위법성조각사유의 전제사실에 관한 착오란 위법성조각사유의 객관적 전제 사실이 실제로 존재하지 아니함에도 불구하고 이를 존재한다고 오인하여 위법성조각사유에 해당하는 행위로 나아간 경우를 말하며, 정당화사정의 착오 또는 허용구성요건의 착오라고도 한다. 즉 위법성조각사유의 전제사실에 관한 착오는 ‘법 규정 자체’에는 착오가 없고, 다만 위법성조각사유의 전제가 되는 ‘사실’에 대해서 착오가 있는 경우를 의미하게 된다. 다만, 이러한 착오는 행위자의 의사가 적법하게 실현될 사태의 실현에 향해져 있다는 점에서 그리고 ‘의미의 인식’에 관한 문제가 아니라 ‘사실의 인식’에 관한 문제라는 점에서 행위자의 주관적 의사의 측면에서 보면 구조적으로 구성요건적 착오와 동일하나 그 착오의 대상이 ‘객관적 구성요건표지로서의 사실’이 아니라 ‘위법성조각사유의 요건인 사실’이라는 점에서 구성요건적 착오와 구별된다. 나아가 위법성조각사유의 전제사실에 관한 착오는 구성요건적 고의는 있고 구성요건의 위법경고기능이 작용함에도 불구하고 행위자에게 위법성의 인식이 없다는 점에서 위법성의 착오와 유사하지만 위법성조각사유의 “객관적 전제사실을 오인하여” 다시 허용되는 행위를 한다고 믿었던 ‘이중의 착오’가 있다는 점에서 위법성의 착오와 구별된다. 그런데, 우리 형법은 오스트리아 형법 제8조와 달리 위법성조각사유의 전제사실에 관한 착오에 관하여 명문의 규정을 두고 있지 아니하므로 그 해결은 학설과 판례에 맡겨져 있다고 볼 수 있고, 이런 점에서 해석에 따라 위 착오를 구성요건적 착오로 파악할 경우에는 형법 제13조를 적용하여 고의를 조각(착오에 과실이 있는 경우에는 과실범으로 처리) 시킬 수 있을 것이나 금지착오로 파악할 경우에는 형법 제16조를 적용하여 ‘그 오인에 정당한 이유가 있는 때’에 책임만이 조각되고 원칙적으로 고의범으로 처벌할 수 있을 것이다. 따라서, 형법상 인정되고 있는 구성요건적 착오와 위법성의 착오 중 이러한 착오를 어떻게 취급할 것인지 여부가 문제되고, 착오자에 대한 고의범 또는 과실범 처벌문제가 연결된다는 점에서 그 법적 해석방법 및 형법의 개선방향을 제시해 보고자 한다.

Terahertz Complex Refractive Index and Guiding of White Staghorn Coral

Corals are the remains of animals that grow on warm beaches. They have been used as decorative jewels because of their variety of colors, and as medicinal materials for treating cancers, AIDS, and other therapeutic uses because of their chemical elements. Corals are mainly composed of calcium carbonate (CaCO 3 ) and have many air pores, tens to hundreds of micrometers in size. The refractive indices and absorption coefficients of dried sliced staghorn corals are investigated using terahertz time-domain spectroscopy. The measured values are similar to those for CaCO 3 , as expected. It is observed that a sample with a microstructure formed by air pores can guide terahertz waves. The dispersion, effective index, and loss of the guiding modes of coral core surrounded by five triangular air pores are numerically calculated. The simulated spatial distribution of the electric field of the guide mode at 1.25 THz shows the mode to be tightly confined to the core.

Enhancement in Surface Property via In-Mold Coating Process

We investigated the in-mold coating process that can not only offer a superior surface quality of molded parts but also reduce environmentally harmful chemical releases compared with conventional coating processes. Polycarbonate (PC) plates were first fabricated via injection molding and then a coating layer was generated on the top of the plate in the mold cavity. The in-mold coating process was simulated numerically. To look into the effect of the coating, we prepared three different samples including pure, bar-coated, and in-mold coated PCs and analyzed their physicochemical properties. It turned out the samples prepared using the in-mold coating process had enhanced surface properties such as surface modulus, hardness and pencil hardness.

What is the morality for a hyper-connected society in the network age? This paper critically examines the "principles-based" morality required in the industrial society and the "character-based" morality developed in the ancient natural community. And in order to complement these two moralities, I propose 'personal morality', which is based on personal relations. In conclusion, I will emphasize that 'second-person standpoint morality', based on the addressing as a speech act, should be explored as an appropriate norm system for this age, where the space of communication such as SNS is expanding and deepening day by day. Furthermore, the study of the function and role of 'the second-person standpoint morality should be activated in Korean society where social conflict and hostility such as hate expression are more and more amplifying. 네트워크 시대의 초연결 사회에 적합한 도덕은 무엇인가? 본 논문은 근대 산업사회에서 요구되었던 ‘원칙을 기반으로 한’ 그리고 고대 자연공동체에서 발전했던 ‘품성을 기반으로 한’ 도덕을 비판적으로 검토한다. 그리고 이 두 도덕을 보완(補完)하는 차원에서 ‘인칭적 관계를 기반으로 한’ 도덕인 인칭도덕을 제안한다. 결론으로, ‘말걸기’ 화행에 근거한 ‘2인칭 관점의 도덕’은 SNS 등 소통의 공간이 날로 확대ㆍ심화되어 가고 있는 이 시대에 적합한 규범체계로서 탐구되어야 한다는 점을 강조하고자 한다. 더욱이, 혐오표현 등 사회적 갈등과 적의가 증폭되고 있는 한국 사회에서 ‘2인칭 관점의 도덕’의 기능과 역할에 대한 연구가 활성화되어야 한다는 점을 제안하고자 한다
