本文是对于中韩日三国电子产品输出竞争力比较优势的分析研究。以2000年到2009年10年间的贸易资料为分析对象,利用贸易资料,对各国数字产品产业的贸易构造,贸易特化系数,显示性比较优势指数,以及三国以世界市场,美国市场和欧洲市场为对象的出口相似度指数的年度变化进行研究分析。贸易特化系数的分析结果显示,韩国具有进口型贸易特性,中国具有出口型贸易特性,而日本属于中立性特性。从进口产品类别的显示性比较优势指数来分析,韩国和日本是在电影类产品具有较高的比较优势指数,而中国是在电子游戏用具产品类具有较高的比较优势指数。从出口相似度的分析结果来看,2000年代前期,韩国与日本具有较高的出口相似度,而到了最近,韩国与中国的出口相似度高于与日本的出口相似度。本研究能够对大家理解亚洲三国的数码产品产业及数字虚拟产品产业出口竞争力的变迁以及未来的产业结构提供帮助。

In this article, I have analyzed the current situation and problems of the U.S. legislations for Electronic Commerce in order to obtain some lessons for the Korean policy for the future legislation. Korea is far behind in this area of law, whereas the United States has unique problems in both procedural and substantive laws. In the former, they have problems of preemption between the federal and state laws, which are peculiar to their federal systems and with which Korea has nothing to do. In the latter, they have conflicts of interest between the Software Makers and Consumers and presently a fierce battle is being waged concerning the Uniform Computer Information Transaction Act. In this regards, Korea will soon face a problem to protect our consumers' interest against the one sided licensing arrangements of the U.S. Software Makers. Korea should wait for the version of UCITA or a U.S. federal legislation which reflects a balanced interest of Software Makers and Consumers.

This paper analyzed the Trade Structure of environmental industry in Korea and some major countries in preparation for The Doha Development Agenda (DDA) Trade Liberalization Negotiation in the environmental goods. Based on 161 environmental goods list proposed by OECD, this paper examined the Trade Returns of worldwide environmental goods during the past 10 years from 2002 to 2011. The analysis showed that Korean environmental goods' International Market Share(IMS) in the world was 3.2%; trade specialization index(TSI) –0.128; Revealed Comparative Advantage(RCA) 1.002 in 2011. And Korea Export Similarity Index(ESI) to Japan was the highest rank in the world market. According to the results of investigation, it is clear that International Competitiveness of the Korean Environmental Industry was received a relatively poor evaluation compared with Korean trade scale. To strengthen the competitiveness, it is required that Korean government should make an effort to boost domestic environmental industry and promote systematically Trade Liberalization Negotiation including the enforcement of transient period for Korean environmental goods in the next DDA Negotiation. 본 논문에서는 DDA 환경상품 무역자유화 협상에 대비하여 세계 주요국과 우리나라의 환경산업 제품에 대한 무역구조를 분석하였다. OECD에서 제안한 161종의 환경상품 리스트를 기반으로 2002년부터 2011년까지 10년간 전 세계 환경상품의 무역 통계를 조사하였다. 환경산업의 세계 무역규모는 2002년 4,639억 달러에서 2011년 1조4,778억 달러로 3배 이상 증가하였다. 우리나라의 2011년 환경상품의 세계시장 점유율은 3.2%이며, 무역특화지수는 –0.128, 현시비교우위지수는 1.002이며 세계시장에서 일본과 수출경합도가 가장 높은 것으로 나타났다. 본 논문에서 우리나라의 환경상품의 국제경쟁력은 무역규모에 비해 국제경쟁력이 상대적으로 약한 것으로 조사되었다. 따라서 향후 지속될 DDA 환경상품 자유화 협상에서 우리나라는 환경상품의 유예기간 설정 등 단계별 무역자유화 추진과 국내 산업의 경쟁력 향상을 위해 노력해야 할 것이다.

A Study on the Legal Aspect of Electronic Commerce by Internet The legal problems of Electronic Commerce by Internet are evidential issues of EDI such as request of writing, authentification, electronic signature and contractual issues of EDI transactions, liability issues of the parties. UNCID and UNCITLAL model law on Electronic Commerce treat the legal problems of EDI transactions. This study brings focus to the issues and opportunities in the implementation of Electronic Commerce and look into the legal problems of Electronic Commerce by Internet and new legislation about Electronic Commerce.

Electronic Commerce(EC) has become so important that countries and firms unprepared for this new trend would lose competitive advantages in the coming century of Digital Economy. Despite its importance, current EC markets in Chonnam are immature and there still exist several barriers to EC development. The objective of this paper is to study the status quo of Chonnam EC markets, to investigate barriers to EC, and to provide suggestions to overcome the barriers. The first part of this paper defines EC and Internet Electronic Trade and investigates the present conditions of EC. In Chapter 3, the actual conditions of Internet and EC application of small and medium sized companies in Chonnam province are analyzed in detail Chapter 4 describes technical issues for EC. Chapter 5 describes the business strategies for EC. Finally, barriers to EC are identified in Chapter 6, together with suggestions to overcome these barriers and to enlarge Chonnam EC markets.

The study states a theory based on U.C.C. §2-201 as the legal evidence of EDI messages. First, we ascertain the meaning of signature under the current system of trade at shich a paper is a supposed medium for concluding. Then, with investigating the legislative changes in introducing electronic telegram, we try to find the possibility of the adoption of EDI. Finally, in association to domestic electronic document, we compare and analyze the related laws and present basic problems that should be reflected in the process of EC legislation.

地方政府의 對外對策에 관한 事例 硏究 : 日本에 있어서 地域의 國際化 現狀과 向後의 方向

The objective of the article is to examine the foreign policies of the four representative Prefectures in Japan and to propose the direction of foreign policies of Korean local govemments. Based on the close examination of the Japanese case, the author proposes the following basic points that should be considered when the internationalization is driven forward. First, the local govemments should make an effort to establish themselves from the centralized political, economic and social structure. Second, the internationalization should be done with the consideration of the locality including the characteristics, environments, nature, humanity and history peculiar to the local area. Third, the internationalization should be done without discrimination on the basis of race, nationality and class. Forth, the main body of the internationalization should be the local residents.
