우리나라는 인구성장률은 물론 경제성장률도 점점 감소할 것으로 전망되고 있다. 토지가격 변동률도 예외가 아니다. 이와 같은 저성장기에는 토지은행의 필요성과 역할에 대해 의문을 제기하는 경우가 많다. 이는 대부분의 경우 고도 성장기에 비축제도가 설계되어 있기 때문이다. 선진국의 토지은행제도를 보면, 단지 경제적 측면에서의 비용절감 및 재정 문제를 해결하려는 취지뿐만 아니라, 계획적·사회적 측면을 강조하는 의미로 목적이 확대되고 있으며 제도를 둘러한 환경변화와 더불어 단계적이고 전략적인 토지비축을 하는 경향이 있다. 이 논문은 저성장기에도 토지은행의 역할이 줄지 않으며 오히려 공공성 강화 차원에서 비축 목적을 보다 확대되어야 한다는 점을 강조한다. 저성장기에는 서민주거 안정 도모와 같은 사회안정화 역할과 기업의 부실자산 매입과 같은 경제안정화 역할이 필요하기 때문이다. 이를 위해 비축제도가 보다 적극적인 역할을 할 수 있도록 비축목적과 비축수단 등을 포함하는 법체계와 운영방안의 재검토가 필요하다. 저성장기에 부응한 토지비축법의 개편방향은 우선 토지은행의 역할 재정립을 위해 비축목적을 수정하여 다양한 목적의 토지를 토지은행이 취득할 수 있도록 해야 한다. 또한 다양한 공공토지의 원활한 비축을 위해 공공토지비축계획은 관련 법률의 계획을 반영하여 수립되어야 한다. 마지막으로 토지은행의 공공토지비축자금의 원활한 마련을 위해서는 공공토지비축기금의 설치가 반드시 필요하다. Recently the reform of land banking system which was introduced in 2009 has attracted interest from academics in Korea. Although the land saving system is an effective means to provide appropriate public facilities and to manage land market, the system didn't play an important role in reserving land for SOC and industrial complex since the introduction of land banking system. The reason is mainly due to financial insufficiencies. In addition to this, low rate of economy and population growth make the land banking system difficult. In this context this paper is aimed at identifying the efficacy of the land banking system particularly in economic recession period and at suggesting policy implications and revision of the land banking law. The conclusions are summarized as follows: Firstly, the role of land banking system should reestablished. In doing this, objectives of land savings are enlarged according to the change of socio-economic conditions, such as economic recession. Secondly, various plans based on relevant laws should be comprehensively reflected in the land purchase plan. Finally, in order to secure financial resources, establishment of land savings funds will be needed.
