        대형 건축 턴키공사의 클레임예방을 위한 클레임 요인 분석에 관한 연구 - 국내 사례를 중심으로 -

        국내의 연간 공사발주 물량의 약 $10\%$를 차지하고 있는 턴키공사는 발주처의 인력부족과 기술력부족으로 인하여 충분히 검토되지 못하고 진행되는 경우가 많으며, 발주자우위의 계약조항을 포함하고 있는 등의 문제점을 안고 진행되고 있다. 본 논문은 턴키공사가 가지고 있는 문제점으로 인하여 발생하게 될 클레임의 효과적인 예방을 위하여 현장에서 실제로 발생하고있는 클레임요인을 추출하고 영향도를 분석하여 그 결과를 실무에서 사용할 수 있도록 하는데 목적이 있다. 추출된 요인들에 대해서 전문가들에게 설문조사를 실시하여 턴키프로젝트에 미치는 영향도가 높은 클레임요인을 선별하고, 사례분석을 통한 클레임 금액의 조사를 실시하여 어떤 요인들이 클레임에 얼마나 영향을 미치는 지를 분석 검증하였다. Turnkey projects accounting for some $10\%$ of the total volume of the projects in the domestic market have been often implemented without the process of full-scale review or study because of clients' lack of expert and expertise. Moreover, many projects have been executed under the terms and conditions of the contact which were found to be unilaterally in favor of the clients. The study, as part of effects to mitigate the claims that would possibly be caused by the potential problems with the typical turnkey projects, were intended to identify the elements of the claims virtually being occurred at the construction sites, and then analyze the degree of influence on the project so as to be able to incorporate the outcome into the plan at the working-levels. As a result of experts' review, through the survey, of the elements once extracted, those having relatively higher degrees of influence on turnkey projects were determined, and the investigation aimed at estimating the amount of claims in terms of value were conducted to eventually identify, evaluate and verify the elements that had affected the Project together with the degree of influence.

It should also include the needs of all the members of society. Through this research, the appropriate understanding of pension and identification of its problems and improvement has come to light. This will help in ensuring that a better Real Estate culture is nurtured and adopted.<BR>  (2) REAEARCH METHOD<BR>  Reference to various records and thesis<BR>  (3) REAEARCH RESULTS<BR>  For pensions that satisfies both owners and government and develops continuously, fostering management mind of owner, creating various theme and efforts.<BR>  2. RESULTS<BR>  Still there are a number of problems. These include environmental pollution, limited support from the government, excessive supply, lack of cooperation and other problems associated with the national pension scheme.<BR>  To solve these problems, alternatives such as forming unions with foreign bodies and organizations, support enterprises, system reformation and enterprise differentiation.<BR>  It has not been long since pension scheme was introduced. Despite the current state of things, a great endeavor is required in order to attain a bright future.

        공립초등학교(公立初等學校) 리모델링의 경향분석 및 방향설정에 관한 연구

        This study analyzed the remodeling cases of 53 public primary schools located in Seoul to grasp the trends and set the direction in remodeling public primary schools. As a result of the analysis, before the sixth Education Process major remodeling of schools was focused on increasing the number of classrooms and after the sixth Education Process public space was increased. According to development of education, frequency of remodeling is increased. But myopic remodeling works were not a surprise. It means the schools simply focused on increasing space. Therefore, the study aims to set the direction for a comprehensive and systemic remodeling plan which will serve as an opportunity to not only improve physical life of schools but also extend functional life and enhance the quality of educational environment.

        고등학교 리모델링의 경향분석 및 방향설정에 관한 기초적 연구

        The study is intended to analyze the tendency of the remodeling for the high schools in Seoul, with the potential challenges thereof, determining the principle for the remodeling projects in the days to come. To that end, the analysis to identify the school facilities in a bid to accommodate the current curriculum was conducted, along with the case study on remodeling projects. The curriculum demands for a significant change in school facilities. The number of student in a class that has been on the decline, despite of steady increase in number of schools, and the population getting concentrated in Seoul and its suburbs have resulted in an increase in number of class. Consequently, more investment in the facility, rather than improving a substantial education environment, has been made. The study, thus, is aimed at identifying the facility of the high school required by the curriculum, as well as implementing a fact-finding investigation into the remodeling works far high schools in Seoul so as to come up with the guideline for remodeling projects.

        사례분석을 통한 건설클레임 비용의 효율성에 관한 연구

        근래 들어 한국에서는 건설 관련 소송이 점차적으로 증가하여, 전체 소송의 30%를 차지하고 있다. 그런데 건설 관련 소송의 판결을 위해서는 담당 재판장 이 건설공사에 대한 전문지식을 갖추고 있어야 하는데, 현실적으로 어려움이 있어 건설 관련 소송에서는 클레임 전문가에게 금액 산정을 의뢰하고 전문가의 의견을 참조하여 판결을 내리는 경우가 많으며 금액 산정 내용이 판결에 많은 영향을 미치고 있다. 본 논문은 사례 분석을 통해 건설클레임 비용과 신청인이 건설클레임을 통해 얻는 이익을 비교 후 건설클레임 비용의 효율성을 파악하여 원고나 피고가 무익한 건설클레임을 신청하지 않도록 기여하고자 한다. 근래 들어 BIM 기반 Simulation을 적용한 물량 및 공사비 산출을 위한 Prototype 진행이 검토되고 있다. 1. CONTENTS (1) RESEARCH OBJECTIVES In this paper, comparing construction claim cost and benefits from using claim contents in lawsuit, this paper would like to contribute to plaintiff or defendant’s understanding about usefulness of claim cost and preventing them from requesting for unbeneficial claim contents. (2) RESEARCH METHOD Research methods are researching literature, survey major books, research and analysis actual claim case. (3) RESEARCH FINDINGS It is also not easy to find usefulness of claim, one must consider contingent fee and claim cost to get benefits from requesting for such content. 2. RESULTS Recently in Korea, number of construction related lawsuit gradually increased that it accounts for 30% of the total number of lawsuits in Korea. To adjudicate construction related cases, it requires for the chief judge to have expertise about construction, which is hardtop find in reality. Most of time, judges adjudicate referring to construction claim by construction appraiser. Allowing such content to affect on the judgment. During lawsuit, it often develops to emotional conflict between plaintiff and defendant rather than matter of fact. To secure more evidence, applicants often rashly request for claim contents. As can see from case of Busan and Yongin, applicants requested for claim contents to have better position in the lawsuit, but they had more expense than what they got. It is also not easy to find usefulness of claim, one must consider contingent fee and claim cost to get benefits from requesting for such content.

Our purpose is to present device for value improvement of property of postal administration business headquarters of Ministry of Information and Communication. (2) RESEARCH METHOD Research was made on cases of domestic postal offices planned to be built along with cases of foreign post offices. (3) RESEARCH RESULTS Problems of domestic postal administration business were first found out.         법원의 건설 분쟁물건 감정평가 시 하도급 단가 적용에 관한 연구

        근래에 들어 국민들의 건설 관련 지식수준이 향상되고, 건설 관련 분쟁에 관한 관심이 높아지면서, 건설 관련 소송이 차지하는 비율이 점차 높아지고 있다. 대부분의 건설 관련 소송에서 건설 전문가의 감정은 필수적이다. 본 연구에서는 2016년 8월에 수행한 서울고등법원의 감정서를 조사 · 분석하였다. 건설 감정평가와 관련한 논문 및 저서에 관한 조사, 건설 감정 전문가의 의견 청취 등을 바탕으로 건설 하도급 관련 소송에서 적정 공사비 산출을 위한 하도급 단가를 결정하는 방향을 제시하여 적정 공사비를 산출할 수 있는 근거를 제시하는 것을 연구의 목적으로 한다. 향후 건설감정평가 시 활용가치가 있을 것으로 예측된다. 감정평가 결과가 중요한 증거 방법이 되어 재판 결과에 큰 영향을 미치게 된다. 실제 수행한 감정평가 사례를 조사 · 분석하여 가장 합리적인 하도급 단가를 결정하여 적정 공사비를 산출하는 기준을 제시하고자 한다.

        국공유잡종재산의 효율적 활용을 위한 관리제도의 개선방안에 관한 연구 - 서울특별시 성북구 사례를 중심으로

CONTENTS<BR>  (1) RESEARCH OBJECTIVES<BR>  The purpose of this study is to review the alternatives for efficient management of the national and public miscellaneous assets located in Seongbuk-gu, Seoul, and examine the possibility of applying such alternatives to management of the miscellaneous assets.<BR>  (2) RESEARCH METHOD<BR>  1) reviewing the concepts and management of the national and public miscellaneous assets, and 2) analyzing the conditions of the national and public miscellaneous assets in Seongbuk-gu, Seoul and addressing the problems to suggest their solution and thereby, improve the management of the miscellaneous assets.<BR>  (3) RESEARCH RESULTS<BR>  The solutions to the problems identified are suggested for efficient management of the national and public miscellaneous assets. To be more specific, the current sale policy needs to be replaced with a preservation policy ; the public land reserves should be expanded, the small parcels of land be integrated through exchanges, and the public assets should be managed in a more far-reaching and scientific way.<BR>  To be so, the national and public miscellaneous assets should be surveyed more precisely to establish a model for more revenues from the land through computerization of the relevant data.<BR>  2. RESULTS<BR>  In terms of reform measures for management system and legal system, it is required to readjust the land ownership among autonomous wards, improve the financial or compensation system and activate the trust system. Lastly, since the national and public assets should be used for people"s benefits and welfare, it is important that they should be efficiently managed, and in this regard, the relevant officials are urged to do their best for management of such assets.
