현대의 사회생활이 점점 다양해지고 복잡해지면서 우리의 안전한 삶을 위협하는 다양한 위험요인들이 존재하는데, 그 중에서도 점점 범죄발생건수가 늘어나고 수법이 지능화, 신속화, 흉포화, 집단화 되가는 추세에 민간경비는 더 이상 사회 안전관리에 대한 방관자적 입장이 아닌 국가기관과 사회전체의 공동책임이라는 사회범죄예방의 주체자적 역할을 수행하고 있다.<BR> 1978년 10여개에 불과하던 경비업체가 2007년 12월 말 현재 2800여개, 경비원수 약130,000에 이를 정도로 질적인 성장과 양적인 성장을 하여왔다.<BR> 이제 21세기 새로운 치안행정구조와 국민소득 2만불 시대를 지향하는 참여정부의 혁신정책에 부응하여 현행 경비업법 전반에 걸친 과감한 개정이 필요한 시점에 왔다. 위축된 기업성을 회복시켜 공공성과 균형을 이루어야 한다. 여기에 경비업 개정의 당위성과 필요성이 있다.<BR> 따라서 본 논문에서는 한국민간경비산업의 현황을 살펴보고 문헌적 연구를 통하여 경비업법의 문제점을 도출하고 이에 따른 적절한 개선방안을 모색하고자 한다. There are various factors that bring danger and threaten our lives, as life in modem society is increasingly becoming more diverse and complex. The crime rate is growing rapidly and modi operandi are becoming more and more intellectual, fast, brutal and organized. Private guards no longer take an onlooker"s view on society"s safety management. Being aware that both government organizations and society are responsible for citizens"safety, private guards are taking the initiative in the prevention of crime in society.<BR> In the year 1978 there were no more than ten private guard companies. The private guard industry has experienced remarkable growth over the past thirty years. As of Dec. 2007 there are 2800 guard businesses and approximately 130,000 guards. Despite this growth the Korean private guard industry faces a serious obstacle that has deterred the industry from developing further compared to other developed countries. The further growth of the Korean private guard industry requires changes in and improvement of relevant laws and systems.<BR> This study looks at the present status of the Korean private guard industry. Based on the literature review, the study aims to examine and present problems of private guard business laws, and finally suggest ways to improve the problems.

민간경비교육기관 개방에 따른 문제점 및 개선방안 - 개정 경비업법 시행규칙 제12조제2항을 중심으로 : 민간경비교육기관 개방에 따른 문제점 및 개선방안

경비원 자질향상을 위하여는 교육훈련, 보수, 복지시설, 사회적 인식 그리고 정부정책 등 여러 가지가 함께 고려되어야 하겠지만 그중에서도 시급하고도 중요한 것은 교육훈련문제라 할 것이다. 우리니라에서도 경비원의 자질문제는 어제 오늘의 얘기가 아닌 경비업법제정 된 이래 꾸준히 부각되는 문제로서, 1991년 「경비지도사」 제도를 도입하여 경비원에 대한 교육을 담당토록 하였다, 경비원 자질향상에 경비지도사의 근무여건을 개선하여 직무를 성실하게 수행하도록 하기위하여 경찰청에서는 2005년 9월1일부로 감독명령을 발령하여 경비지도사의 지위를 준관리자급으로 향상시켰다. 이와 동시에 경비지도자들의 활동으로 경비원의 자질이 꾸준히 향상되고 있었다. 그러나 최근 경찰청에서는 경비업법 시행규칙 제12조제2항을 개정하여 경비원 교육제도 개편과 경비업법령을 개정하여 경비원 교육을 강화하고, 자질 향상을 위한다는 취지하에 일반경비원신임교육의 위탁제도가 폐지시키고, 일반경비원신입교육을 우리협회를 비롯한 46개 민간교육기관으로 개방하였다. 이에 민간경비 교육기관 개방이 우리나라 민간경비업체에 어떠한 영항을 미치는지를 알아보고 개선방안을 재시하고 한다. Improving the capabilities of security guards involves the consideration of various issues such as training, salary, welfare benefits and social/public awareness, Among these education and training is the moot important and needs to be urgently dealt with. The issue of security guards" capabilities has teen discussed since the enactment of the security guard business law. The security instructor system to train security guards has been adopted in 1997. With the aim of enhancing security guards/capabilities, and improving security instructors" working conditions and work efficiency the National Police Agency has issued an official order to appoint security instructors to a supervisory position. The promotion of security instructors to an associate managerial position has enhanced their work efficiency to a great extent. As a consequence, the capabilities of security guards have continued to improve considerably. Recently, the National Police Agency has amended the Clause 2, Article 12 of the enforcement regulations of the security guard business law. It has revised security guards training and education systems, and security guard laws and ordinances to strengthen security guard training and education and increase the capabilities of security guards. Training and education for newly recruited security guards are no longer handled by a small number of exclusive training institutes. The National Police Agency has opened training and education for newly recruited security guards to forty six educational organizations including the Korean Security Association. This study aims to the impact of opening security guard education and training to private organizations on the Korean security guard businesses. The study then intends to make suggestions about the new system of security guard education and training.

우리나라에서도 경비원의 자질문제는 어제 오늘의 얘기가 아닌 경비업법 제정된 이래 꾸준히 부각되는 문제로서 1997년 경비지도사 제도를 도입하여 위탁 제도하에서 경비원에 대한 교육을 담당토록 하였으며, 경비지도사들의 많은 노력과 활동으로 경비원의 자질이 꾸준히 항상되고 있었다. 이때 경찰청에서도 경비지도사의 능력 자질을 인정하여 경비지도사의 근무여건을 개선하여 경비원교육 등 직무를 성실하게 수행하도록, 경찰청에서 2005년 9월1일부로 감독명령을 발령하여 경비지도사를 준관리자금으로 지위를 향상시켰다.<BR> 그러나 경찰청에서는 경비업법 시행규칙 제12조제2항을 경비원교육제도 개편과 경비업법령 개정하여 경비원 교육을 강화하고, 자질향상을 위한다는 취지하에 일반경비원신임교육의 위탁제교육을 폐지시키고(경비지도사 제도자체가 유명무실하게 됨) 교육기관제 교육을 도입하여 일반경비원신임교육을 우리협회를 비롯한 46개 민간경비교육기관으로 개방하였다. 이에 위탁제 교육 폐지가 우리나라 민간경비산업에 미치는 실태를 분석하여 개선방안을 제시하고자 한다.
