본 연구의 목적은 최근 정부조직개편으로 인한 과도기적 시기에 놓여있는 한국의 지적측량제도를 재조명하고 이를 통해 향후 발전방향을 제시하는 것이다. 본 연구를 효율적으로 달성하기 위한 연구의 범위로는 시간적으로 한국지적제도의 창설부터 현재까지로 하고, 공간적으로는 한국으로 하며, 내용적으로는 한국의 지적측량제도의 실태를 분석하고 이에 따른 발전방향을 제시하는 것으로 하였다. 또한 연구방법으로는 역사적 접근방법을 사용하고, 조사방법은 문헌조사법과 인터넷조사법을 병행하여 분석방법은 기술적 분석법을 사용하였다. 본 연구는 일필지의 모든 정보를 정확히 등록․관리하는 지적에 있어서 조사와 측량은 가장 기본적이고 매우 중요한 단계이다. 특히, 지적측량은 일반측량과는 달리 지적법규에서 정하고 있는 엄격한 규정을 적용하여 국민의 소유권과 재산권 보호에 절대적인 기능을 한다. 그러나 현 정부에서는 그 기능이 유사하다는 이유로 지적측량과 일반측량을 통합 운영할 목적으로 관계법령을 정비하고 있다. 따라서 현 시점에서 무엇보다도 시급한 것은 지적측량제도의 본질을 규명하여 제도적 고유성을 입증하는 것이다. 본 연구는 지적측량제도의 본질에 바탕을 두고 일필지 본위의 토지조사를 위한 지적재조사사업이 합리적인 방향에서 이뤄질 수 있도록 발전방향을 모색함으로서 지적측량제도의 발전에 기여하고자 한다. The purpose of this research is to review Korean cadastral surveying system which is in a transition stage in accordance with current government restructuring and though this to present a future plan. This research topic is to analyze cadastral surveying system in Korea and to present its development plan and time scope is from the initiation of cadastral system in Korea until now, the space scope is Korea. In addition, research methods were both literature review and Internet search with a historical approach. The investigation and surveying is very fundamental and important stage in cadastral that records every pieces of information on a parcel of land. In particular, cadastral surveying has a significant role in protecting people’s ownership and property right by applying very strict rules prescribed in a cadastral law. But current government is consolidating related regulations for the purpose of unifying cadastral surveying and general surveying with an excuse of their similar functions. Therefore, the most urgent thing is to verify institutional uniqueness by revealing the intrinsic attribute of the cadastral surveying system. This research aims to contribute to improving cadastral surveying system by investigating development plan in order to achieve reasonable cadastral resurveying for land investigation based on a parcel of land.

森林法의 地籍申告에 關한 硏究 - 民有森林(山野) 略圖를 中心으로 -

본 연구의 목적은 민유삼림(산야) 약도를 중심으로 삼림법의 지적신고에 관해 살펴보고자 함이었다. 연구범위로써 시간적 범위는 1908년부터 현재까지로 하였고, 공간적 범위는 우리나라로 하였으며, 내용적 범위는 민유삼림(산야) 약도를 중심으로 삼림법의 지적신고에 관해 살펴보고자 하는 것으로 한정하였다. 연구방법으로 접근방법은 역사적 접근방법을 사용하였고, 조사 방법은 문헌조사법과 인터넷조사법을 병행하였으며, 분석방법은 기술적(記述的) 분석법을 사용하였다. 연구결과, 지적신고제도의 문제점으로는 첫째, 측량기술 인력이 턱없이 부족한데서 출발한 것을 알 수 있었다. 둘째, 민유임야측량에 따른 규정이 미비하였다. 셋째, 단기간 내에 측량을한 결과, 임야측량의 혼란을 야기하였다. 따라서 이상을 토대로 지적신고제도가 지적계에 미친 영향으로는 첫째, 측량교육이 주변교육(신교육)으로 들어가는 선도적인 역할을 한 것으로 나타 났다. 둘째, 지적측량의 영역구축과 측량문화의 발전에 기여한 것으로 나타났다. 셋째, 측량비를 소유자에게 부담시킨 것으로 나타났다. This study aimed to explore the cadastral notification in the Act on Forest with a focus on outline maps of the privately owned forest(fields and mountains). As for the scope of time, this study covered the period from 1908 to the present while the spacial scope had the Republic of Korea. By contents, the study set its limit to exploration of the cadastral notification in the Act of Forest with a focus on outline maps of the privately owned forest(mountains and fields). Literature review and internet research were conducted as for research methods while historical approach was applied. As for the analytic methodology, descriptive analysis was conducted. The results revealed problems with the cadastral notification system, which stemmed from extremely insufficient workforce in surveying techniques. Second, the laws and regulations on measurement of the privately owned fields and mountains were insufficient. Third, surveying took place in a very short period of time, which confused measurement of fields and mountains. As for impacts of the cadastral notification system on the cadastral system based on these, first, surveying education was found to have a leading role to enter into the surrounding education. Second, it contributed to construction of the areas in cadastral surveying and development of surveying culture. Third, it was found that surveying payment was imposed on owners.

본 연구는 이웃나라 일본의 국유지 관리 실태를 조사ㆍ분석하여 그에 따른 제반 사항을 평가해 봄으로써 우리나라 국유지 관리에 시사될 수 있는 내용을 도출하는 데 목적이 있다. 이상과 같은 연구의 목적을 효율적으로 달성하기 위해, 연구의 대상을 일본 국유재산관리로 한정하였고, 그 범위로서 시간적 범위는 일본의 국유재산법이 제정된 1948년부터 현재까지를 기준으로, 공간적 범위는 일본으로, 내용적 범위는 일본의 국유지 재산관리로 설정하였다. 연구방법으로는 법률적 접근방법을 사용하고 조사방법은 문헌조사법, 사례조사법, 인터넷조사법 을 병행하며, 연구내용의 분석 방법은 기술적(記述的)분석방법을 사용하였다. 연구결과, 일본의 국유지 재산관리에 있어서는 첫째, 국유지 무단점유로 인한 관계기관의 관리상 어려움이 산재되어 있다는 점, 둘째, 국유지 시효취득에 대한 점유자와 국가 간의 의견 격차로 소송이 빈번히 일어나고 있다는 점, 셋째, 지자체별로 각각의 국유지관리시스템을 운용함으로써 관리기준의 모호성 및 그에 따른 예산 낭비가 심화되고 있다는 점 등의 문제점이 대두 되고 있는 것으로 평가되었다. The purpose of this study is to review the Japanese national property management system and to receive the suggestions from it. To achieve the purpose of study effectively, we limited the object of study to Japanese national property management system. The scope of time was from 1948 up to present. And also, the range of contents was concretely focused on the main issues, occurred in the management system. With regard to the methodology of study, we firstly investigated legal principles of issues by annotating the national property management system in Japan. Then, we described the core of a topic for discussion in details. This study could find the decisive reason why Japanese system has not been efficient. And also it will be the key to the Korean system. Therefore, this study presented the ways how to establish alternative plan in order to resolve many problems from it.
