        Law and Insurance Claim of General Average: a Comparative Study on York-Antwerp Rules, the Law of English and Taiwan

        General average system is a special part of maritime law, which is considered to have existed long before insurance policies, and the general average loss is to be made good by the contribution of all concerned, when the adventure is saved. Different insurance policies will cover the sacrifices and extraordinary expenses and general average contributions arising from a general average contributions arising from a general average act. This paper will study the underwriter liability for general average losses according to Marine Insurance Act, 1906. After inductive analysis, this article proposes revised suggestions of the law pertaining to the claim of general average for an underwriter in Taiwan.

        Proton Pump Inhibitor-unresponsive Laryngeal Symptoms Are Associated With Psychological Comorbidities and Sleep Disturbance: A Manometry and Impedance-pH Monitoring Study

        Background/AimsLaryngeal symptoms are largely treated with empiric proton pump inhibitor (PPI) therapy if no apparent pathology shown on ear, nose, and throat evaluation and reflux-related etiologies are suspected. However, treatment response remains unsatisfactory. This study aimed to investigate the clinical and physiological characteristics of patients with PPI-refractory laryngeal symptoms. MethodsPatients with persistent laryngeal symptoms despite PPI treatment for ≥ 8 weeks were recruited. A multidisciplinary evaluation comprising validated questionnaires for laryngeal symptoms (reflux symptom index [RSI]), gastroesophageal reflux disease symptoms, psychological comorbidity (5-item brief symptom rating scale [BSRS-5]) and sleep disturbance (Pittsburgh sleep quality index [PSQI]), esophagogastroduodenoscopy, ambulatory impedance-pH monitoring, and high-resolution impedance manometry were performed. Healthy asymptomatic individuals were also recruited for comparison of psychological morbidity and sleep disturbances. ResultsNinety-seven adult patients and 48 healthy volunteers were analyzed. The patients had markedly higher prevalence of psychological distress (52.6% vs 2.1%, P < 0.001) and sleep disturbance (82.5% vs 37.5%, P < 0.001) than the healthy volunteers. There were significant correlations between RSI and BSRS-5 scores, and between RSI and PSQI scores (r = 0.26, P = 0.010, and r = 0.29, P = 0.004, respectively). Fifty-eight patients had concurrent gastroesophageal reflux disease symptoms. They had more prominent sleep disturbances (89.7% vs 71.8%, P < 0.001) than those with laryngeal symptoms alone but similar reflux profiles and esophageal motility. ConclusionsPPI-refractory laryngeal symptoms are mostly associated with psychological comorbidities and sleep disturbances. Recognition of these psychosocial comorbidities may help optimize management in these patients.

        Pioglitazone and Prostate Cancer Risk in Taiwanese Male Patients with Type 2 Diabetes: A Retrospective Cohort Study

        Purpose: This study investigated prostate cancer risk associated with pioglitazone use. Materials and Methods: The Taiwan’s National Health Insurance database was used to create a propensity score-matched cohort of male patients with type 2 diabetes mellitus newly diagnosed in 1999-2005 and aged ≥25 years at baseline. The matched cohort included 20437 ever users and 20437 never users of pioglitazone. The patients were followed up for the incidence of prostate cancer until December 31, 2011. Hazard ratios (HRs) were created from Cox regression weighted on propensity score. Results: Prostate cancer was diagnosed in 121 ever users of pioglitazone (incidence: 175.84 per 100,000 person-years) and 143 never users of pioglitazone (incidence: 216.66 per 100,000 person-years). When ever users were compared to never users of pioglitazone, the HR was 0.815 (95% confidence interval [CI], 0.639–1.039; p=0.0987). When ever users were cat-egorized into tertiles of cumulative duration of pioglitazone therapy (<6.83, 6.83–20.23, and >20.23 months), the HRs were 1.044 (95% CI, 0.741–1.471), 0.975 (95% CI, 0.690–1.377) and 0.539 (95% CI, 0.374–0.778), respectively. For the tertiles of cumulative dose of <5,040, 5,040–15,330, and >15,330 mg, the HRs were 1.008 (95% CI, 0.710–1.429), 1.090 (95% CI, 0.785–1.515) and 0.484 (95% CI, 0.330–0.711), respectively. A significantly lower risk associated with pioglitazone use could only be seen in patients aged <65 years (HR, 0.578; 95% CI, 0.360–0.927) but not in patients aged ≥65 years. Conclusions: A significantly lower risk of prostate cancer is observed after a cumulative duration of pioglitazone therapy for >20.23 months or a cumulative dose of >15,330 mg. The risk reduction is mainly observed in patients aged <65 years.

        Characterization of machining quality attributes based on spindle probe, coordinate measuring machine, and surface roughness data

        This study investigates the effects of machining parameters as they relate to the quality characteristics of machined features. Two most important quality characteristics are set as the dimensional accuracy and the surface roughness. Before any newly acquired machine tool is put to use for production, it is important to test the machine in a systematic way to find out how different parameter settings affect machining quality. The empirical verification was made by conducting a Design of Experiment (DOE) with 3 levels and 3 factors on a state-of-the-art Cincinnati Hawk Arrow 750 Vertical Machining Center (VMC). Data analysis revealed that the significant factor was the Hardness of the material and the significant interaction effect was the Hardness + Feed for dimensional accuracy, while the significant factor was Speed for surface roughness. Since the equally important thing is the capability of the instruments from which the quality characteristics are being measured, a comparison was made between the VMC touch probe readings and the measurements from a Mi-tutoyo coordinate measuring machine (CMM) on bore diameters. A machine mounted touch probe has gained a wide acceptance in recent years, as it is more suitable for the modern manufacturing environment. The data vindicated that the VMC touch probe has the capability that is suitable for the production environment. The test results can be incorporated in the process plan to help maintain the machining quality in the subsequent runs.

        Technological Competition and Cultural Rivalry: The Post-war Coke Wars in Taiwan’s Beverage Industry

        After World War II, along with the U.S. economic and military aid to foreign countries, its capitalism and mass consumerism gradually swept the world, forming the phenomenon of “Americanization.” Coca-Cola’s world-wide popularity was regarded as an important representative of the wave of American consumerism. With its exceptional taste, efficient production system, extensive advertising and promotions, and the American consumer culture it represents, Coca-Cola was often welcomed by the public everywhere it went and had created tremendous pressure on the local beverage industries. In order to compete with Coca-Cola in the beverage market, local beverage manufacturers likewise had to imitate Coca-Cola to innovate their production techniques and marketing methods. In 1968, Taiwan also opened up Coca-Cola to the local consumer market, and Taiwan’s local beverage manufacturers began a fierce competition with foreign beverage manufacturers such as Coca-Cola and Pepsi-Cola. Focusing on the competition between Coca-Cola and Taiwanese local beverage manufacturers in the 1960s and 1970s, this article analyzes the reform strategies of local beverage manufacturers and the impacts they bore. This article argues that Taiwanese beverage manufacturers have been quite successful in the competition. However, the key to their success was not simply the improvement of production facilities or the imitation of marketing strategies, but also the search for beverages that fit the local consumer context and the establishment of a beverage culture different from that of Coca-Cola. The success of this strategy ensured the position of local manufacturers in the beverage market; further, it unintentionally contributed to the development of local food traditions. This research demonstrates that “Americanization” does not signify the continuous acceptance of American values, but rather conveys the possibilities of stimulating a localized culture.

        Can Flexible Exchange Rates Insulate the Impact of Foreign Monetary Shocks? : The Case of Monopolistic Competition

        In a two-country model of monopolistic competition where PPP holds at aggregate price levels, this paper examines whether market imperfections alone can fail flexible exchange rates to insulate aggregate output from foreign monetary shocks. It finds that the possibility of insulation hinges on whether monopolists can freely adjust their individual prices to optimum If monopolists keep rigid their individual prices, these shocks will destabilize domestic aggregate output; and the greater the drgree of monopoly power, the larger the output fluctuations. The study conveys an implication for recent menu-costs models that price adjustment costs not only can cause price stickiness and non-neutrality of money, as they have shown but can fail flexible rate to achieve insulation as well.

        Black Hole along with Other Attacks in MANETs: A Survey

        Security issue in mobile ad hoc network (MANET) is a promising research. In 2011, we had accomplished a survey of black hole attacks in MANETs. However network technology is changing with each passing day, a vast number of novel schemes and papers have been proposed and published in recent years. In this paper, we survey the literature on malicious attacks in MANETs published during past 5 years, especially the black hole attack. Black hole attacks are classified into non-cooperative and collaborative black hole attacks. Except black hole attacks, other attacks in MANET are also studied, e.g., wormhole and flooding attacks. In addition, we conceive the open issues and future trends of black hole detection and prevention in MANETs based on the survey results of this paper. We summarize these detection schemes with three systematic comparison tables of non-cooperative black hole, collaborative black hole and other attacks, respectively, for a comprehensive survey of attacks in MANETs.

        E-quality control: A support vector machines approach

        The automated part quality inspection poses many challenges to the engineers, especially when the part features to be inspected become complicated. A large quantity of part inspection at a faster rate should be relied upon computerized, automated inspection methods, which requires advanced quality control approaches. In this context, this work uses innovative methods in remote part tracking and quality control with the aid of the modern equipment and application of support vector machine (SVM) learning approach to predict the outcome of the quality control process. The classifier equations are built on the data obtained from the experiments and analyzed with different kernel functions. From the analysis, detailed outcome is presented for six different cases. The results indicate the robustness of support vector classification for the experimental data with two output classes.

        A High-Efficiency High Step-Up Interleaved Converter with a Voltage Multiplier for Electric Vehicle Power Management Applications

        This paper proposes a novel high-efficiency high-step-up interleaved converter with a voltage multiplier, which is suitable for electric vehicle power management applications. The proposed interleaved converter is capable of achieving high step-up conversion by employing a voltage-multiplier circuit. The proposed converter lowers the input-current ripple, which can extend the input source's lifetime, and reduces the voltage stress on the main switches. Hence, large voltage spikes across the main switches are alleviated and the efficiency is improved. Finally, a prototype circuit with an input voltage of 24 V, an output voltage of 380 V, and an output rated power of 1 kW is implemented and tested to demonstrate the functionality of the proposed converter. Moreover, satisfying experimental results are obtained and discussed in this paper. The measured full-load efficiency is 95.2%, and the highest measured efficiency of the proposed converter is 96.3%.
