The aim of this study is to understand the relationship between awareness of traditional culture, personality and emotional stability of male high school students participating in the Taekkyon training activities of school sports clubs. For this purpose, this study looks at the result of the survey of the total of 560 students (290 first year students and 270 second grade students) who participated in Taekkyon training activities at ‘N’ High School sports club in Dong-gu, Daejeon. The data processing program used is ‘SPSS V. 18.0 statistical package’. First, this study attempted to verify the relationship between traditional culture awareness and personality and emotional stability by analyzing the result of correlation, it has been found that traditional culture interest, interest in traditional culture education, ability to utilize traditional culture were influenced by emotional stability, personality education, There were statistically significant results in all factors such as care, manners, and basic lifestyle. As such, this study argues thatthe correlation between traditional cultural awareness and personality and emotional stability now has been clearly verified. Second, this study attempts to find out how traditional cultural awareness affects the students’ personality and emotional stability. In order to do this, ‘multiple regression analysis’ was taken to be conducted. By taking this method, this study found that the awareness of traditional culture strongly affect to both personalityand emotional stability of the subjects who participate the Taekkyon training activities because there are statistically significant in all factors such as emotional stability, personality education, caring, manners, and basic lifestyles.Therefore, this thesis strongly argues that the traditional cultural education and the systematically well-organized education of martial arts is necessary at school sports education

The competence of a claim is defined that the claim of a certain action has objective necessity and benefits for merits-action, therefore the action has a qualification for being an object of judicial judgement. An action should be certified of below some conditions, to be lawful one that has the claim with the competence of a claim and to be received judgement about it’s substantial question by justice court. The juridical relation as a subject of an action should be within power of justice court and could be an object of judicial judgement, therefore the issue related the action could be resolved through judicial judgement. 1. 국가 사법권의 발동이라는 면에서 볼 때 원고가 구하는 청구, 나아가 모든 사실관계나 법률관계 또는 그로부터 발생하는 법률효과 모두가 다 적법한 소송목적이 될 수는 없다. 특정한 소의 청구가 실체관계(본안)에 대한 심리‧판단의 대상이 될 수 있어 본안소송을 인정할 객관적 필요성 내지 이익을 가지고 심판의 대상인 자격을 갖춘 것을 청구적격 또는 본안적격이라고 한다. 이는 본안심판의 요건이므로 소송요건에 속한다. 2. 특정한 소의 청구가 청구적격을 갖추어 적법한 소송으로 성립하고 그 실체관계(본안)에 대한 심리‧판단을 받을 수 있으려면, ① 우선 그 소송목적인 법률관계가 법원의 권한에 속하고 재판의 대상이 되는 것이어서 재판을 통해 해결할 수 있는 것이어야 하고, ② 일정한 분쟁 해결 수단으로 법이 특별한 절차와 형식을 정해 놓은 경우에는 그 요건을 충족하여야 하며, ③ 그 법률관계에 대한 재판을 통해 상대방으로부터 급부를 받거나 의무를 면하거나 법적 지위를 확인받는 등으로 당사자가 권리를 실행하거나 분쟁을 해결하는 등 구체적‧현실적 문제에 관하여 당사자에게 경제적‧정신적 만족을 줄 수 있는 것이어야 하고, ④ 그것이 단순한 사실관계가 아닌 현재의 법률관계, 즉 법(법규)에 의하여 규율되는 인간생활의 영역에 속하는 것이어야 하며, ⑤ 복수의 청구가 있는 때에는 그 상호 간에 독립성이 있어 그 각각에 대하여 독립하여 따로 심판할 필요와 이익을 갖는 것이어야 한다. 3. 청구병합의 성립 여부와 그 형태는 실질설이 타당하다. 이에 따를 때, 형식상으로는 복수의 청구라도, 실질상 청구병합이 성립하지 않는 경우 일부 청구가 청구적격이 없는 등으로 부적법하거나 청구의 이유가 없더라도, 그에 대해서는 소를 각하하거나 청구를 기각할 필요가 없다.

직권남용죄의 보호법익과 구성요건

The benefits and protection of the law for crime of abuse of authority include the protection of social trust in public servant’s work-related equitability and citizens’ individual rights. Punishment of this crime can be justified when a public servant’s behavior is an use of work-related power, but it is against the laws that give him that power in terms of its purpose of use or its means, procedure, also the result of power usage makes the counterpart do a task without any obligations or incur losses by being disrupted exercise of his right. A public servant’s work-related power is not confined to things that are expressed clearly by laws, it extends to things that are reasonably and commonly needed to perform his job or things that are entrusted or directed by the person who has the power. If the counterpart’s doing a task without any obligations or being disrupted exercise of his right is not caused by a public servant’s use of work-related power, instead by his position or status, the public servant don’t have to be punished. But it’s hard to tell the two sides. So, it’s helpful to know to judge which side it is, whether the public servant’s actual purpose is based on performance of his job or completely on his private aim. This crime can be realized even when a public servant used the power over his work-related power, if there is work-relation between the power and above result. And that is the same if a counterpart against his power usage is a his assistant official. 직권남용죄의 보호법익은 공무원의 직무상 공정성에 대한 사회의 신뢰와 국가기능의 공정한 행사라는 공적 측면, 공권력으로부터의 국민 개개인의 법익 보호라는 사적 측면을 겸유한다. 직권남용죄를 처벌할 당벌성(當罰性)은 ① 공무원의 행위가 직무상 권한의 행사로서, 그 행사 목적이나 수단·절차에 있어 그에게 직권을 부여한 법질서를 현저히 벗어나 용인할 수 없는 것이어서 위법하고, ② 그 결과에서 상대방인 타인에게 법령상 의무 없는 일을 하거나 권리행사를 방해당하는 손해를 입게 하는 데에 있다. 공무원의 직권은 법령에 명시된 것에 한하지 않고, 법령에 명시된 권한 및 그의 직위나 직무에 밀접히 연관된 것으로서 그 지위와 직위로부터 합리적·통상적으로 기대되는 직무를 수행하는 데에 필요하거나, 법령상 권한을 가진 자의 명시적·묵시적 위임이나 지시가 있는 경우로 확장된다. 이 경우 그 직권의 범위는 당해 공무원이 그 권한을 종래부터 계속적으로 행사해온 것인지 여부, 그 권한의 행사가 관련 법령이나 일반적 법체계와 법제도에 반하는지 여부, 그 권한 행사에 대하여 국민 일반이나 조직 내외의 다른 공무원 등이 이를 당연한 것으로 인식하고 이를 수용해 왔는지 여부 등을 고려하여 종합적·실질적·객관적으로 판단하여야 한다. 상대방의 의무 없는 일 등이 공무원의 직권 행사에 기한 것이 아니라 단순히 그의 지위나 신분에 기한 때에는 직권남용죄가 성립하지 않는바, 이는 그의 법령상 권한과 실제 행사한 권한의 관계, 그것이 행사된 경위와 전후사정 등을 실질적·객관적으로 종합해서 판단하여야 하되, 공무원의 구체적 행위의 목적이 직무상 업무 수행의 일환으로 행하여진 것인지 아니면 순수하게 그의 개인적 목적을 위한 것인지 여부는 양자를 결정하는 가장 중요한 기준이 될 수 있다. 공무원이 직권을 초과하여 행사한 경우라도, 그 행사한 권한과 상대방의 일 등 사이에 직무상 연관성이 있는 경우에는 직권남용죄가 성립하며, 상대방이 자신의 보조기관(하급자)인 경우에도 성립할 수 있다.

The multilayer structure material contained ductile and brittle layer simultaneously was compared, examined with singlelayer's property through the breaking dynamics strain process of amorphous area in multilayer structure polymer material. As a result, we know that impact strength of multilayer structure material is strictly higher than singlelyer's and the toughness is enhanced about two or more times in the glass transition temperature(T_g) and same dimension. Also superposition principle of impact pulse was used for interpretation of kinetic stress wave when the high velocity crack is going on in the plastic. Consequently, the optimum condition of ductile/brittle thickness ratio could be designed in the final toughness enhancement of multilayer. Therefore the physical property(impact strengh and tensile strength synchronously are high) of this multilayer structure material is higher than any ENPLA(engineering plastic) so that high physical functionization of general polymer material could be accomplished.

자기공명영상용 라디오주파수 코일의 제작에 있어서 동조 및 매칭에 영향을 미치는 전기 용량 값들의 실험적 측정

Radio frequency coil which is capable of transmit and receive the signal has been used for image production in magnetic resonance imaging(MRI). Tuning and matching characteristic of radio frequency coil is major factor determining the image quality. In experiment the used coil was called a staircase type coil which is simplified the birdcage coil and referred to a simple LC resonant circuit. Because the inductance values of the coils are fixed coil performance was examined by changing of the capacitance values. In this study capacitance values were experimentally determined to increase of-tuning and matching effect in junction of the coil between coil endring and BNC cable to obtain the high quality of image.
