The purpose of this study is to analyze spectra utilizing shared kitchens in terms of the increase of single-person households in modern society and the sharing economy. Cases were collected through research and literature surveys, and the results of this study are as follows. It is classified into four types depending on the purpose of business platforms, government support and leisure activities and conglomerate-led activities This study is meaningful in that it presented a method of utilization according to characteristics by classifying shared kitchens. It is intended to confirm that the shared kitchen is a major space to accommodate new needs as society changes and present it as a reference to the space planning.

공유경제의 제도적 환경조성을 위한 현행법제 개선방안 - 공간공유를 중심으로 -

공유경제에 대한 규제개선방향은 사무실이나 시설 등을 타인과 공동으로 사용하는 공간공유 영역에서 가장 조화롭게 적용될 수 있다. 이 영역에서는 종래의 규제가 가지는 필요성을 더 이상 찾기 어렵게 되었기 때문이다. 가령 단독의 사무실을 설치하지 않고 하나의 사무실을 다른 사업자와 공동으로 사용하는 경우에도 특별한 사정이 없는 한 그 소재지를 명확하게 파악할 수 있으므로 사업자등록의 목적은 얼마든지 달성할 수 있다. 그 결과 현행과 같이 독립한 사무소를 설치할 것을 요구하고 있는 것은 업종에 대한 진입을 과도하게 막는 장애가 된다. 따라서 공간의 공동사용은 원칙적으로 허용되어야 하며, 사업자등록 시의 규제대상이 될 수 없다. 다만 이에 관해 야기될 수 있는 문제에 대해서는 그 운영 또는 사용주체가 책임을 부담할 수 있다. 대표적으로 주방시설의 공유는 그로부터 야기될 수 있는 위험을 제거하기 위한 책임을 사업자에게 부담시키는 것을 조건으로 허용할 수 있다. 그리고 이러한 개선방향은 사업의 자율성을 확대함은 물론 부작용의 발생가능성을 더욱 줄이는데 기여함과 동시에 공유경제의 장점을 극대화할 수 있다. 특히 이는 플랫폼을 통해 위생관리 계획의 수립과 그 수행이 더욱 체계적으로 원활하게 이루어질 수 있다는 점에서도 실제적으로 가능한 규제의 개선방안이다. 그리고 이는 현재 공간사용에 관해 요구되고 있는 대부분의 규제사항에도 적용될 수 있으며, 그 결과 과도한 규제를 합리적으로 완화할 수 있게 된다. 한편 시설 등의 공동사용에 관해 공동사용계약의 체결이 추가적인 조건으로 제시될 수 있다. 이때 공동사용계약은 사무실을 제공하는 주체와 그 사무실을 사용하고자 하는 사업자 간에 체결하는 것으로서 계약서상에 해당 사무실을 다른 사업자와 공동으로 사용한다는 취지가 명시된 계약이다. 또한 사무실을 공동으로 사용하는 각 사업자가 실제로 그 공간을 사용하는 구체적인 방법이나 기준 역시 명시되어야 한다. The regulatory improvement of the sharing economy can be most harmoniously applied in sharing of spaces such as offices. This is because the need for regulation no longer exists in this area. For example, even if one business operator does not have a single office, the purpose of business registration can be sufficiently achieved if one office is shared with others. Because the location of business can be clearly identified in this way. Therefore, requiring the establishment of an independent office results in excessively preventing entry into the business. Therefore, sharing of spaces must be permitted in principle, and cannot be regulated when registering a business. However, the operator or the user is responsible for any problems that may arise here. Typically, a shared kitchen can be allowed on condition that the operator has responsibility for eliminating the expected risks. And these regulatory improvements contribute to expanding the autonomy of business and eliminating the possibility of side effects. In addition, the advantages of the sharing economy can be maximized. In particular, the establishment and implementation of sanitation management plans can be made more systematically in platform. Thus, this is a practical solution. This approach can also contribute to ease excessive regulations that apply to most other space sharing. Meanwhile, the joint use contract for space sharing may be presented as an additional condition. This joint use contract is concluded between the office provider and the user, and in the contract, the purpose of office sharing with another business operator is specified. In addition, specific methods and standards for how to actually use the space among those who shares the office should be specified.
