우리나라는 외환을 매개로 하는 국제거래의 자유화를 증진시키기 위해 외환거래의 규제방식을 positive 방식에서 negative 방식으로 변경하였다. 이는 1998년 외환 위기로 촉발되었다. 과거의 외환 규제는 외환 당국의 허가가 없으면 원칙적으로 외환거래를 금지하는 방식을 취했기 때문에, 국가 외환 위기가 발생한 이후에 정책을 변경하였다는 것은 이와 같은 규제당국의 강력한 규제방식이 외환의 건전한 균형 관리에 제대로 기능하지 않았다는 반성으로 이해할 수 있다. 그러나, 현재도 외환 거래를 하기 위해 거주자가 외환 당국의 사전 승인을 받도록 하는 규제 방식은 잔존하고 있다. 그 일례가 ‘기타 자본거래’에 대한 규정이다. 외국환거래규정은 상위법인 외국환거래법 및 그 시행령에서 외환 당국으로의 예외적으로 신고가 필요한 자본 거래를 정하는 것과 관련하여 폭넓게 위임받았으며, ‘기타 자본거래’ 조항 내에 여러 가지 신고 대상 자본거래를 열거하면서 “기타 이와 유사한 계약”이라는 표현을 사용하고 있다. 본 조항에서 규정한 “기타 이와 유사한 계약”은 거래 시 외환당국에 신고를 필요로 한다. 즉, 외환 당국은 명시적으로 열거하지 않은 법률행위라고 하더라도 규제의 필요가 있다고 판단하는 경우 규제를 할 수 있는 근거로 본 조항을 활용할 수 있는 것이다. 이는 외환 거래 자유화라는 정책에 반하는 규제 방식이며 특히 외환 관련 규제의 위반 시 그 제재가 엄중하다는 측면에서 문제가 있다. 이를 해결하기 위해서 우선 대상 외환 거래가 규제에 명시된 자본거래에 해당하지 않는 경우, 필요한 범위를 초과하는 규제로 인하여 외환 거래 및 건전한 경제 환경의 조성을 방해하지 않기 위해 외환 당국이 해당 거래가 신고대상 외환 거래인가를 판단 시 외환 거래 규제 취지 및 그 목적에 맞는 합리적인 기준을 적용해야 할 것이다. 장기적로는 ‘기타 자본거래’ 관련 조항(7-44~7-46)은 불명확한 부분을 포함하지 않도록 명확하게 개정할 필요가 있다. 또한, 거래 주체들의 외환 거래의 모니터링에의 자발적인 참여인 신고를 독려하기 위해서는 형사 처벌과 같은 엄중한 제재 방식이 이상적이지 않다는 점을 감안하여 규제 위반의 제재 방식의 변경도 고려되어야 할 것이다. The Korean regulation on foreign exchange have changed from the positive system to negative system in order to nultur on the free trade involving foreign currency. This change was triggered by the foreign currency crisis in 1998. Previously, dconcept of generally not permitting foreign exchange involving trade unless allowed by the authorities. Thus, the change in policy after the national bankruptcy crisis signifies that previous strong regulatory approach was not functioning to balance sound foreign exchange trade. Even now, however, remains this regulatory approach of requiring a domestic person to obtain prior approval from the foreign exchange authorities. One of this example is the regulation on “other capital transactions”. This specific clause on the Foreign Exchange Transaction Regulation, which is overly delegated of scoping the “capital transactions that require report to the authority” by the law, uses expression that “any other transactions that is similar to” the listed capital transactions. And such “other capital transactions” which is decided to be “similar to” the “capital transactions” are required to be reported to foreign exchange authorities. This opens gate to the authority to regulate transactions that is not explicitly specified in the clause when necessary. This is against the policy of promoting free trade especially as the consequence of the violation of foreign exchange law is very severe. To avoid unnecessary blocking of the trade and nurture the sound economic environment, the regulatory authorities should use standard of reasonableness when deciding any certain trade requires foreign exchange trade reporting if it does not exactly fit in the regulation remembering the regulatory purpose of foreign exchange. Also, in the long term the Articles on the other capital transactions (7-44~7-46) should be revised not to contain ambiguous terms. Also, given that harsh disciplines would not be ideal to meet up the purpose of the foreign exchange policy adopting schemes to solicit market players to participate in the monitoring activities should be considered.

소유래 성분 원재료 사용 생물의약품과 의료기기 제조 공정에서 bovine adenovirus type 1 정량 검출을 위한 TaqMan probe real-time PCR

소의 혈액, 세포, 조직, 기관 등이 생물의약품, 조직공학제제, 세포치료제, 의료기기의 원재료로 널리 사용되고 있다. 소유래 성분 원재료에 다양한 바이러스가 오염된 사례가 있기 때문에 소유래 물질을 원재료로 사용한 제제의 바이러스 안전성 검증이 필수적으로 요구된다. Bovine adenovirus type 1(BAdV-1)은 소에게 가장 흔하게 감염되는 바이러스 중의 하나이다. 소유래 물질을 원재료로 하는 생물의약품, 조직공학제제, 세포치료제, 의료기기 등에서 BAdV-1 안전성을 확보하기 위해, 세포주, 원재료, 제조공정, 완제품에서 BAdV-1을 정량적으로 검출하고, 제조공정에서 BAdV-1 제거 검증을 위한 시험법으로 활용이 가능한 TaqMan probe real-time PCR 시험법을 확립하였다. 세포배양법에 의한 감염역가와 비교한 결과, real-time PCR 검출한계는 $7.44{\times}10^1\;TCID_{50}/ml$이었다. 확립 된 시험법의 신뢰성(reliability)을 보증하기 위해 시험법 검증을 실시한 결과, 특이성(specificity)과 재현성(reproducibility), 완건성(robustness)이 우수함을 확인하였다. 확립된 real-time PCR을 생물의약품 제조공정 검증에 적용할 수 있는지 확인한 결과, 인위적으로 BAdV-1을 오염시킨 Chinese Hamster Ovary(CHO) 세포주에서 BAdV-1를 정량적으로 검출할 수 있었다. 확립된 시험법을 항체의약품 생산용 CHO 마스터 세포주와 소유래 type 1 collagen에서 BAdV-1 검출 시험에 산업적으로 적용하였다. 위와 같은 결과에서 확립된 BAdV-1 real-time PCR 시험법은 감염역가 시험법과 같은 생물학적 시험법을 대신할 수 있는 신속하고, 특이성과 민감성이 우수한 시험법임을 확인하였다. Biologics and medical devices manufactured with bovine-derived raw materials have the risk of viral contamination. Therefore, viral validation study is essential to ensure the safety of the products. Bovine adenovirus type-1 (BAdV-1) is one of the common bovine viral pathogens. For quantitative detection of BAdV-1 during the manufacture of biologics and medical devices, a TaqMan probe real-time PCR method was developed. Specific primers and TaqMan probe for amplifying and detecting BAdV-1 DNA were designed. Specificity, limit of detection (LOD), and robustness of the method was validated according to international guideline on the validation of nucleic acid amplification tests for the pathogen detection. The sensitivity of the assay was found to be $7.44{\times}10^1\;TCID_{50}/ml$. The real-time PCR method was reproducible, very specific to BAdV-1, and robust. Moreover, the method was successfully applied to the validation of Chinese Hamster Ovary (CHO)-K1 cells artificially infected with BAdV-1, a commercial CHO master bank, and bovine type 1 collagen. The overall results indicate that this rapid, specific, sensitive, and robust assay can be reliably used for quantitative detection of BAdV-1 contamination during the manufacture of biologics and medical devices using bovine-derived raw materials.
