In Korea, nonpossessory security right cannot be created against personal properties because of the lack of proper publicity. If personal properties and receivables are granted as security, its may be usually possessed and used by the debtor. In order to create such nonpossessory security rights, a public announcement of filing system or perfection against third parties are required. In the United States, security interest is perfected if it has attached and all of the applicable requirement for perfection have been satisfied. In general, after perfection the secured party is protected against creditors and transferees of the debtors and, in particular, against any representative of creditors in solvency proceedings instituted by or against the debtor. Generally, most types of collateral either mayor must be perfected by filing under the Article 9 of the Uniform Commercial Code of the United States. At present, one of the most Important factors is the electronic registration, without any exception, increasing the security rights. The newly amended Article 9 of the U.C.C. of the United States purports to include the electronic registration Canada have followed precedents of the Article 9 of the U.C.C. Since 1974, Canada had computerized the filing system for personal properties and receivables under personal property Security Act. In the Japan, when the artificial person assign mass obligation that they has, they acquired the perfection on essential factor of registration of commerce since 1998. In addition, assignment of account receivables, as recently codified by UNCITRAL, constitutes an effective financing tool. The UNCITRAL convention on assignment of receivables is expected to bring a momentum in creating security in the international trade. Currently, thanks to the development of information industries, electronic registration system is eligible as a convenient and cheap instrument for publicity. Particularly, the publicity of these security rights may be obtained conveniently at comparatively low cost and reduced risk of credit by means of electronic registration on the internet. In Korea, the modernization of the public announcement on the nonpossessory security right should be promoted so as to implement the security interest on moveables and receivables.

자동화된 스마트 그리드의 등장은 이러한 문제에 대응을 위한 필수적인 장치가 되고 있으며 스마트 그리드 기반 사회로의 진전을 가져오고 있다. 스마트 그리드는 전기 공급 업체와 소비자 간의 양방향 통신을 가능하게 하는 새로운 패러다임이다. 스마트 그리드는 전력 그리드를 보다 안정적이고 신뢰할 수 있으며 효율적이고 안전하게 만들기 위한 엔지니어의 이니셔티브로 인해 등장했다. 스마트 그리드는 전력 소비자가 전력 사용에서 더 큰 역할을 할 수 있는 기회를 창출하고 전력을 현명하고 효율적으로 사용하도록 동기를 부여한다. 이에 본 연구에서는 기계 학습을 통한 전력 수요 관리에 중점을 둔다. 기계 학습을 사용한 수요 예측과 관련하여 현재 다양한 기계 학습 모델이 소개되어 적용되고 있는 데 이에 관한 체계적인 접근이 요구되고 있다. 특히 GP 학습 모델의 경우에 일반 소비 예측 및 데이터의 가시화와 관련해서 다른 학습 모델보다 장점이 있지만, 스마트 미터 데이터의 예측과 관련해서는 데이터 독립성에 강한 영향을 받는다. The emergence of the automated smart grid has become an essential device for responding to these problems and is bringing progress toward a smart grid-based society. Smart grid is a new paradigm that enables two-way communication between electricity suppliers and consumers. Smart grids have emerged due to engineers' initiatives to make the power grid more stable, reliable, efficient and safe. Smart grids create opportunities for electricity consumers to play a greater role in electricity use and motivate them to use electricity wisely and efficiently. Therefore, this study focuses on power demand management through machine learning. In relation to demand forecasting using machine learning, various machine learning models are currently introduced and applied, and a systematic approach is required. In particular, the GP learning model has advantages over other learning models in terms of general consumption prediction and data visualization, but is strongly influenced by data independence when it comes to prediction of smart meter data.

Fingerprint Recognition System is made up of Off-line treatment and On-line treatment; the one is registering all the information of there trier features which are retrieved in the digitalized fingerprint getting out of the analog fingerprint through the fingerprint acquisition device and the other is the treatment making the decision whether the users are approved to be accessed to the system or not with matching them with the fingerprint features which are retrieved and database from the input fingerprint when the users are approaching the system to use. In this paper, Among various biometrics recognition systems, statistical fingerprint recognition matching methods are considered using minutiae on fingerprints. We define similarity distance measures based on the coordinate and angle of the minutiae, and suggest a fingerprint recognition model following statistical distributions. 지문 인식 시스템은 지문인식 장치(fingerprint acquisition device)를 통하여 아날로그(analog) 지문으로부터 변환된 디지털(digital) 지문에서 특이점을 추출하고 추출한 특이점들에 대한 정보를 데이터베이스에 등록하는 오프라인(off-line) 처리와 사용자가 시스템에 접근 할 때 입력한 지문으로부터 특이점을 추출한 후 데이터베이스에 저장되어 있는 특이점들과 정합(matching) 하여 사용자의 시스템 접근 여부를 결정하는 온라인(on-line) 처리로 이루어져 있다. 본 논문에서는 다양한 생체인식시스템 중, 통계 지문 인식 정합 방법인 지문의 특이점 을 사용한다. 좌표를 기준으로서 유사성 거리 측정을 하고, 그리고 특정한 각도, 통계 배포 판에 따라서 지문 인식 모델을 찾는 것이다.

In Korea, nonpossessory security interest cannot be created against personal properties because of the lack of proper notice. If personal properties and receivables are granted as security, its may be usually possessed and used by the debtor. In order to create such nonpossessory security rights, a public announcement of filing or perfection against third parties are required. The collateral transferred for security is useful for the diversity of security and financing of enterprises. But it has some problems. First, the collateral transferred for security is a security interest according to custom. But an obligee has the title of collateral transferred for security, an obligor could use it and have interest in it. It can be recovered to its former state where repaid one’s debts. Second, due to not having legal ground, the basis of the collateral transferred for security theory is founded in theory that comprised of the collective theory, analytical theory, value scope theory, obligatory agreement theory, complex effect theory and so on. Among them, the collective theory is advocated by a majority. In the collective theory, it is offered as security that made into one economic unit from several properties. This way to ensure a secure interest is contributed to elevation of efficiency by way of security. But, in Korea, the collateral transferred for security is in existence by case law, not having legal ground. In order to diversify a collateral offered as security in future, it is necessary to more widely employ the collateral transferred for security. Consequently, I think, we need make greater effort to study the collateral transferred for security.

Copyright Law makes a declaration of Creator doctrine in article 2 and article 10. But there is one exception to this doctrine. It is work made for hire system. It seems to me that we received it from the United States of America which has Anglo-American law system. However South Korea has copyright law of the Continental law system as Japan. In spite of the Harmonization in the world, I think it is impertinent. Especially, I regard it as appropriate that we adopt the divided ownership approach of English method or the divided ownership of Japanese method in the maker of a cinematographic work, not the divided ownership approach of German method(split right approach) or the ownership approach of American method(all or nothing approach).

중국 농지임대차분쟁의 중재에 관한 고찰

중국 정부는 심각한 사회문제로 대두된 농촌의 삼농문제의 발생에 대하여 사회주의 계획경제체제의 근간을 흔들 수 있는 중차대한 것으로 여기며 그 해결에 많은 고심을 하고 있다. 토지소유권이 없는 중국에서 농촌도급토지의 경영과 관련하여 발생하고 있는 각종 불만사항은 나날이 커져 가고 있으며 향후에도 증가할 것으로 예상된다. 중국정부는 이를 해결하기 위하여 농지도급법을 제정하여 재산권 관련 문제를 해결하고 토지제도를 안정적으로 운용하고자 노력하고 있다. 그러나 농지와 관련한 분쟁을 어느 정도 해결할 수 있는 원칙을 담고 있는 농지도급법이 제정된지 얼마 되지 않았음에도 불구하고 농지도급분쟁조정중재법을 새로이 제정한 것은 그 만큼 삼농문제 등 농촌의 여러 가지 사정이 급박하다는 것을 역설적으로 말해주는 것이다. 주지하는 바처럼 중국과 같이 都農間의 소득 격차가 큰 국가는 개발도상국을 비롯한 전세계에서 거의 찾기가 힘들다. 雙層經營制度는 중국의 농지도급경영의 기초적이고 기본적인 형태이다. 토지도급과 관련한 분쟁을 조기에 합법적으로 해결하기 위하여 구축한 농지도급분쟁조정중재법은 농지도급에 관한 분쟁을 효과적으로 처리하여 중국의 농업생산력을 제고하게 될 것이다. 아울러 농지도급과 관련한 분쟁을 해결함으로써 도급토지의 점유, 사용, 수익, 이전 등의 권리를 행사하는데 도움을 줌으로써 농지경영권의 권리보장에 기여하게 될 것으로 보인다. 이러한 일련의 조치들로 인하여 농지에 대한 권리를 보다 확고하게 보장함으로써 도시민에 대하여 열위에 있는 농민과 농촌사회의 조화와 안정에 기여하게 될 것이다. 그러나 농지도급 관련한 각종 법률들이 농민들이 이해하기에는 매우 어렵고 매우 복잡하기는 여전히 마찬가지여서 농촌문제에 대한 과제가 모두 해결된 것은 아니다. 또한 그동안 농촌에서 토지와 관련한 문제들이 발생하는 경우 지방정부나 관련기관들에 의해서 비공식적인 방법으로 해결되었으나 사회주의 시장경제체제가 나날이 성장, 발전함에 따라 이러한 방법으로는 많은 농지임대차 분쟁을 해결할 수 없게 되었다. 시장경제체제 하에서는 경제주체가 자유로운 경쟁을 하며, 자유경쟁의 질서 속에서 수요와 공급에 따라 농지의 가격이 형성되고 농지의 소유와 이전이 가능하도록 하여야 될 것이다. 중국은 물권법이 제정되면서부터 치열한 이념 논쟁을 멀리하고 새로운 변화를 맞이하기 시작하였는데 그 중심에 있는 것이 바로 토지사용권제도라고 할 수 있다. 농지도급경영권은 토지제도 개혁과 맞물려 매우 중대하고 그를 둘러싼 분쟁도 많이 발생하여 이를 해결할 중재제도가 필요하게 되었다. 이러한 농지임대차 문제에 대하여 중재를 통하여 보다 합리적으로 해결한다면 중국의 경제발전과 사회안정을 위하여 바람직할 것이다.
