        강제퇴거대상 외국인의 보호명령에 대한 위헌성

        Judgment on the unconstitutional provisions of the Immigration Control Act is a very important constitutional matter that directly links the freedom of the body of foreigners, and has yet to be made by the Constitutional Court. As we have seen in this research paper, protection orders under the terms of the judgment may be re-established again, and some refugee applicants are still long protected, and so the basic rights violation debate is a precondition for the trial. Since foreign protection under the Immigration Control Act is to deprive foreigners of their physical freedom in accordance with the criminal procedure, there should be a mechanism for those in an objective and neutral position to examine the validity of their human rights. The defendant can appeal to the Minister of Justice, and if the protection period exceeds three months, it can be extended only through approval from the Minister of Justice, but only by the Office of Administrative Supervision, which issued an order for protection. And in order to avoid the possibility of unfair long-term detention of foreigners, it would be desirable to set an upper limit on protection period and to readjust the system so that related procedures can proceed quickly within that period, while the judiciary reviews and decides. In other words, in order to avoid the possibility of unfair long-term detention, the European comparative legal grounds stipulating the maximum length of detention must be considered in order to establish a reasonable period to the upper limit of the protection period.

      • Squalene이 Cyclophosphamide를 투여한 Mouse의 혈액상과 간에 미치는 영향

        20g 내외의 BALB/c 계통의 건강한 웅성 mouse 60마리를 대조군, cyclophospharude 투여군, cyclophosphamide와 squalene 동시투여군으로 나누어 cyclophosphamide 부작용에 대한 squalene의 효과를 혈액상 및 조직학적 측면에서 조사 연구한 결과 다음과 같은 결과를 얻었다. 1. 헐액학적 측면에서 백혈구수, 적혈구수, hemoglobin값 모두가 cyclophosphamide 투여군보다 cyclophosphamide와 squalene동시투여군에서 높았고, 특히 백혈구수는 뚜렷한 증가를 보였다. 2. 72시간 후, cyclophosphamide와 squalene 동시투여군에서 백혈구수, 적혈구수, hemoglobin값이 최저값을 나타낸 시간과 간조직의 손상정도가 가장 심했던 시간이 일치했었다. 3. 조직학적 측면에서, HE 염색에 의한 일반적인 간조직의 변화, PAS 염색에 의한 glycogen의 변화, oil red-0 염색에 의한 간조직내 지방 침착의 변화는 cyclophoshamide 투여군과 cyclophosphamide와 squalene 동시투여군 사이에서 뚜렷한 차이점을 나타내지 않았다. This research was undertaken to know the relationships between cyclophosphamide and squalene on the liver and blood of male mouse in terms of histological and hematological alternation at the different groups; control groups, cyclophosphamide treated groups, and cyclophosphamide with squalene treated groups. The results were as follows: 1. All of the number of leukocytes and erythrocytes, and values of hemoglobin were increased in cyclophosphamide with squalene treated groups than cyclophosphamide treated groups, especially at the number of leukocytes. 2. After 72 hours, in the cyclophosphamide with squalene treated group, the lowest values of the tested blood cells and hemoglobin were agreed with the intensively degree of damages to the mouse liver tissues. 3. At the histological level, there were no differences between the two groups;cyclophosphamide treated group and cyclophosphamide with squalene treated group.

        자치분권강화를 위한 헌법개정의 의미 - 2018년 대통령 개정안을 중심으로 -

        It has already been more than 32 years since the 9th revision of the Constitution of the Republic of Korea in the wake of the June 10, 1987 uprising. There has been much debate and debate in the political circles about the constitutional amendment. In the end, finally, Moon Jae-in president more than a year since he took office on May 10, 2017 for the first time in the current Constitution, Article 128 paragraph 1 of the Moon Jae-in, based on government amendment of the Constitution, is president.Became. A special presidential advisory committee on constitutional amendment prepared and reported the amendment to the Constitution to the President on March 13, 2018. Cheong Wa Dae Moon Jae-in the president on March 20, the reforms, 2018 (basic rights, a special subject the Constitution) First report, 2018, the second announcement on March 21 (decentralization of power and economy), 2018 third on March 22.(form of government and electoral system, the justice system and the constitutional justice system) the announcement was made. Although there are several contents of the amendment, this research paper considered the amendment in relation to the decentralization. First of all, the outline of the revision is designed to strengthen the autonomy of the Republic of Korea for sustainable growth. In other words, the revision strengthens the self-governing and legislative powers while granting self-organization rights to the autonomous governments, but also includes the guarantee of the autonomous governments, among other things. In addition, the Special Committee on Constitutional Reform clearly stated to the autonomous communities that the autonomy of the autonomous governments came from the local people so that they could realize substantial democracy, and also confirmed that the local people had the right to participate in organizing and operating the autonomous governments. In addition, the Commission newly established elements of direct democracy for local residents, such as residents' proposals, residents' votes and residents' recall, on a constitutional basis. As such, the amendment to the Constitution for the enhancement of autonomy was proposed in many respects. In the end, this research paper reviewed again the contents of the amendment to local autonomy in April 2018 of the President's proposal for constitutional amendment, and presented practical problems, directions and improvements to be developed through the analysis of the relevant local autonomy system. 1987년 6월 10일 항쟁을 계기로 대한민국 헌법을 제9차 개정한 지 벌써 32년이 넘었다. 그 동안 헌법개정에 대한 정치권에서 많은 논쟁과 논의가 있어 왔다. 결국 드디어 문재인 대통령 2017년 5월 10일 취임 후 1여 년 만에 현행 헌법 제128조 제1항에 근거하여 문재인 정부 측 대통령이 헌법 개정안을 마련하게 되었다. 대통령 소속 국민헌법 헌법개정 자문특별위원회가 헌법개정안을 마련하여 2018년 3월 13일 대통령에게 보고했다. 이에 청와대는 문재인 대통령 개헌안 2018년 3월 20일 제1차 발표(헌법전문과 기본권), 2018년 3월 21일 제2차 발표(지방분권과 경제), 2018년 3월 22일 제3차 발표(정부형태, 선거제도, 사법제도, 헌법재판제도)를 하였다. 개정안의 내용은 여러 가지가 있지만 본 연구논문에서는 지방분권과 관련하여 개정안에 대하여 검토하였다. 우선 개정안의 개괄적인 내용을 보면, 대한민국의 지속가능한 성장을 위해 자치분권을 강화하는 것으로 마련되어 있다. 즉 개정안은 자치정부에 자주조직권을 부여하면서 자치행정권, 자치입법권을 강화하되 그 중에서도 자치재정권의 보장도 포함되어 있다. 그리고 헌법개정 자문특별위원회는 자치단체에게 실질적 민주주의를 구현할 수 있도록 자치정부의 자치권이 지역 주민으로부터 나온다는 사실을 명확히 명시하고, 지역 주민이 자치정부를 조직하고 운영함에 있어서 참여할 권리를 갖다는 것도 확인하였다. 또한 동 위원회는 주민발안, 주민투표, 주민소환이라는 지역 주민의 직접 민주주의 요소를 헌법적 근거로 신설하였다. 이렇듯 자치분권 강화를 위한 헌법개정안은 많은 부분을 정비하여 제시되었다. 결국 본 연구논문은 2018년 4월 대통령 측의 헌법개정 발의내용 중 지방자치에 대한 개정안의 내용을 다시 한번 더 살펴보면서 앞으로 그간의 지방자치제에 대한 분석을 통하여 현실적 문제와 앞으로 전개되어야 할 방향 및 개선점 등을 제시하였다.

        재한외국인처우기본법 이민기금 설치의 필요성

        A fund is established by law only when the state needs to operate certain funds flexibly for a specific purpose, which means funds that can be operated without being subject to revenue or tax expenditure. To realize a special policy objective, the fund can be held and operated for a specific project so that it can be operated more flexibly away from the general constraints of the budget principle. The budget and the fund are the same fiscal management tools of the government, but in the case of the fund, they differ from the budget in that the autonomy and resilience of fund management entities are guaranteed. The biggest feature of funds being distinguished from budgets is the ability to draw up a fiscal management plan for the purposes of the fund management entity without going through a general budget process. In modern fiscal policy seeking an integrated budget, funds are included with general account and special account to be used as data for fiscal policy, increasing the importance of management and control. However, it is generally over budgeted, and the benefits are based on the law. It can be operated without budget and has relative autonomy in operation under the responsibilities of the Minister in charge through separate operational regulations. Taking into account the nature or characteristics of these funds and fund systems, there is a need for immigration funds to pursue and support a realistic and effective immigration policy for true social integration in Korean immigrant communities. At a time when the number of foreigners residing in Korea is rapidly increasing as a social phenomenon and the purpose of staying in Korea is gradually diversifying, many social problems have arisen, including anti-foreign sentiment among the public by implementing a policy of consistent benefits by considering Korean foreigners as simply those who need support. Going one step further, the failure to come up with a realistic and integrated support policy for Koreans and foreigners could lead to serious social problems by deepening conflicts between Koreans and foreigners as well as greatly increasing the tax burden on the people. Another important policy is to minimize the public's tax burden on integration costs between Koreans and foreigners in the future and to secure stable resources to support foreigners' smooth adaptation to the country through a shift in the policy that has been implemented so far at a time when conflicts between Koreans and foreigners are emerging. The fund needs to be raised using fees levied on immigrants and others to resolve conflicts between their own people and foreigners, resolve reverse discrimination and finance stable social integration. The time has come for Korea to contribute to the development of the Republic of Korea and social integration by promoting people's anti-depression by directly utilizing various expenses incurred by foreigners in their social integration and securing the funds needed for efficient social integration of foreigners living in Korea.

        진균성 사대 농양의 내시경적 제거 증례 1예

        Aspergillus clival abscess, especially without a sphenoid sinus lesion, is a very rare infection of central nervous system. In this report, we describe the successful treatment of a patient with aspergillus clival abscess. A 63-year-old man was referred to our hospital with the diagnosis of sphenoid mass lesion in magnetic resonance image accompanied by headache and diplopia. The computed tomography scan revealed a clival cystic lesion without connection with the sphenoid sinus. The patient underwent the endoscopic endonasal clival approach and histopathological examination revealed aspergillosis. Postoperatively, the patient was given IV amphotericin-B for 2 weeks and oral voriconazole for 3 months. After surgery, patient’s headache and diplopia disappeared. Aspergillus abscess originating from the skull base is rare but has a high mortality rate. Histopathological confirmation via endonasal approach and intensive antifungal therapy should be started for a successful treatment.

        병역미필자 국적이탈허가의 예외 가능성에 대한 소고

        At present, multiple nationalities are legislatively established in the trend of the times and are established as legal and social perceptions for the Korean people. The normative content of a multi-national system maintains social law order in consideration of national interests. Moreover, it allows for a limited number of national departures when considering national interests comprehensively, including social, economic and legal sentiment. In particular, the nation's youth and people regard the issue of military service as an important content, and pay keen attention to the situation in which they are either not required to serve in the military or are in the military service reserve under the military service law. As discussed in this research paper, the issue of national flight or abandonment of nationality by 18-year-old Koreans who are not required to serve in the military or in military service is likely to be an important task for the nation to be solved in the future. Thus, here, the government wanted to approach the wide-ranging Saya to provide exceptional regulations for those who did not complete their military service. In other words, it wanted to look into the future and macro perspective for the development of the Republic of Korea. The problem here is that the discussion on the exceptional rules for the exemption of those who have not yet completed their military service will have to come up with legislative policy revisions and alternatives that take into account the nationality law, the military service law, the immigration law, the Overseas Koreans' Law and the Overseas Koreans' Foundation ActUnder the current nationality law, the multiple citizenship system is recognized and enforced, and the military service law is also expected to be prepared as a legislative alternative for various alternative services, even if the Constitutional Court rules against the type of military service, and it can also be represented in the above-mentioned law what role Korea can play in the national interest, even considering immigration control and the status of overseas Koreans. Of course, drawing up exceptional regulations on the nationality departure of those who have not yet completed their military service at this time could be a controversial issue in the legal and social order of the people, but it is also likely that there will be a need for an exemption in the long term if the people fulfill their duties in defense and tax payment for the nation in various forms in the type of military service, such as immigration management. 현재 우리나라 국민에게 있어서 복수국적은 시대적 흐름에 입법적으로 마련되어 법사회적 인식으로 자리잡고 있다. 복수국적제도에 대한 규범적 내용은 국익을 고려하여 사회법질서를 유지하고 있다. 더욱이 사회적, 경제적 및 법감정적 등을 종합적으로 국익을 고려할 때 국적이탈을 제한적으로 허용하고 있다. 특히 우리나라 청년 및 국민은 병역에 대한 문제를 중요한 내용으로 여기고 있으며, 병역미필 상태이거나 병역법상 병역준비역에 있는 상황을 많은 관심을 갖고 있다. 본 연구논문에서도 언급한 바와 같이 병역미필자 또는 병역준비역에 있는 18세의 국민이 국적이탈 또는 국적포기에 대한 문제는 앞으로 풀어야 할 국가의 중요한 과제일 것으로 보인다. 따라서 여기에서는 병역미필자의 국적이탈허가의 예외적 규정을 마련하기 위한 폭넓은 관점에서 접근하고자 하였다. 즉 대한민국의 발전을 위한 거시적 및 미래지향적 관점에서 일고찰하고자 하였다. 여기서 문제는 병역미필자의 국적이탈허가의 예외적 규정에 대한 논의는 국적법, 병역법, 출입국관리법, 재외동포법, 재외동재단법 등을 모두 고려한 입법정책적 개정안 및 대안에서 마련되어야 할 것이다. 현행 국적법상 복수국적제도를 인정 및 시행하고 있으며, 병역법 또한 병역의 종류에 대한 헌법불합치 결정을 보더라도 대체복무가 다양하게 입법대안으로 마련되어야 할 것으로 보이며, 역시 이들에 대한 출입국관리 및 재외동포의 지위를 고려하더라도 대한민국 국익을 위한 어떤 역할을 할 수 있는지 위에 언급한 법률에서 나타낼 수 있을 것으로 보인다. 물론 현시점에서 병역미필자의 국적이탈허가의 예외적 규정을 마련하기란 국민의 법감정이나 법사회질서의 논란이 될 수 있지만, 이민자 관리 등 대체복무라는 병역의 종류에 있어서 다양한 형태로 국가를 위한 국방 및 납세에 관하여 국민의 의무를 다한다면 장기적으로 예외규정이 마련될 가능성도 전개될 것이다.
