This study investigates the optical characteristics of InGaN multiple quantum wells(MQWs) light emitting diodes(LEDs) on planar sapphire substrates(PSSs), nano-sized PSS(NPSS) and micro-sized PSS(MPSS). We obtain the results as the patterning size of the sapphire substrates approach the nanometer scale: The light from the back side of the device increases and the total light extraction becomes larger than the MPSS- and planar-LEDs. The experiment is conducted by Monte Carlo ray-tracing, which is regarded as one of the most suitable ways to simulate light propagation in LEDs. The results show fine consistency between simulation and measurement of the samples with different sized patterned substrates. Notably, light from the back side becomes larger in the NPSS LEDs. We strongly propose that the increase in the light intensity of NPSS LEDs is due to an abnormal optical distribution, which indicates an increase of extraction probability through NPSS.

지역사회로부터 경찰에 대한 요구와 수요가 보다 다양해짐에 따라, 각각의 수요에 적합한 경찰기능이 요구되고 있으며, 이러한 개별적 수요에 경찰이 대응할 수 있어야 한다. 이를 위해서는 지역사회에 대한 조사와 분석을 통해 지역사회의 요구와 필요가 무엇인지를 파악하여야 한다. 즉, 직접적이고 체계적인 방법으로 주민의 요구와 의사를 파악할 수 있는 방법을 선택하여 지역사회의 치안수요를 파악하는 것이 필요하다. 본 연구에서는 지역사회의 치안수요 결정에 영향을 미치는 요인들을 밝혀내는데 연구의 목적을 두고, 경상북도 경주시 주민 385명을 대상으로 한 설문조사를 실시하여 그 결과를 분석하였다. 실증적 조사결과는 다음과 같이 요약할 수 있다. 지역치안활동에 대한 평가에 있어서 각 집단간에 유의미한 차이가 나타났다. 인과관계 분석에 있어서, 자율방범활동에의 참여도에 영향을 미치는 요인은 자율방범활동의 효과성, 경찰관의 업무태도, 경찰활동의 신뢰성, 범죄 안전성 등이고 치안서비스에 대한 만족도에 영향을 주는 요인은 경찰관의 업무태도, 경찰활동의 신뢰성, 범죄 안전성, 자율방범활동의 효과성 등이며, 범죄 대처와 적극성에 영향을 주는 요인은 경찰활동의 신뢰성, 범죄 피해, 자율방범활동의 효과성, 경찰관의 업무태도 등이다. 경찰의 업무태도, 경찰활동의 신뢰성 및 자율방범활동의 효과성 등 종속변수에 긍정적인 영향을 미치는 중요한 요인들을 보다 바람직한 방향으로 변화·개선시키기 위해서는 무엇보다도 경찰과 지역사회간의 상호작용 및 협력이 필요하다. 이를 위해서는 지역사회의 범죄예방 및 문제 해결을 위한 경찰과 지역사회간의 협력체계 형성과 문제해결능력의 신장을 핵심 내용으로 하는 지역사회경찰활동을 도입하는 것이 바람직하다. 그러기 위해서는 먼저 경찰권의 분권화와 자치경찰제의 도입이 이루어져야 할 것이다.

조직내의 하급자가 상급자에 대하여 정보를 누락시키거나 허위보고를 하는 경우, 그 영향은 매우 심각할 수 있다. 하지만 조직계층간의 情報傳達의 경우 정보의 非對稱性(asymmetric information)으로 인해 항상 정보의 왜곡 및 조작의 위험성이 존재한다. 이러한 조직내의 허위보고를 방지하고 眞率한 정보전달을 유도하기 위한 相對的 比重原則 (relative weight rule) 이 개발되었다. 하지만 수학적으로 증명된 추상적인 원칙이 과연 복잡 다기한 실제 정보전달과 집적과정에 적용될 수 있는 지는 의문스럽다. 이 연구는 정보조작방지를 위한 상대적 비중원칙의 실제 적용가능성을 검토하기 위하여, 한국전쟁 당시 중공군 개입여부에 대한 미국 트루만대통령과 맥아더 UN군사령관간의 정보전달 사례 분석한 것이다. 실제 정보전달과 모의실험을 이용한 상대적 비중원칙의 적응결과를 분석 비교한 것으로, 상대적 비중원칙을 적용할 경우 진솔한 정보전달을 효과적으로 보장할 수 있다는 적용가능성을 보여주고 있다.

다단계판매의 규제와 소비자보호방안

제조업자로부터 만들어진 상품은 일반적으로 중간도매상 그리고 소매상으로부터 여러경로를 거쳐 최종 소비자에게 전달되고 있다. 이러한 여러 유통과정 속에서 발생하는 많은 유통경비와 광고료 등은 상품에 부가되는 것이므로 결과적으로는 소비자가 부담하게 된다. 따라서 유통비용을 줄이고 그 이익을 소비자에게 환원시키는 무점포 또는 점포 외의 공간을 전제로 하는 새로운 판매방식인 다단계판매가 등장하게 되었다. 다단계 판매는 “방문판매등에 관한 법률”에서 규율하고 있지만, 우리 현실에 맞지 않는 규정들로 인해 아직까지도 그 피해는 끊이지 않고 있고, 대다수의 사람들로부터 부정적인 반응이 나타나고 있다. 따라서 미등록 불법다단계판매업체에 대한 엄중한 법집행과 관련제도의 정비를 통해 시장질서를 바로잡고, 소비자 피해 발생을 근본적으로 방지하여야 할 필요가 있다. 이 연구에서는 우리나라의 실정에 맞는 다단계판매가 이루어지기 위해 현행 방문판매법을 중심으로 검토하면서 소비자를 보호하기 위한 발전적인 방안을 제시하고자 한다. 향후 정부기관, 소비자단체, 학계 등과 협력?강화가 지속적으로 이루어져 나가기를 바란다. 금융실명제하에서 비실명 예금거래의 효력

예금계약도 계약의 한 유형이므로 당사자가 직접 체결하는 것뿐만 아니라 대리나 제3자를 위한 계약도 허용된다. 그러나 금융기관과 거래를 함에 있어서는 가명이나 차명에 의하지 않는 본인의 실지 명의에 의하여야 한다는 금융실명제가 시행된 이후에는 타인 명의의 예금계약의 효력은 어떠한가가 문제된다. 특히 우리나라는 비실명 금융거래로 인한 정상적인 자금흐름의 왜곡, 부동산 투기, 재산도피의 수단 등으로 이용되는 사회적 부작용이 노출되었다. 그 부작용을 방지하기 위해 1993년 「금융실명거래및비밀보장에관한긴급재정경제명령」에 의하여 금융실명제가 실시되었고, 1997년 법률로 대체되었다. 그러나 금융실명제의 실시에도 불구하고 다른 사람의 명의를 빌리거나 혹은 타인 명의를 도용하여 예금을 개설하는 경우가 아직도 행해지고 있다. 금융실명법은 금융실명제의 확립을 위해 실지명의에 의한 예금거래와 그에 대한 규제방안을 담고 있지만, 실지명의에 의하지 아니한 예금계약의 사법상의 효력 및 타인 명의의 예금계약을 법률적으로 어떻게 취급할 것인가는 채권자들의 채권확보와 그 방법에 있어서 중요한 문제이다. 동 법률은 금융실명제의 입법목적을 달성하기 위하여 실지명의에 의한 예금거래와 그에 대한 규제 방안을 담고 있지만, 그 입법취지의 목적을 담보할 수 있는가, 그리고 실지명의에 의하지 아니한 예금계약에 대한 사법상의 효력은 어떠한가라는 의문이 제기되고 있다. 이러한 의문점을 해결하기 위하여 예금계약의 성립시기, 예금주의 확정등과 비실명 예금계약의 효력문제에 대한 입장을 구체적으로 밝힘으로써 예금계약의 해석에 대한 체계적 기준을 제시하고자 한다. However, the real-name financial transaction system implemented several legal issues have been raised since. As the principal, depositors, deposits is the effect of the contract. Court decisions, prior to the enactment of Act Real Name Financial Transactions, placed weight on the transactions in realitly where the name of bank account-holder had no significant meaning between parties to the bank account contract, and ruled that a fund provider should be treated as the contracting party who had a claim for the money from the account against the bank. As a result, the fund provider usually opened his/her bank accounts or borrowed name and exercised his/her right as the account-holder, there by causing such problem as generating lots of false or borrowed accounts for illegitimate purposes tax evasion and concealment of slush fund.
