초·중등 교육분권을 위한 법령 제·개정 방안 연구 -초·중등교육법과 초·중등교육법 시행령을 중심으로-

최근 논의되고 있는 교육분권을 위한 법률안과 그동안 중앙정부와 교육감 간 갈등의 주된 원인으로 지목된 교육 관련 법령의 공동주어에 대한 현황을 분석한 후, 보충성의 원칙에 입각하여 「초․중등교육법」과 「초․중등교육법시행령」의 개정안을 마련하고자 하였다. 그 결과, 최근 논의되고 있는 교육자치정책협의회의「유ㆍ초ㆍ중등 교육의 지방분권에 관한 특별법안」과 국회 박경미 의원이 발의한「지방교육자치에 관한 법률」개정안 모두 원칙적으로 교육 권한은 교육감에게 주어야 한다는 것을 전제로 법률의 제·개정을 추진하고 있음을 확인할 수 있었다. 교육 관련 법령의 공동주어 조문을 분석한 결과, 52개의 법령에서 221개 조문이 공동주어로 명시되어 있음을 확인할 수 있었고, 실질적이고 포괄적인 교육분권을 위해서는 교육분권 일괄법 제정과 이에 따른 개별 법령의 정비가 조속하게 이루어져야 함을 알 수 있었다. 그리고 이 연구에서 살펴본 「초·중등교육법」과 「초․중등교육법 시행령」외 「교육기본법」 등 50여 개의 교육 관련 개별 법령의 개정안에 대한 세부적인 연구가 이루어져야 하며, 공동주어 조문 뿐 아니라 각 조문들이 중앙 집권적이고 획일적인 교육을 조장하는 내용을 포함하고 있지 않은지 면밀한 검토가 이루어져야 함을 제언한다. In this study, the recent legislation for educational decentralization was reviewed. Since expressions of the grammatical subjects in education-related laws have been caused conflicts, the status quo of the expressions was also reviewed. Due to the importance of 「Primary and Secondary Education Act」and 「Primary and Secondary Education Act Enforcement Decree」, revised versions were proposed on the principle of supplementation. As a result, findings show that recent discussions on 「Special Acts on the decentralization of primary and secondary education」of Council on Government Policy and 「Local Education Act」proposed by the congresswoman Park Kyung-Mi, emphasize that more authority should be given to educational superintendents. According to the analysis of grammatical subjects of education-related laws that have been causing conflicts between the education minister and the superintendent, grammatical subjects from more than 221 clauses in 52 educational laws comprised of ‘the education minister’ and ‘the education superintendent’ in the same sentence. This co-expressions of grammatical subjects are considered damaging local educational authority. Therefore, along with the enactment of a comprehensive law for education decentralization, individual educational laws should be revised as soon as possible in order to achieve practical educational autonomy. Furthermore, including 「the Primary and Secondary Education Act」 and 「the Primary and Secondary Education Act Enforcement Decree」, the other 50 educational laws should be analyzed in terms of expressing the sentence subjects. It is also recommended that careful review should be conducted if there is any contents of government controlling or standardized education in the laws mentioned above.
