The legislation related to the economy has taken priority over all other things, since the period of the reform and the open in china began. China is provided with all kinds of law and system in order to seek for his development by the market economy.<BR> These facts imply the reform and the change generally in his traditional way of thinking and the social framework as revolutionary changes in an economic structure. It is necessary for China to provide a reasonable law and system for accommodating lots of changes. A civil law is important to China for achieving his purpose and moreover, the law of jus in rem is most important in a civil law. As reason is that social life on the whole is affected by a civil law as a general law. The legislation of a civil law is progressed by comprehensively integrating the contents of a civil law after enacting it separately as an independent volume. Especially, a draft of civil law of china promulgated on July 8, 2005 has accommodated elements of both the continental law and the common law at a time, including them of socialism, the traditional law of china. It is criticized that a reformed civil law is not fully overcome limitations in the law of the socialist state. The contents of a civil law are not fully provided for. Thus, It is necessary for China to take complementary measures. Where the law of jus in rem reformed is established, an idea and an ideology of the socialist system shall be combined with actual conditions of the market economy. It is certain that the law of jus in rem can be material means for china to grow and develop in a national economy rapidly.

The social cost caused by the medical disputes has been increasing to be sufficiently high to danger the reasonable operation of the Korean medical system. The defensive medicine is one of the principal factors increasing the medical cost in Korea. It resulted in the defensive medicine that many patients or their families averted their eyes from the court in case of the medical accidents. They incline to believe that the medical litigation system is so much in favor of the medical doctors or hospitals, that the system is meaningless to their damage.<BR> Therefore the fair system of the medical litigation is necessary for the control of the social cost referred to above. The core problem is the distribution of burden of proof of the medical fault and cause in fact. Many countries" courts including Korean Supreme Court tend to alleviate the patients" burden of proof. The Chinese Supreme Court, however, regulated the shift of the burden of proof from the plaintiffs to the defendants.<BR> This paper aims at the analysis of the Korean medical litigation system, especially of the distribution of the burden of proof of the medical fault and cause in fact. It is the comparison of the distribution of the burden of the proof between in Korea and in China that this paper chose as a approach for carrying out the analysis.<BR> The determination to introduce the medical litigation system shifting the burden of proof of medical fault and cause in fact in the medical accidents needs another arguments many issues including the medical liability insurance, compensation of the damage caused by the medical accidents without fault, and the criminal privilege of the medical doctors. It should be noted that the reasonable solution system of medical dispute does not save only the social cost but also the individual cost of the parties involved in or related with the medical accidents.
생물전기화학반응조에서 저급석탄의 메탄전환에 대한 정전기장의 영향

석탄은 지구상에 비교적 고르게 분포되어 있으며, 매장량이 풍부한 천연에너지원중의 하나이다. 그러나 미세먼지가 큰 환경이슈로 부각되고 있는 최근 석탄을에너지원으로 이용하고 있는 각종 산업에서는 석탄을 대체할 수 있는청정에너지원에 대한 관심이 급증하고 있다. 한편, 지하에 매장된 석탄층에는석탄의 열화학적/생물학적 전환 기작에 의해 CBM (coal-bed methane)이라 불리는메탄이 생성되고 있다. 따라서, 지금까지 CBM을 추출하여 활용하기 위한 연구들이진행되어 왔으나 매우 느리게 진행되는 CBM의 생성속도로 인해 상업적으로이용하는데 한계가 있었다. 최근에는 석탄을 혐기성반응조에서 메탄으로전환시키기 위한 연구들이 진행되고 있다. 생물학적인 석탄의 메탄전환과정은연속적인 가수분해, 산생성 및 메탄생성반응에 의해 이루어진다. 그러나 석탄에함유된 유기물 성분들은 탄화과정이 진행 중인 리그닌 등의 소수성 고형물질이다. 따라서 석탄에 함유된 유기물의 가수분해에 의해 생성되는 중간생성물들은 주로생물학적으로 분해하기 어려운 난분해성 방향족 화합물들이다. 이러한중간생성물질들은 혐기성미생물에 독성이 있어 지금까지 생물학적으로 생성 가능한메탄의 수율은 매우 낮았다. 그러나 최근 생물전기화학기술을 이용하여이종간직접전자전달을 촉진시킴으로서 석탄의 메탄수율을 향상시킬 수 있다는결과들이 발표되고 있다. 본 연구에서는 생물전기화학반응조에서 정전기장의세기가 석탄의 메탄전환율에 미치는 영향을 조사하였다.
