        Focussed this paper lies introducing facilities for space structure, enabling us to do balanced regional development, differential development of facilities and development of comfortable facilities by realizing development of facilities with consideration of the type of existing development plan. After all, researcher can say that this paper is the result of research and analysis verifying that facilities to accommodate gradually increasing marine tourists properly are keenly necessary. Finally, this paper suggests that it will be necessary to systematically enforce development as centers for leisure/sports, rest/amusement, natural view sightseeing, education of marine culture or experience of ecological environment.

        The research findings suggest that first, the archeological value of the roads turns out to be high enough to become tourist ones regardless of limited accessibility to the surrounding archeological remains; second, their cultural value would be maximized in association with various local, cultural events that have recently burgeoned; third, the historical value is deeply associated with people`s affective responses such as willingness-to-visit; fourth, their natural values are high enough to be used as tourist ones; fifth, sorting the roads by their recreational values, the result is very similar with that of KRTA; and sixth, and last, the balanced application of modern design and recent construction methods is believed to appeal to the users in the aesthetical aspect.

        개인정보유출에 대한 구제방안으로서의 징벌적 손해배상

        While a large-scale leakage of information ensues, the court approves just hundreds of thousands of won. the reason is lawsuit structure in Korea. It is very difficult each individual proves negligence or malice, if he or she wanna receive indemnification for damage, due to characteristic of information. Even though obligation to prove is diverted from person to business operator, The judge rules mostly against the plaintiff due to the fact that business operator doesn't have negligence or malice. ultimately actual damage exists but man couldn't be paid indemnification for that. That causes that measure of the relief system about the damage to information is imposed a blockade. In this situation, counterplans that are prepared by government break decisively with damage relief for nation. most measures that avert information leakage go along on the direction to punishing more severely via penalty, fine. but if it consider that the attributed subject of penalty surcharge is state, that is be absent from compensation for the damage of people. therefore these measure means just for securing source of taxation. To solve that should introduce the system that is punitive damages. 2014년 초 금융사의 개인정보유출사태에서 볼 수 있듯이 대규모의 개인정보의 유출은 지속적으로 발생하고 있는 반면에, 이에 대한 법원의 손해배상액은 수십만원에 불과하여 피해자에 대한 적절한 구제수단으로서의 기능은 해오지 못했다. 이러한 원인은 우리 법제가 가지고 있는 근본적인 소송구조 때문이다. 개인정보의 특성상 손해배상을 받기 위해서 는 개인정보유출에 따른 피해에 대한 입증과 사업자의 고의·과실을 입증하여야 하는데 이는 현실적으로 매우 어려운 상황이다. 비록 개인정보보호법상 사업자의 고의·과실은 입증책임이 전환되어 있다고는 하나 법원의 상당수의 판결은 사업자의 고의·과실이 없음을 근거로 원고패소의 결과가 주를 이루고 있다. 이러한 상황에서 개인정보유출을 방지하기 위 해 정부에서 내놓은 대책들은 과징금·과태료 금액을 상향하여 처벌수위를 강화하는 방향으로 진행될 뿐, 국민의 피해구제와는 그 궤를 달리하는 것으로 보인다. 생각건대, 과징금은 그 귀속주체가 오로지 국가라는 점을 감안한다면 국민이 받고 있는 피해보상과는 전혀 무관하며, 이러한 방안은 결국 세원의 확대 말고는 국민의 권리구제 방안으로써의 그 의미 는 찾을 수 없다. 이러한 문제점을 해결하기 위해 최근 ‘개인정보대량유출사태’를 계기로 국회에서 징벌적 손해배상, 배상명령, 법정손해배상제도 도입 등을 주요내용으로 하는 2개의「개인정보보호법」개정안이 발의된 것은 매우 다행스런 일이다. 한편, 징벌적 손해배상의 도입과 관련하여 일률적인 3배 배상의 적용은 징벌적 손해배상제도의 기능을 형해화 시킬 수 있으므로 이에 대한 합리적인 배상 규정을 마련하는 것도 징벌적 손해배상제도의 근본 취지를 살릴 수 있는 방안이 될 것이다.

        국내 진출 위탁경영호텔에 관한 연구

        The purpose of this paper is to suggest appropriate strategies for effective hotel management contract. As a methodology of this study, hotel management contract proposals are reviewed; and contract conditions and reports are analysed. Major findings and suggestions are as follows: ① Communications with mother company should be frequently conducted for the operation planning, suggestible facilities, royalty structure, etc. ② Mutual communications for each content area should be discussed. ③ The starting point of management contract should be focused during the on going management contract period. ④ Preparations of opening, cost of chain system, advertising and public relation costs, purchasing commission should be deeply manipulated between the two parties of mother company and chain company.

        부동산 Portfolio 에 따른 호텔 REITs 도입 모델의 적용에 관한 연구

        In this paper, we have proved that REITs will create sufficient managerial profit with a feasibility analysis of a virtual hotel. However, how to reserve the necessary capital is a problem. We have studied that we can ensure competitiveness and profit by using REITs. What we are suggesting here are 1. managment incentive and room occupancy rate is high in first class hotels in Korea; 2. management of a new first class hotel is very marketable; 3. the safest investment type of Hotel REITs is hotel industry; 4. we need to study and implement a Korean style of chain management system, since Hotel REITs is in its early stage; 5. for a quick return to investors, it is preferable to invest into the existing hotels rather than new hotel development; 6. we need to develop proper operation and management systems suitable to the domestic environment. The limitations of this research are 1. since Hotel REITs is still a new concept and field, case study is done with American hotels; 2. it is hard to apply the concept of Hotel REITs to domestic hotels since the hotel industry in Korea is still growing. The existing first class hotels are operated through chain contracts; 3. there are no pure domestic chain hotels. International chain hotels create reasonable operation revenue currently, however it has limitations with a lack of know-how in hotel development, capital, and marketing.
