      • 憲法上 財産權 保障과 制限에 關한 比較法的 考察

        The center of the right relation was influenced by the private legal order until mid-nineteenth cent ury. But since the close of the nineteenth century, it has been controlled publicly and externally by various policies of a nation or public bodies, not by depending on the citizens' free determination wholly. Earlier, the freedom of the right of property was the central principle of the law in the liberal stage. But its guarantee and limitation have become innevitable as modern capitalism progresses. Especially, after the beginning of the twentieth century, the limitation of this right was necessary in the process of the realization of the basic living right, But the guarantee of the right of property was absolutely necessary in the capitalistic system which its right was a fundamental idea. Therefore, its limitation was demanded unavoidably for the rational utilization of resources to develop the economy and the national land development, the expansion of the national function to realize a welfare state. In the basic idea of constitution, the guarantee of the right of property is natural. But its limitation is inevitable for public welfare in the respect of policies. So, we have to establish the interpretative basis of public welfare to harmonize the public good and the self-interest and to have a rational guarantee and limitation.

        기초지방의회 의정성과의 변화 동향과 영향요인

        This study aims to describe a trend in the performance of basic local councils from 1998 to 2015 and to analyze three types of factors impacting on it. The activities of local councils are assessed in terms of three functions(autonomous legislation, review of budget and accounting, and check and control on the executive branch), while independent variables are investigated from three dimensions(expertise, political factors, and institutional factors). The analysis results show that the following factors appear to have a positive effect on local councils’ performance: expertise, political career, and age of members among expertise factors; the proportion of opposition party members, relation of local councils with mayors, and the proportion of district members among political factors; and a feature of the local council system and the number of secretariats and specialties among institutional factors. In addition, it is argued that party nomination of member candidates, albeit with some problems, has a positive effect on local councils' performance. Given these results, some policy implications are discussed, including revision of the local council election system and the candidate nomination system, measures to increase both the expertise of council members and the independence of secretariats, and the establishment of a training and education institution for members and secretariats. 본 연구는 2006년에 기초의회선거 정당공천제 도입 등 지방의회제도의 변화 전후로 기초지방의회 의정성과의 변화 동향을 파악하고, 의정성과에 대한 영향요인을 분석하는데 목적이 있다. 이에 시간적 범위는 제3∼4 대 의회(1998.7∼2006.6) 및 제5∼6대와 제7대 의회 전반기(2006.7∼2016.6)로 설정하되 연도별 자료로 정리하여 분석한다. 공간적 범위는 수도권의 부천시의회와 성남시의회, 비수도권의 경산시의회와 여수시의회를 대상으로 한다. 분석 결과 지역별, 변수별로 일부 차이는 있지만 2006년 이후 대체로 의정성과가 증가추 세를 나타냈고, 기초지방의원들의 학력, 정치적 경력, 의원 경력, 연령 등의 전문성 요인, 야당의원 비율, 단체 장과 지방의회 관계, 지역구의원 비율 등 정치적 요인, 지방의회제도, 사무기구 및 입법지원 직원 비율 등 제도적 요인이 의정성과에 영향을 미치는 것을 확인하였다. 특히 기초의회선거 정당공천제에 대한 일각에서의 우려와 달리 제도의 긍정적인 효과도 파악되었다. 분석을 통해 선행연구들에서 개별적으로 확인된 영향요인 들을 종합적으로 논의한 후 다음과 같은 정책적 시사점들을 확인하였다. 후보자 공천 시 의정실적 반영 등 다선 의원의 의정활동을 강화하는 방안과 함께 고학력자, 정치적 경력자 및 젊은 층들의 지방의회 진출 기회를 확대할 수 있는 선거제도 개선이 요구된다. 또한 전문위원 증원, 입법지원 전담직원 확대 등 의정활동 지원구조 강화, 사무국 직원의 독립성 확보를 위한 인사제도의 개선, 지방의회 전문교육기관 운영 등의 개선도 검토될 필요가 있다.

        The personal liberty is the most foundamental one that we can enjoy And consequently, all other liberties will seem to be nominal, provided that we are deprived of this liberty. With a view to secure the personal liberty, out constitution, like other other constitutions of democratic countries, prescribes details in such a way that the personal liberty may not be resticted voluntarily by national power.

        1.The fundamental human rights are defined to bo the individual public rights which people can exercise towards the nation. The constitution guarantees the public rights for the nation not to neglect the duty to protect the rights of people to the utmost. By enumerating the fundamental human rights, they mask clear the guarantee of lights by law, enfrust the law with the limit of guarantee and proscribe the possibility of limitation by law. even though parts of liberty and rights are not included, they are not to be neglected. 2.In the case of restricting the liberty and rights of people the following should be considered; first, it should be regulated by law, secondly it should be regulated for the preservation of social order and public welfare and lastly it should be kept from being infringed the essential substance of liverty and rights. 3.The new fraits of the idea concerining the guarantee of fundamental rights has court into effect the change in the from of quarantee of the fundamental rights, as is shown in Bonn constitution of west Germary and in constitution of other countries after world war II. This has come from the necessities that some reasonable restriction on the fundamental rights of a person on some persons has been asked if needed for defence of demecracy. 4.Finally, the emergency financial economy order, an emergency order (constitution 72), proclaiming martial low(constitution 75), clean-up law to political activities, and prohibition of alternations and abolitious of the elligal fortunes making law(supplement 4-2)etc, are to be taken for granted an important exception to the principle of independence of three powers. Therofere, this suggests that the principle of liberty and right are usually variable to some extent.

      • 集會, 結社의 自由에 對한 保障의 限界

        Freedom of assembly and association, what we call, indicates the one for the majority to assemble at a time in order to discuss and demonstrate in accordance with steady purpose and the one for the majority to organize a community or to keep continuous relationship of combination in order to accomplish its steady purpose. and here I take no heed of what the purpose is like. This as will as freedom of speech and press will be the standard to diistinguish democratic governments, from doctatorial ones. In addition, since tihs freedom seems inelneluctable to the realization of party politics and comes to the driving force of the development of democratic society democratic country wants the assurance of this freedom. But a nation should make it its main function to assure national security, to maintion national order and to keep public order. What is more there is immanent restriction in exercising a right. So we can't confirm this freedom without any restriction. Accordingly it is needless to say that we can't assure freedom of association toward the groups who are running wilde to overthrow social orders by means of making resort to force. Therefore this freedom is excusable in certain circumstance in accordance with the national law for the purpose of the assurance of national security, presrvation of social ordersand public rights. Espeially under the arrangement of the national emergency and proclamation of martial law exceptional restriction can be inflicted. and this restric-tion of freedom of assembly and association is unmistakable and should be applied to clear and present danger rule.

        The purpose of this study was to analyze the technical aspect of triple jump. The triple jump is one of the official event in Olympic Games since 1896. The triple jump composed of the approach, hop, step, jump and the landing. The implication of this study are as follows ; 1. The Approach 1) Develop consistent rhythmic approach and keep knees high, run tall with good spring form. 2) Keep the horizontal velocity until the jump phase. 2. The Hop 1) Extension of the take-off leg, coordinated with the opposing actions of the free leg and arms, increases the impulse applied the board. 2) Before landing, the triple jumper take-off foot is dorsi-flexed, pawing back at the ground, while arms and free leg sweep forward and together. 3. The Step 1) The jumper must remember to use an active take-off, in which the jumper's arms should be moving forward fast down and along the side of the body. 2) Utilize a double arm pump and ride as long as possible. 4. The Jump 1) Maximize height without killing velocity and drive the free knee high and into the pit. 2) The hang style is more efficient and much easier to do than the hitch kick or scissors style.
