 70% efficiency without PAC addition. The PAC solution added to the sand filter resulted in high aluminum concentration at the upper layer as compared with the bottom layer of the sand filter column. A change in the zeta potential to a strong positive-ions at upper layer was observed at this time but only a small change was obtained at the bottom. This result showed that the zeta potential of the sand was changed to positive with PAC coating. The effect of pH on zeta potential with PAC addition was also investigated. Zeta potential was greatly changed to positive-ion at pH 4∼6. A series of experiments was then conducted in this study to optimize the pH of the PAC solution to be added to the sand filter after backwashing. The removal efficiency of turbidity was found to be highest at pH 5. This result suggested that hydrolyzed aluminium species attached to the surface of the sand enhanced the removal of turbidity of the effluent.

This problemare being blamed for hamperingcorporateactivitiesandharbor logistics industrydevelopment. soweneednewway to solve that problem.

        사업초기단계 중소기업의 무역지향성과 불확실성에 관한 실증연구

        본 연구는 새롭게 사업을 시장하는 사업초기단계 중소기업의 무역활동에 주목하고자 한다. 사업초기 단계부터 해외진출을 목적으로 한 중소기업의 경우 기존 내수 중심의 기업에 비하여 국가 경제에 건전한 영향을 미칠 수 있는 상당한 가능성을 가지고 있다. 그러나 이에 대한 세분화된 분석을 통한 관심과 지원이 필요함에도 불구하고 이들 중소기업이 창업 초기단계에 무역활동을 시작하고 지속함에 있어 대금결제 및 각종 금융활동에 상당한 어려움을 겪고 있는 실정이다. 따라서 본 연구를 통하여 사업초기단계 중소기업의 무역활동의 불안정성에 미치는 요인을 금융실무로 구체화하여 본질적인 차원에서 문제점을 찾고 실증분석을 통한 합리적 대안과 시사점을 제시하는데 목적을 가지고 있다. 본 연구의 실증분석결과는 다음과 같다. 사업초기단계 중소기업의 무역지향성은 무역거래 불확실성에 유의한 영향을 미치는 것을 알 수 있었으며 무역지향성과 무역거래의 불확실성 사이에 제한적 결제업무와 무역금융조달한계는 유의한 부분 매개효과를 가지는 것을 알 수 있었다. 다만, 무역금융지원과 무역보험의 경우 별다른 매개효과를 나타내지 않는 것으로 나타났다. 따라서 사업초기단계의 중소기업의 무역활동을 효과적으로 지원할 수 있는 다양한 방안이 필요함을 확인할 수 있었다. Purpose : The purpose of this study is to confirm that the impact of Variables of financial task between Trade Orientation and Uncertainty on the Early stage SMEs. and take in the whole situation of Early stage SMEs market by this research and it is clear from the findings that Trade financial task of Early stage SMEs market situations and distinctiveness. Research design, data, methodology : Research model and hypotheses have been developed based on literature review and working-level interview, and a questionnaire survey was conducted to 153 Early stage SMEs.(with 5 years or less) The collected data were analysed with structural equation modeling, examining the hypothesized relationships and mediating effect. Results : According The results of research are as follows, first, a Trade Orientation of Early stage SMEs has a positive effect on a Trade Uncertainty. second, a Limited payment business and a Limited trade finance have a partly mediating effect on relationships between a Trade Orientation and a Trade Uncertainty. Trade financial support and Trade insurance have no effect on relationships between a Trade Orientation and a Trade Uncertainty. Conclusions : The Early stage SMEs market need to improve Trade financial environment. To this end, Persistent efforts are involved in that. and at a strategic level, They need the professional theory educations of trade.

      • 중복보험에서의 고지의무위반의 효과에 관한 연구

        보험계약에서 최대선의의 원칙은 당사자에 의해서 지켜져야 할 기본적인 것이다. 이 최대선의의 원칙에 입각해 피보험자는 보험자에게 계약이 체결되기 전에 모든 중요한 사실에 대해서 고지해야 하며, 만약 고지의무의 위반이 있을 경우 보험자는 계약을 해지할 수 있다. 이러한 고지의무제도는 보험자에게 피보험자의 위험사정을 정확하게 알려주고 도덕적 위험을 방지하기 위한 것이다. 이러한 점에서 피보험자의 고지의무는 보험계약에 있어서 가장 중요한 것이라고 할 수 있다. 하지만 보험계약에서 규정하고 있는 다른 법률상의 의무와는 차이가 있다. 예를 들면 만약 다른 법률상의 의무에서는 채무자가 그의 법적인 의무를 거절하거나 지체하는 경우 법적 강제이행이 따르지만, 고지의무위반의 경우에는 계약을 해지할 수 있을 뿐이다. 따라서 보험계약에서 고지의무를 어떻게 해석할 것인가에 대한 논쟁의 여지가 있다. 이러한 문제와 관련하여 본 논문에서 동일한 보험목적물 또는 동일한 보험사고에 대하여 수개의 보험계약이 동시에 또는 순차적으로 체결되는 중복보험도 이와 같은 고지의무위반에 따른 법률적 효과가 그대로 적용될 수 있는가에 대한 문제를 중심으로 고찰하고자 한다. It is a fundamental principle of insurance contract law that the utmost good faith must be observed by either party. Subject to the principle, an assured must disclose to the insurer every material circumstance before the contract is concluded. If the assured fail to make such disclosure, the insurer may avoid the contract. The duty of disclosure system has been developed in order to offer the insurer the same information about the risk that are originally under the control of the assured by which it also enables the insurer to evaluate the nature of the risks correctly and to prevent moral risks by excluding bad ones. In this respects, the duty of disclosure of the assured is considered to be one of the most significant in contracting insurance. However, the duty of disclosure in insurance contract has different characteristics from the other duties in law. For instance, if the obligator reject or delay to carry on his legal duty, legal execution force follows, but if the assured breach the duty of disclosure, legal execution force is not available and the insurer can just avoid the contract itself. Therefore there have been controversies on the subject of how to interpret the duty of disclosure the insurance contract employ. In this paper, we handles the matters concerned with these subject. It especially studies whether the legal effects on the duty of disclosure are applicable to the double insurance contract in where two or more policies are effected by or on behalf of the assured on the same adventure and interest or any part thereof with the focus on case study. In conclusion, it is generally admitted that even if there is a breach of the duty of disclosure to the double insurance contract, the breach must be resulted from the disclosure obligator`s intention or gross negligence for the real effect of contract avoidance.

        ICC(1982)와 ICC(2009)에서의 면책조항에 관한 비교연구

        The ICC(2009) replace the previous clauses which were in use since 1982. The ICC(2009) is more clear and easier than ICC(1982), particularly advantageous to the Assured. The Exclusions of ICC(2009) are summarized as follows: First, Loss damage or expense caused by insufficiency or unsuitability of packing is carried out by the Assured or their employees, this exclusion shall not apply to a container is stowed by independent contractors prior to attachment of cover. Second, Exclusion 4.6 has been replaced by the insolvency exclusion from the Commodity Trades Clauses, that is to say, this exclusion shall not apply where contract of insurance has been assigned to the party claiming hereunder who has bought or agreed to buy the subject-matter insured in good faith under a binding contract. Third, In unseaworthiness and unfitness of vessel or craft, where the Assured are privy to such unseaworthiness or unfitness, and in unfitness of vessel or craft, where loading there in or thereon is carried out prior to attachment of insurance or by the Assured or their employees and they are privy to such unfitness at the time of loading. Finally, In clause 7, terrorism is defined newly. Above three clauses are more favorable to the Assured, but this clause is not. In this clause, terrorism is defined in accordance with UK Reinsurance(Acts of Terrorism) Act 1993, i.e. "caused by any person acting from a political, ideological or religious motive.

        An Empirical Study of the Effects of Collaboration Companies Capabilities on Specialization, Diversification and Corporate Performance - Primarily on International Freight Forwarders -

        Purpose : The international freight forwarder market has been met irresistible revolution time because the shipping market has been unsteady. Freight Forwarders which deputize for shipper s orders are in charge of a variety of takes for reaching the destination And the only way they make common cause with the collaboration companies. This study should find out the Effects of the relationship between Collaboration Companies Capabilities and International freight forwarders on Specialization, Diversification and Corporate Performance. Research design, data, methodology : Research model And hypotheses have been developed based on literature review And working-level interview, And a questionnaire survey was conducted to 114 international freight forwarder. The collected data were analysed with structural equation modeling, examining the hypothesized relationships and mediating effect. Results : The results of this study are listed below, First, the relationship between Collaboration Shipping Companies, Inland transportation Companies and Freight forwarder has a positive influence on Specialization. Second, the relationship between Oversea partner and Freight forwarder has a positive influence on Diversification. Third, the Specialization and Diversification have a positive influence on Corporate Performance. Conclusions : The International Freight Forwarders should pursue a Diversification of the Businesses base on establishing enough cooperative relationship with the transportation companies. And They will get a better benefit if Diversification generate a synergy effect through the intelligence capabilities using the relationship with oversea partners. 국내 해운시장의 불확실성으로 인하여 국제물류주선업계는 거부할 수 없는 변혁의 시기를 맞이하고 있다. 화주의 운송을 대행하는 이들은 화물을 목적지까지 안전하고 신속하게 운송하는데 필요한 다양한 업무를 원활하게 진행하기 위해서 다양한 협력기업들과 관계를 맺고 있다. 본 연구는 이러한 국제물류주선업체와 협력기업과의 관계가 기업의 다각화와 전문화 그리고 기업성과에 미치는 영향에 대하여 파악하고자 하였다. 연구결과는 다음과 같다. 첫 번째, 협력 선박회사와 육상운송사의 관계는 전문화에 긍정적인 영향을 미치는 것으로 나타났다. 두 번째, 해외파트너는 다각화에 긍정적인 영향을 미치는 것으로 나타났다. 세 번째, 전문화와 다각화 모두 기업성과에 유의한 영향을 주는 것으로 나타났다. 국제물류주선기업은 협력기업들과 충분한 협력관계 구축을 통한 전문화를 수립하고 이를 바탕으로 연관분야로의 다각화를 추구해야 한다. 그리고 해외파트너와의 관계를 이용한 해외 정보력을 통하여 다각화에 시너지 효과를 극대화한다면 더 나은 기업성과를 얻을 수 있을 것이다.
