20세기 후반에, 더 정확히는 2000년 6월에, 거의 모든 인간게놈의 염기서열이 완성된 사실이 공표되었다. 하지만 이 소식은 환영의 대상이자 동시에 근심의 대상이기도 했다. 환영을 했던 이유는, 이 완성을 통해서, 게놈연구의 다양한 응용, 특히 의료분야에 응용함으로써 개인뿐만 아니라 인류 전체를 위한 보다 나은 복지를 향해 새로운 길이 열리고 있기 때문이다. 맞춤형태의 의료가 우리에게 다가오고 있다. 하지만, 왜 근심인가? 그 완성의 추진세력 중의 하나가 "셀레라게놈학 "(Celera Genemics)이라고 불리는 사기업이다. 게놈정보가 지적소유권이라는 명분 하에 제약회사들의 손아귀에 놓여지고 그 결과, 인류에게 찬란한 희망을 가져다 줄 모든 유전정보를 사기업이 독점하게 될 것인지 여부를 세계가 묻고 있다. 새로운 지식을 발명한 사람이 일정한 기간동안 일정한 특권을 누리고 이후에는 사회와 그것을 공유하도록 하는 법적 수단이 지적소유권체계인 것은 사실이다. 그러한 특권은 "발명자"로서의 영예와 발명자가 들인 실제 재정적 공로에 대한 보상으로 주어진다. 특허권체계에 의해서 혁신을 보호하는 것은 과학적 연구와 산업발전을 촉진하고 장려하는데 중요한 요소이다. 하지만, 특허권의 대상이 인체의 DNA이자 인간생명의 청사진을 가리키는 인간게놈이라는 점이 근심스럽다. 따라서 우리는 근본적인 질문에 봉착한다. 지적소유권이 인간게놈에게도 적용되는가? 이 강연에서는 위와 같은 의문을 세 분야로 나누어서 검토한다. 첫째, 지적소유권의 개념, 그리고 생물체의 지적소유권에 대한 여러 국가들의 현행 법제 및 역사적 발전과정의 제시를 통하여 지적소유권에 대한 일반적 검토를 한다. 둘째, 인간게놈의 특허화에 대한 윤리적 고려들을 분석하며, 여기에는 그 주제의 남북적(南北的) 측면(North-South)과 '인간게놈 및 인권에 대한 국제선언' 상의 해당 조항에 드러나 있는 UNESCO 국제생명윤리위원회(IBC)의 입장이 포함된다. 마지막으로, 이 주제에 관해서 IBC의 실무위원회가 제시한 기본적 요소들을 검토할 것이다. At the end of the 20^(th) century, more precisely in June 2000, it was publicly announced that all most all the sequences of the human genome was accomplished. However, this news was at the same time the object of welcome and that of anxiety. Welcome, because with this accomplishment, a new road is now opening towards a better welfare of the whole human being as well as that of each individual through the various applications of genomic research, in medical fields in particular. A tailor-made fashion medicine is approaching to us. But, anxiety. Why? For one of the driving force of this accomplishment was done by a private enterprise, named "Celera Genomics". The world is asking whether the genomic data will be in the hands of medico-pharmaceutical enterprises by means of intellectual property, and thus all the genetic data which should bring the humanity a wonderful hope will be monopolized by private enterprises. It is true that the intellectual property system represents a legal means of appropriating new knowledge to the benefit of identified persons who, in turn, shared it with society but upon condition that, for a specified time, they would enjoy particular privileged rights. Such a privilege is given for honour as "inventor" and for compensation of real and financial efforts of the inventor. To protect the innovation by patent system is an important element for the promotion and encouragement of scientific research and industrial development. However, in our concern, the subject of the patent is the human genome, which is DNA of the human body and represents a blue print of human life. So arises the fundamental question for us: Is the concept of intellectual property applicable to the human genome? In this lecture, we will examine this question through three parts. First a general survey of intellectual, property will be taken in presenting successively the conception of the intellectual property and the historical developments of the intellectual property rights on living organisms, as well as current legislations in different countries. Secondly, we will analyze ethical considerations of patenting of the human genome including the North-South aspect of the issue and the position taken by the International Bioethics Committee(IBC) of the UNESCO through relevant articles of the Universal Declaration on the Human Genome and Human rights. Finally, we will consider basic elements to be taken into account which are presented by the Working Group of the IBC on this issue.
