목 적: 본 연구의 목적은 내인성 성호르몬이 자궁근종의 성장에 미치는 영향을 알아보고자 연구를 시행하였다. 연구대상 및 방법: 폐경전 자궁근종 환자 27명과 같은 연령대의 정상여성 25명을 대상으로 하였다. 모든 대상군의 여성에서 24시간 소변을 모아서 소변내 estrogen, androgen의 대사체들을 GC-MS를 이용하여 측정하였으며 두 군에서의 차이를 비교분석 하였다. 결 과: 소변내 $17{\beta}$-estradiol, 5-androstene-$3{\beta}$, $16{\beta}$, $17{\beta}$-triol, 11-keto-ethiocholanolone, $11{\beta}$-hydroxy-androsterone, THS, THA, THE, a-cortolone, a-cortol 및 $\beta$-cortol가 환자군에서 의의있게 증가하였으며 $17{\beta}$estradiol/estrone 및 $11{\beta}$-hydroxy-ethiocholanolone/$11{\beta}$-hydroxy-androsterone도 환자군에서 의의있게 증가하였다. 결 론: 자궁근종의 성장은 요중 estrogen과 androgen의 농도와 밀접한 관련이 있으며 이는 환자의 스테로이드 호르몬 대사 감소에 기인한 것으로 사료된다.

북한 사회주의헌법의 인권 실효성에 관한 연구

This Article is a attempt to understand the effectiveness of human rights in North-Korean constitution. Generally speaking, the concept of human rights is told as “the right owned by human being” and has been promoted as a legal concept in large part due to the idea that human being have “fundamental” rights. The University of human rights has strengthened its persuasion, and the idea that human rights is not in the control of states has widely been accepted. Thus in case that human rights violations span such as indiscriminate jailings and torture and the forced sterilization of women, moreover such violations are not tolerable, it is probable that international community intervene in domestic human rights abuse or international sanctions isolate several regimes because of their human rights violations. So then, Under what condition can human rights be effectively guaranteed? It is ‘The rule of Law’. Originally, the reason the rule of law is rule is due to the rule of rights. And the rule of Law is the practical means to prevent arbitrary work of state power and guarantee human rights. In other words, only the rule of Law would not be left people alone in natural conditions that the principle of power dominates. For constitution to guarantee human rights ought be based on the following three rule - the rule of clarity, the separation of powers, constitutional court-. To understand the effectiveness of human rights in North-Korean constitution, this article attempts the appliance the three rule- the rule of clarity, the separation of powers, constitutional court- to North-Korean constitution. In case of North Korean constitution, there has been the following absence of three rule. the absence of the rule of clarity, separation of powers, and constitutional court. First, the rule of clarity is the internal condition to prevent the arbitrary interpretation of states. But in case of North-Korean constitution, the concept of ‘people’, ‘the rights of people’, ‘the freedom of religion’, and ‘the freedom of labor’ etc can be variously interpreted. In case of the fundamental rights and duty, its boundary is ambiguous. Second, the rule of the separation of powers is the external condition to prevent the arbitrary interpretation of states. But because the political structure of North Korea is vertically formed, the rule of the separation of powers does not actually work. Third, constitutional court is playing its own role for the purpose of protecting human rights, supplementing other national authorities in the scope of human rights protection. But because all court of law in North Korea that plays a role of constitutional court has been under the control of Labor Party, all court of law in North Korea has recognized the command of ‘Suryong’ as the highest rule. In this point, human rights provision described in North Korean Constitution are not only nominal but also decorative constitution.

강성대국 건설, 체제전환을 위한 체제개혁의 시도인가? 체제유지를 위한 또 다른 이데올로기인가? -선군정치를 중심으로-

본 연구는 북한의 강성대국 건설이 ``체제전환``을 위한 ``체제개혁``의 시도가 아니라 체제유지를 위한 또 다른 이데올로기에 불과하다는 것을 분석하는 데 목적이 있다. 이를 위해 먼저 체제전환을 위한 필요충분조건을 고찰하였다. 체제전환을 위한 필요조건은 체제 내적인 자기반성 내지 자기성찰을 의미하는 ``체제개혁`` 즉 기존체제에 이질적 요소를 접합시키려는 의지이다. 체제전환의 충분조건은 ``기존 체제에 접합되는 이질적 요소가 얼마나 여러 다른 하위체계와 유기적으로 융합하느냐``로 제시하였다. 다음으로, 이러한 이론적 틀 속에서 북한 강성대국 건설의 통치 시스템인 선군정치가 체제유지를 위한 ``관성적 권력``의 전략적 기제임을 분석하였다. 이를 위해 선군정치에 대한 북한의 정당화 논리와 공시적 차원에서 이루어지는 선군정치의 전략적효과에 대해서 분석하였다. 전자의 분석을 통해서 선군정치의 지향점이 수령 중심적우리식 사회주의의 유지에 있음을 제시하고, 후자의 분석을 통해서 ``항시 전시체제``로서의 선군정치가 악화된 대내외적인 환경에도 불구하고 그 같은 지향점을 성취하기 위한 탁월한 전략적 방식임을 제시하였다. 마지막으로, 선군정치 하의 경제개혁조치가 ``체제 내 조정``으로서의 ``수혈적 경제개혁``이라는 점을 분석하였다. 체제전환을 위한 필요조건인 ``체제개혁``이 기존체제에 이질적 요소를 접합시키려는 의지, 즉현상적으로는 기존 체제에 접합되는 ``이질적 요소의 자율성 보장``이라고 할 때, 북한의 경제개혁을 ``이질적 요소의 자율성 보장``이라는 맥락에서 분석하였다. 특히, 내적으로 소유권 문제와 가격결정 자율성 문제, 그리고 외적으로 시장과 시장 외적인 요소와의 관계에 대해서 살펴보았다. 이러한 분석을 통해서 선군정치 하의 경제개혁조치는 북한의 사회주의 경제체제의 변화를 유도하기 위한 장기적인 프로그램의 일환이라기보다는 절박한 경제위기에 대처하기 위한 임시적인 조치로서 판명된다. This paper is to aim the analysis of ``strong and prosperous state building of North Korea`` as a ideology for ``system maintenance``. For this, first, this paper analyzes the necessary and sufficient condition for ``system transformation``. This paper suggests that the necessary condition for ``system transformation`` is ``system reform`` and the sufficient condition for ``system transformation`` is how well the heterogeneous thing conjugated at the system is suitable for other things in the system. Second, this paper presents the ``army first policy`` of North Korea as inertial power. This paper analyzes the justification-logic for the ``army first policy`` of North Korea and the strategic effect of the ``army first policy`` of North Korea. Finally, this paper presents the economic reform under the ``army first policy`` of North Korea as just a stopgap to deal with the aggravated economic crisis, rather than a permanent reform intended to bring about change on the economic system. This paper analyzes this in the context of the autonomy of the heterogeneous thing conjugated at the system.

공생과 상생에 입각한 헌법적 가치의 구성논리

Gongsaeng and Sangsaeng which describe the peaceful relation between I and others are the two important principle and thinking in legal philosophy. In political reality under value-pluralism including internal conflict, the investigation on The constructive logic of the constitutional value on the basis of Gongsaeng and Sangsaeng will be the meaningful work for durable and stable communal life. The purpose of the constitutional value on the basis of Gongsaeng is presented as the peaceful co-exsitence of value-pluralism, and its constructive method is based on the exclusion of individual’s goodness. On the other hand, The purpose of the constitutional value on the basis of Sangsaeng is presented as the overcome value-pluralism, and its constructive method is based on the ethical attitude of community members who try to seek common good.

심의민주주의의 실존적 의미

본고는 인간 실존에 대한 현상학적 이해에 기초해 있는 메를로-퐁티의 실존철학적 입장에서 심의민주주의의 양가적 측면을 분석한다. 한편으로, 화폐와 권력에 의한 가치 전도현상이 만연한 현 시대적 상황에서, 생활세계 복원을 위한 (화폐와 권력이 배제된)공적 영역 구성의 필요성을 주장하는 심의민주주의는 메를로-퐁티의 자유와 반성의 조합으로서의 프락시스가 작동하기 위한 물리적 공간을 제공한다는 점에서 의미가 있다. 다른 한편으로, ‘이상화된 생활세계’에 기초한 심의민주주의의 소통가능성 전략이 현실에 적용되었을 때, 그것의 결과는 ‘만인에게 균등하게 좋은 선’으로 귀결되기보다 다양한 정치적 입장들 간에 형성된 ‘힘의 불균형’의 노출로 표면화될 가능성이 높다. 특히, 심의민주주의의 소통가능성을 위한 이론적 재구성 전략이 배제 전략 ?첫 번째 배제는 다양한 정치적 입장들 간에 형성된 힘의 불균형성, 두 번째 배제는 각 각의 정치적 입장의 내적 구성 원리로서의 독백? 에 기초하고 있다는 점에서, (배제 전략에 기초한) 이론 구성의 실제로의 적용은 결과적으로 현실의 힘의 논리를 그대로 반영시키는 결과를 낳을 수밖에 없다. 실존철학적 입장에서 분석된 이러한 심의민주주의의 양가적 측면을 통하여, 본고는 소통의 혹은 프락시스 작동의 두 가지 구조적 장애를 요약해 본다. 첫 번째 구조적 장애는 돈과 권력에 의한 가치 전도 현상이다. 두 번째 구조적 장애는 다양한 정치적 입장들 간에 형성된 힘의 불균등성과 각 각의 정치적 입장이 가지는 내적 독백이다. This article is to analyze the duality of deliberative democracy on the basis of existential philosophy. On the one hand, deliberative democracy which asserts the neccesity of public sphere formation for life-world restitution presents material sphere for praxis. On the other hand, when the communication strategy of deliberative democracy is applied to the reality, it ends up the exposure of ‘the inequality of power’ of diverse political position. Specially, the latter is based on the output gained through the analysis on pluralism on the basis of existential philosophy. Through the analysis on the duality of deliberative democracy, this article presents the two structural obstacles for communication or praxis. First structural obstacle is the value-inversion phenomenon by money and power. Second structural obstacle is ‘the inequality of power’ formed among diverse political positions, and the internal monology of each political position.

질서와 진보의 교차적 동학으로서의 실존철학적 변증법

본 논문은 일차적으로 세계-내-존재(being in the world)로서의 인간의 필연적 세계 귀속성뿐만이 아니라 세계에로의 존재(being to the world)로서의 인간의 개방성을 강조하는 메를로 퐁티(M. Merleau-Ponty)의 실존철학적 입장에서 변증법적틀을 재구성해보는데 있다. 실존철학적 변증법은 구조에 대한 반성과 재생산의 문제를 구조의 공시적 차원?구조 그 자체의 운동성?과 통시적 차원에서 함께 다룬다. 이러한 재구성의 맥락에서 본 논문은 ‘정치적인 것’과 ‘정치적 행동’을 새롭게 다루고자 한다. 첫째, 정치적인 것의 의미를 재 고찰한다. ‘정치적인 것’은 구조의 공시적 차원과 통시적 차원의 교차지점에서 형성된다. 특히, 공시적 차원에서 이루어지는 구조의 운동성에 대한 고려는 정치공동체 구성원의 ‘정치적 삶’(political life)과 ‘정치적 입장’(political position)을 구분시킬 뿐만이 아니라, 양자의 상호관계를 명확히 한다. 둘째, 정치적 행동의 의미를 재 고찰한다. 정치적인 것에 기초하여 정치적 행동(political action)의 범위와 조건을 기술한다. 특히, 이것은 소통을 위한 공적 영역의 구성과 관계한다. This article is to aim the reformation of dialectic frame in the context of the existential philosophy of M-Maurice Ponty. The dialectic of existential philosophy considers the reflection and the reproduction of structure on synchronic dimension as well as on diachronic dimension. In such a reformation, this article renews ‘the political’ and ‘the political action’. ‘The political’ is formed at the intersection where synchronic dimension meets diachronic dimension. Specially, the idea of ‘the movement of structure at synchronic dimension’ makes ‘the political’ divided into ‘the political life’ and ‘the political position’. Besides, it makes the relationship of ‘the political life’ and ‘the political position’ clear. On the basis of the understanding and the analysis on ‘the political’, this article describes the range and conditions for ‘the political action’, which are related with the formation of public sphere for mutual understanding.

하버마스의 절차주의적 법 패러다임의 지향점과 한계점

At the present situation which instrumental and technical politics dominates, Habermas’s Proceduralist Paradigm of Law for strengthening democratic legitimacy in law is a method for restitution of political autonomy’s ethos. In context of popular sovereignty, the legitimacy and the authority in law is based on the support of people. Though this popular sovereignty theory has been historically realized through the birth of council’s system, the council sovereignty theory has forgotten political autonomy’s ethos. Thus Habermas attempts to overcome the rupture of law and politics thorough his Proceduralist Paradigm of Law. But unlike his attempt to restitute political autonomy’s ethos, the application of his Proceduralist Paradigm of Law to the real life-world is likely to produce not ‘good goodness to people’ but the domination of power. When his Proceduralist Paradigm of Law based on the equality of power among diverse positions and the openness of each position is applied to real life-world based on the inequality of power among diverse positions and the hardness of each position, the result of the application is likely to produce not the combination between justice and solidarity but the domination of power.

칼 슈미트(K. Schmitt)의 헌법구성의 토대인 ‘정치적 통일체’에 관한 연구

In the divided place between liberalism and republicanism on the relationship of politics and law, we meet K. Schmitt’s constitution. His constitution is based not on moral priority, but on the politics. In other words His constitution is founded on the political unity. In this point the idea that constitution itself is founded is not reasonable. His constitution is formed by the political judgement of sovereign. His constitution is the outcome of Sovereign’s judgement for the special being of political unity. In this point, his constitution is similar with republicanism which connects law with politics. But while republicanism is based on political optimism on commensurability, he is based on political realism on incommensurability. K. Schmitt forms the inequivalency of power and antagonism among diverse ethic life-forms which political reality shows as ‘the political’. His ‘political’ is formed not on pure or romantic motivations such as common-good and humanity, but on the dichotomy such as enemy and friend. The political unity formed in the hostile confrontment with enemy is the outcome of the war between enemy and friend. This is the essence of politics. Though this political position of K. Schmittis understanded as the violent, our history and reality have showed this. The deep investigation for our political reality gets us to realize that the war and conflict among political powers is the more daily than the consensus and harmony among them.
