As a variety of social conflicts increase in the Korean society, the alternative dispute resolution(ADR) movement has recognized the limitations of formal adjudication and has tried to employ diverse mechanisms or techniques including arbitration and mediation through which conflicts may be resolved or settled. This study compared administrative ADR systems established in the Korean government to settle diverse social disputes and conflicts. Based on the results, this study made important suggestions to improve the current ADR systems.

This paper introduces two successful conflict resolution cases with a mutual gains approach ? National Seoul (Mental) Hospital Relocation and Milyang 765kV Powerline Construction ? at which the author played the mediator role. The two cases, however, provide important implications in terms of conflict management in the central government. In the Milyang 765kV Powerlin Construction case, a creative problem-solving mechanism was found through the consensus of statkeholders involved but the Ministry of Knolwedge Economy has been inactive to the mechanism so that the conflict has been so still lingering that the residents have long been suffering. The National Seoul (Mental) Hospital Relocation conflict was very successfully resolved and has very useful implications to conflict managements. The implications, however, has not been shared even within the Ministry of Health and Welfare and throughout the other Ministries. It, thus, is very imperative for the Government to make efforts to equipt relevant infrastructure in order to participate all stakeholders with trust and try find creative mutual gains in all public conflicts.

Looking at the resolution process of public conflicts, we come to find that negotiation is frequently used as an important tool to solve them. When core interests of major stakeholders are reflected in the making of final agreement, it is observed that conflicts are resolved through successful negotiation. This study focuses on applicability of negotiation in the way of public conflict resolution. The results of analysis show that ‘interdependency among stakeholders’, ‘different preferences and claims among stakeholders’, ‘free use of tactics and strategies’, and ‘existence of possible agreement zone’ are critical elements in the successful negotiation. It is urged in this study that above 4 elements are needed to be evaluated before going to the negotiation table.
