      • 컴퓨터 법에 있어서의 책임에 관한 연구

        This paper, coauthored by Chin-Se Chung, as well as other 5 faculty members at Hong-Ik University Department of Law (Jea-Hwang Jeong, Suk-Ho Bang, Tae-Hoon Ha, Seong-Deog Yi and Bong-Chul Choi), deals with liability issuses surrounding constitutional law, administrative law, civil law (contracts, torts), commercial law, criminal law, international law and philosophy & law. Professor of Law Jea-Hwang Jeong makes a comparative analysis of privacy protection and disclosure of information legal issues, appeared at current Korean law and draft of law in case of the latter one. He suggestes some desirable ways of legislation through revision process and operation of legal rules at his paper. Professor of Law Suk-Ho Bang makes a brief survey of civil liability issues arising out of contracts and torts in English and American law, first. He tries to show that many Parts of arguments in such legal world are attributed to Statute of Frauds tradition, unique to such legal world. New developments in the area of torts, including computer malpractice and computer virus, are shown and analysed in terms of application possibility under our current law. But, as even the Anglo-American courts are found very reluctant to accept those arguments as new grounds for torts liability, it seems more plausible and practicable to refer to contractual approach, basically, rather than to torts approach even under English American law. Professor of Law Chin-Se Chung suggests in his paper on EFT that the allocation of liability under EFT be made under the new and most relevant principle, working for useful transmission way of fund, not solely under traditional legal principles. If such new principle works with high return of risk to users, it makes imminent problems against the goats of consumer protection, and eventually will be hardly refered to. Conversely, if it requires too much sacrifice from the side of banks, then the convenience in such system will not be utilized. So, it may be natural that EFT be discarded even without proper functioning under market system. In conclusion, Professor Chung points out that, only when banks fond that the economy out of cost-saving at tasks outweighs the risk undertaken by the banks, the banks will operate the system. But, if this system makes more return of benefits to the banks with the burden of users, it is against the idea of equity. Consequently, the banks should bear the aggeviated risks in return for the cost saved under this system Professor of Law Tae-Hoon Ha focuses his research paper on criminal liability under EFT. He draws his conclusion out of current criminal statutes that illegal fund transfer under automatic teller machines, cash cards and information system can not be penalized due to lack of proper statutory provision. So, the criminal provision on computer crime, newly made on December of 1995, can be positively appreciated. But, he anticipates that the question whether such new provision will be successful in regulating all illegal activites at fund transfor system without any operation defects in criminal code, or will cause new problem in interpretation of criminal code remains unsolved. Professor of Law Seong-Deog Yi examines the international legal issues which may be given rise to by direct satellite broadcasting. In his paper, the issue of national jurisdiction in relation to direct satellite broadcasting is firstly dealt with. Secondly, the possible ways in which direct satellite broadcasting is regulated by international law are examined with special emphasis of two different approaches, that is, freedom of information approach and state sovereignty approach. In this context, many international conventions concerning direct satellite broadcasting in Particular, and international regulatory regime of outer space in general are broadly reviewed. Thirdly, the types of activities which may be a violation of international legal regime of direct satellite broadcasting are suggested and the possible lethal remedies for these violations are proposed with the traditional international state responsibility law in mind. Professor of Law Bong-Chul Choi explores the relations of computerized society to its laws throughout his paper as a kind of conclusion of this whole paper. Computerized society is one that the technical, scientific, informational knowledge prevails. With correspondence to the structural change in knowledge, the law of such a society has suffered transformation, and the knowledge and techniques distributing and computing legal responsibility has also changed. However, he does not insist that the diffusion of technical knowledge is the sole factor of the transformation of legal responsibility. It is only one of the various factors. Moreover, he does not deny the continuation between the classical techniques distributing legal responsibility and the contemporary ones. In this era, the law realizes fairness and community values at the expense of singularities. In addition, he proposes that legal scholars take the diagnosis of law from the perspective of the technology/knowledge shifts seriously.

        계피의 부위별 cinnamic acid 와 cinnamic aldehyde 정량

        In order to prove which layer of Cinnamomi cortex had been used in Oriental medicine, the contents of cinnamic acid and cinnamic aldehyde as indexd component on 3 different layers of Cinnamomi Cortex were analysed respectively The results were: 1. The cinnamic acid contents of Cassiae Cortex Interior was 0.135%, inner bark layer, 0.031%, peridium, 0.023%, and average, 0.068%. 2. The cinnamic aldehyde contents of Cassiae Cortex Interior was 1.686%, inner bark layer 0.139%, peridium, 0.183%, and average, 0.696%. From the above results, it is suggested that the main part of Cinnamomi Cortex showed pharmacological activity is its interior.

        龜旨歌攷 : 배경설화를 중심으로

        우리의 고대 시가 중 ‘구지가’는 여러 면에서 중요한 위치를 차지하고 있으며,이러한 까닭으로 여러 각도에서 연구되어 왔다.‘구지가’와 그 신화에 대한 연구는 제의적 측면,발생학적 측면,무속적 측면 등으로 이루어져 왔으니,이것은 연구자마다 방법론과 시각의 차이에 따라 다른 각도에서 접근하였기 때문이다.본고에서는 ‘가락구기’가 고려 문종조에 지어진 것에 염두를 두고,그에 따른 한문학적 고찰과 아울러 무속적 제의에 중점을 두고 배경설화를 중심으로 분석해보고자 한다.‘구지가’를 자세히 살펴보기 위하여 ‘가락국기’가 지어진 배경과 그 구성원 및 그들의 생활양식을 살펴볼 필요가 있다.

        This paper suggests one of the methods which extracts feature parameters from 2-dimensional object using feature base and also provides reco-ordination and recognition method of 3-dimensional object using those extracted feature parameters. Two-dimensional feature parameters are starting point, ending point, spherical harmonic point and vertex Reco-ordination of 3-dimensional object is achieved by obtaining feature parameters from two 2-dimensional images of cameras placed in left and right of the subject and by matching obtained feature parameters using feature base method. Recognition process of 3-dimensional object is to calculate the number of vertices and the angle between vertices by recognizing triangular horn and quadrangular horn. As a result, the recognition ratio for triangular horn is 90% and for quadrangular horn is 83%.

      • 사상과 울산자연집단내 노랑초파리 제2염색체의 유전적 변이성

        The genetic variabilities of second chromosome concealed in natural populations of Drosophila melanogaster have been analyzed annually. The collections have been continued three years since 1984 in Sasang and Ulsan natural populations and the flies were analyzed by Cy//Pm method and allelism test. The results were as follows: 1) The mean frequencies of deleterious gene(lethal plus semilethal), were estimated to be 30.60% in Sasang and 25.10% in Ulsan population. 2) The mean allelism rates between lethal genes isolated from natural populations were calculated to be about 1.66%, 1.64% in Sasang and Ulsan population, respectively, 3) The values of elimination were estimated by frequencies of deleterious genes and allelism rates, the mean values were 0.0017 in Sasang and 0.0010 in Ulsan population. 4) The frequencies of phenotypic sterility were ranged from 4.5% to 13.8% in two populatons and genetic sterility were showed from 3.43% to 4.65%, with the exception of Ulsan in 1986.

        The result which was gained from this study is as follows. From the conclusion of this study it was confirmed that resistant motion at high level strength brings about rise in density of lactate in blood at the same time decline of muscular power and generates acute fatigue of nerve-muscle accompanied by decline in electrical activity of muscle. On the other hand explosive loading produced fatigue at body center and decline in nervine-muscular activity particularly for men, In case of women explosive load did not produce fatigue in the same level as men and they were also quicker in recovery after exercise. Based on 2 types of loading method used in this study there was clearly difference in the process of restoration from resistant motion. For greater decline in muscular power and electromyogram activity more longer period of recovery was require.

      • 소양호에서 세균수와 세균 체적의 계절적 수심별 변화

        To define the ecological roles of bacteria in Lake Soynng, the depth profiles of bacterial numbers and their biovolume were estimated temporally. In August, 1992, the bacterial numbers and biovolume were ranged from 12×10^(5) to 28×10^(5) cells ml^(-1) and from 0.4 to 1.0 ㎛³ cell^(-1), respectively. At 30m depth, the biovolume was highest as 1.0㎛³ cell^(-1) while the numbers were not changed. These large bacteria might be allochthonous bacteria originated from terrestrial during the heavy rain. In October, 1882, the bacterial numbers were ranged from 6×10^(5) to 17×10^(5) cells ml³ , and biovolumes at epilimnion were about 0.5 ㎛³ cell^(-1), while at metalimnion and hypolimnion, larger than 0.9 ㎛³ cell^(-1). In this time, zooplankton grazing pressure and nutrients release from sediment might affect the bacterial numbers and biovolume. In April, 1993, when Asterionella and Fragifaria were dominant species of phytoplankton only in epilimnion, the bacterial numbers were about 20×10^(5) cells ml^(-1), and biovolumes were about 0.8㎛³ cell^(-1). While at other depths, the numbers and biovolumes were smaller. These results suggest that the bacterial numbers were dynamically changed with season, while their mean cell volume were commonly stable as 0.5㎛³ cell^(-1). But by the allochthonous bacteria, organic materials released by phytoplnnkton and grazing pressure by zooplankton might increase the biovolume.

        The goal of this study is the development of PC-based surface modeling system based on surface modeler for easy free-form surface modeling, and then building a Database by linking this developed system with the surface modeler, so we can apply this Database to DAM system. The developed surface modeling system is linked with the Database so the storing Database through simulation is applicable to manufacturing process, and it saves processing time and cost by removing unnecessary processes.

        When mating type A and a cells of heterobasidiomycetous yeast Rhodosporidium toruloides were mix-cultured, both of the mating type cells have shown strong agglutination. But this agglutination was not detactable when the A and a cell were cultured separately. From reagglutination made just after the result of disassembling the agglutination by sonication, we knew that the agglutination was sexual-agglutination, not simple physical cell agglutination. The sexual agglutination was progressed actively on logarithmic phase and, in addition, progressed faster on mating type a cell treated with rhodotorucine A. These sexual agglutination have been inhibited by several protease such as trypsin, pronase, chymotrpysin and thermolysin and inhibited by 5 mM DTT as well.

        양극산화와 절연파괴로 형성한 Ti-6Al-7Nb 합금의 산화피막 특성 평가

        This study was performed to investigate the surface properties of electrochemically oxidized Ti-6Al-7Nb by anodic spark deposition technique. Discs of titanium alloy Ti-6Al-lNb of 20 mm in diameter and 2 mm in thickness were polished sequentially from #300 to #1,000 emery paper. They were ultrasonically washed in ethyl alcohol and acetone for 5 min and dried in a desiccator. Ti-6Al-7Nb was anodized in an electrolytic solution that was dissolved calcium and phosphate in water. The electrolytic voltage was set in the range of 170-320 V and the current density was 30 mA/cm^2. The surface oxide film was characterized by X-ray diffractometer, scanning electron microscope (SEM) and X-ray photoemission spectroscopy (XPS). The results obtained were summarized as follows; The main crystal structure of the titanium oxide was anatase type as analyzed with thin-film X-ray diffractometery. The coatings were porous with Pore diameter of 1~4 ㎛. The diameter of micropores increased with increasing the spark forming voltage. The porous coatings showed the growth of cell structure and more compact texture with increasing the voltage. Ca/P ratio in coatings was increased with increasing the voltage.
