과중채무로 인한 채무조정 신청자가 연간 20만 명을 넘지만 관련 제도의 이용 경험에 관한 정보는 드물다. 이 연구는 대표적인 채무조정제도인 개인워크아웃 이용자를 대상으로 그들의 제도 이용 경험 그리고 완제에 기여한 요인들을 살펴보았다. 이를 위해 채무조정 신청 후 다년간의 채무상환을 거쳐 완제에 이르거나 앞둔 개인 9명을 심층면접하였다. 채무조정 이용경험과 관련하여 신청의 동기는 ‘추심으로부터의 해방과 신용회복에 대한 기대’, 신청 당시의 심리적 상태는 ‘위축과 긴장과 불안감’, 길고 어려웠던 변제 과정과 신용회복과 경제적 ‘재기할 수 있는 기회에 대한 고마움’이 두드러졌다. 완제에 기여한 요인으로는 개인워크아웃 제도 내 요인(채무액 조정, 분할 및 장기납부, 상환유예, 상담사의 정서적 지지), 경제적 요인과 사회안전망 요인(일자리와 소득, 장해연금과 같은 사회복지제도), 사회적 지지 요인(가족과 지인의 경제적 지원, 심리정서적 지지), 개인적 요인(자신과의 약속, 변제에 대한 책임감과 자립의지, 일상생활 복귀에 대한 염원, 가족에 대한 책임감)이 있었다. 연구결과는 채무조정 및 신용회복제도와 사회복지제도와의 연계와 협력, 그리고 개인의 회복탄력성을 강화할 수 있게 하는 제도적 지원의 중요성을 보여준다. 이 연구는 채무조정 이용 경험과 완제 요인을 탐색한 새로운 시도라는 점에서 학술적, 실천적 의의가 있다. While over 200,000 people apply for debt relief programs every year in South Korea, little information is available about their experiences in the programs. This study examines experiences of and associated factors for successful debt relief. In-depth interviews were conducted for 9 individuals who successfully completed debt relief or those who are about to. Main results about their experiences of using debt relief programs are as follows: ‘Being free from debt collection and hope for credit recovery’ as reasons for pursuing debt relief; ‘Strain and anxiety’ as emotional state at the time of pursuing debt relief; and ‘Appreciation’ for the opportunities of credit recovery. Associated factors for successful debt relief are as follows: 1) institutional factors: debt reduction, extension of repayment period, temporary exemption of repayment & counselors’ emotional support’; 2) socioeconomic factors: jobs and stable income & social security programs; 3) social support: financial help & emotional support; 4) personal factors: determination to pay off debt, sense of commitment and responsibility for repayment, value of self-reliance, and responsibility for family. Findings suggest the need for coordination between debt relief programs and social services, and the importance of institutional support for enriching debtors’ resilience.

본 연구는 아동·청소년을 대상으로 하는 온라인 그루밍 성범죄가 증가하는 이유를 짚어보고, 온라인 그루밍이 일어나는 구체적 과정을 드러내는 것을 목적으로 한다. 이를 위해 본 연구는 온라인 그루밍 피해 아동·청소년을 상담한 경험이 있는 아동·청소년 지원기관 실무자 9명을 대상으로 심층면접을 진행했다. 연구 결과, 성범죄자들은 디지털 환경의 관계 맺기에 익숙한 아동·청소년들의 특성을 악용해 이들에게 접근하고 순응, 협박, 통제 과정을 거쳐 성착취를 행하는 동일한 전략을 사용하고 있었다. 하지만 온라인 그루밍의 채널이 다양화·음지화되면서 위험이 증가하는 데 반해, 온라인 그루밍이 성범죄로 인식되지 않거나 아동·청소년 피해자가 자발적 동조자로 간주되면서 사회적 지원체계에서 멀어지는 경우가 많았다. 이를 통해 본 연구는 한국사회가 온라인 그루밍의 피해자인 아동·청소년을 낙인찍기보다, 디지털 네이티브인 아동·청소년의 특성을 이해하고, 사회·문화적 구조 개선에 초점을 맞추어 온라인 그루밍 성범죄에 대한 대응책을 마련할 필요가 있음을 주장하고자 한다. The purpose of this study is to examine the background of the increase in online grooming targeting children and adolescents, and to reveal the process of the online grooming sex offenses. To this end, this study conducted in-depth interviews with 9 practitioners of child and adolescent support organizations who had experience counseling with children and adolescents victims of online grooming. The findings show that the groomers have contacted children and adolescents, by taking advantage of teen’s characteristics as digital natives. It also reveals that the groomers use the same strategy of compliance, threat, and control for sexual exploitation. Since the channels of online grooming are being hidden and diversified, its danger is increasing. However, in many situations, online grooming is not yet recognized as crime. The young victims are considered as voluntary participants and it makes them drift away from the social supporting system. Through these results, this study proposes the necessity of understanding the characteristics of digital native children and adolescents, and focusing on the sociocultural structures, rather than stigmatizing children and adolescents who become victims of online grooming.

채무조정 경험에 대한 현상학적 연구: 과중채무자가 인식하는 사회적 배제의 의미

본 연구는 채무조정제도 이용자와의 심층인터뷰를 토대로 과중채무와 채무조정 경험의 의미와 본질을 파악하는 것을 목표로 한 질적 연구이다. 연구참여자는 채무조정―개인워크아웃을 이용한 성인 총 9명으로 채무상환을 완료하였거나 완료 예정자들이다. 이들은 채무 발생부터 과중채무, 채무조정 신청, 변제, 그리고 완제에 이르기까지 겪은 다양한 경험, 감정, 의견을 제시하기에 적합하다. 자료의 분석은 Giorgi가 제안한 기술적 현상학적 연구의 절차를 따랐다. 연구참여자들의 개별적이고 상황적인 경험에 대한 기술인 상황적 구조 기술에서 드러난 23개의 주제들을 유사성, 공통성 차원에서 유목하여 결집했고, 이를 토대로 7개의 본질적 주제를 구성하였다: 불가항력으로 시작된 채무; 가족에게서 멀어짐; 주변에서 멀어짐; 잃어버림의 연속에서 나에게서 멀어짐; 안정적인 삶의 구조에서 멀어짐; 채무조정제도의 양가성; 제자리는 아니지만 현재의 자리를 인정. 이 연구는 과중채무와 채무조정을 이용한 당사자의 목소리를 통해 중첩적으로 배제를 경험하는 것으로 알려진 과중채무자에 대한 이해를 높이고 나아가 그들을 지원하기 위한 방안을 제시한다. This qualitative study aims to explore the ways in which indebted individuals understand the meanings and implications of debt relief in their own lives. Data were collected through in-depth, semi-structured interviews with nine people who have completed or were in the final stage of the process of debt relief. Data were analyzed by the Giorgi’s descriptive phenomenological method. Analyzes of the data have yielded seven themes: uncontrollable indebtedness; being alienated from family; being alienated from friends; being alienated from themselves; uncertainty of lives; ambivalence in the process of debt relief; and acknowledging current situation. The findings enhance our understanding of the lives of individuals who are over-indebted and rely on debt relief. Implications for more effective debt relief programs are suggested.
