        The Effects of Development Strategies Used by Teacher Trainers at an In-service Teacher Training Program*

        The purpose of this study is to investigate the effects of the development strategy used by the teacher trainers at a teacher training program in a metropolitan area in Korea for six years from 2003 to 2008. The study assumed that an in-service teacher training program could be successful if teacher trainers were actively involved in the in-service training program by using a development strategy from the planning stage to the end of the program. Six hundred and ten elementary and secondary school teachers participated in the in-service teacher training program thirty hours a week, each year, over six years. Data were gathered through a questionnaire survey and personal interviews. For the first two years the in-service teacher training program were administrated with emphasis on a top-down approach with a competency or knowledge-based program. On the other hand, the programs, in the following four years, were administrated with emphasis on a bottom-up approach with a traineecentered or client-centered program by the teacher trainers. The data were assessed to establish whether there was a significant effect stemming from the level of teacher trainers’ participation that accompanied the treatment. The results indicated that the teacher trainer’s development strategy had the positive effects on the in-service teacher training program. The study implied that teacher trainers needed to be more aware of the educational process of the trainees and to get involved with the in-service teacher training program more actively.

        Teachers’ Perspectives on Content-based Instruction in English at a Higher Education in Korea

        The purpose of this study is to investigate teachers’ perspectives on content-based instruction (CBI) in English at a higher education in Korea. Based on the assumption that content-based instruction programs could be successful if teachers were actively involved not only in transmitting the content knowledge but also in students’ development in the second or foreign language competence, the study explores teachers’ treatments of language in relation to the students’ language development in CBI classes. Research questions were related to five areas such as (1) the goals of CBI programs, (2) difficulties in CBI classes, (3) the use of native language, (4) teaching strategies and techniques, and (5) factors that affect the success of the CBI programs. Data gathered from 24 college instructors from a large university located in the metropolitan city of Korea. Results of the study indicated that college instructors of CBI programs had keen interest in developing students’ language competence, experienced difficulties in designing course syllabus for mixed leveled group of students, rarely used Korean in class and used successful teaching strategies. Also factors needed to improve the CBI programs were recommended at the end of the study. Results of the study implied that teachers needed to be more aware of the students’ learning process of English and to be more communicative with students in English in class. Further studies were needed in relation to the CBI courses for students of different age levels.

        Study Abroad Experiences for Korean EFL Student Teachers in a Large Philippine University

        The purpose of this study is to examine study abroad experiences of Korean college students in a newly designed study abroad program for student teachers of education in the Philippines. Eleven college students, two males and nine females, participated in the study for four weeks in 2014. Using mixed methods, data were gathered from writing samples, a survey questionnaire, written reports and semi-structured interviews. Findings suggest that while students experienced communication and adaptation problems in the beginning, overall, they adapted well to studying and practicing student teaching in the Philippines; After the program the students became highly motivated to learn and teach English, and enhanced interests and confidence in student teaching and using English. Their attitude toward learning of English and cultural aspects of others also changed positively. The results of the study indicate that on average both studying English abroad and student teaching practice have encouraging effects on the learner`s perceptions and experiences, and positive development of intercultural awareness for future teachers in Korea.         Diagnostic imaging features of hepatic myelolipoma incarcerated in a peritoneopericardial diaphragmatic hernia in a cat

        A 1-year-old male Persian cat was presented for castration. Liver incarcerated in a peritoneopericardial diaphragmatic hernia (PPDH) was diagnosed through pre-anesthetic tests. Multiple homogeneous hyperechoic nodules in the hepatic parenchyma were identified using ultrasound. The nodules showed decreased attenuation compared with normal hepatic parenchyma, and the herniated hepatic parenchyma showed increased arterial and decreased portal enhancement on computed tomography. From the histopathology, we diagnosed hydropic degeneration with portal fibrosis and myelolipoma. This report presents diagnostic imaging features of hepatic myelolipoma incarcerated in a PPDH in a cat. When perfusion of the hepatic parenchyma is altered, surgical treatment should be considered.

        Study-abroad Experiences of Korean EFL Learners and Its Efficacy

        The purposes of this study are to investigate study-abroad experiences and its efficacy from an overseas English program for Korean EFL learners. Forty college students participated in the study-abroad program, an interaction-based language program, at a comprehensive university in the Philippines in January 2017. In order to examine the degree of changes in the students’ language skills development and their perceptions of the program, data were collected through pre- and post-tests of students’ speaking and writing skills, survey questionnaires and follow-up written interviews after the period. The SPSS 18.0 was used for data analysis. The results of the study indicated that both students’ speaking and writing skills were significantly improved, their perception of the program was viewed positively, and their confidence in using English and cross-cultural understanding was improved immensely after four weeks. Further follow-up studies are needed in order to develop the more effective study-abroad programs for Korean EFL learners in the future. (Hannam University)

      • 원어민 교사와의 협동수업이 초등학생의 정의적 태도에 미치는 영향

        The purpose of this study is to examine the effects of team teaching with a native English teacher on the students’ affective factors at the elementary schools in Daejeon, Korea. The study compared the experimental group of class with team teachers and a control group of class with a single Korean teacher. Data were collected after the experiment through questionnaires and written comments. The results of the study were as follows; First, students’ extrinsic motivation in the experimental group changed positively. Second, student’s self-esteem in the experimental group changed positively. It showed that students gained confidence in using English because they were exposed to the environment of using English. Third, students’ risk-taking in the experimental group changed positively. This means that the students weren’t afraid of speaking English and making errors in the class. Fourth, students’ anxiety didn’t show any significant change in both the experimental group and the controlled group. It showed that students’ fear existed when they communicated with a native English teacher. Fifth, most students expressed about team teaching positively through writing. The results of the study indicated that there was a positive influence on the students’ affective factors when students were taught by team teachers.

        EU법상 금융투자상품계약의 준거법

        종래 협약의 형식으로 국제사법의 통일문제를 해결해오던 유럽 연합은 한걸음 더 나아가 공동체법의 형식으로 이 문제를 해결하기 시작하였다. 2009. 12. 6 시행된 Rome I은 회원국 내에서 계약상 채무의 준거법에 관하여 기존의 로마협약을 대체한다. Rome I 에서 “금융투자상품”이라는 개념이 새로이 등장하였다. 금융투자상품을 다루는 규정은 전문 4개항(18, 26-30항)과 본문 3개항(Articles 4(1)(h), 6(4)(d), (e))에 달한다. Rome I상의 금융투자상품에 관한 조항들은 금융투자상품에 관한 계약의 준거법으로서 단일법 제공 및 주식거래소에서의 거래에서의 금융투자상품계약의 단일체제유지를 목적으로 한다. Rome I에서의 금융투자상품이란 ?금융투자상품시장지침? 제4조에서 말하는 것과 동일한 개념이다. ?금융투자상품시장지침? 제4조 제1항 제17호에 따르면 ‘금융투자상품이란 동 지침 부속서 I C항에 규정된 증권들’을 의미한다. Rome I은 금융투자상품으로부터 발생하거나 금융투자상품에 관계된 계약상의 채무만을 다루고 증권상 권리의 양도나 증권에 관한 담보권의 양도를 다루지 않는다. Rome I상의 금융투자상품계약은 제4조 제1항 (h)호의 적용을 받는 전문가 금융투자상품거래와 제4조 제1항 (h)호 규정의 적용을 받지 않는 비전문가 거래로 구분된다. 당사자의 준거법 지정이 없는 경우 다자간시스템 안에서 체결되는 계약체결시 적용되는 특별법이 전문가 금융투자상품계약의 준거법이 된다. 비전문가 금융투자상품계약에 대해, Rome I은 특별 규정을 두고 있지 않다. 따라서 이들은 일반 원칙의 적용을 받는다. 일반 소비자들이 체결하는 대부분의 금융투자상품계약은 Rome I 제4조 제1항 (h)호가 아닌 다른 조항(제4조 제1항 (a)호, 제4조 제1항 (b)호, 제4조 제2항)의 적용을 받게 된다. 단일법 제공이라는 목적의 필요성을 인정하는 경우, 금융투자상품에 관한 계약에만 이 원칙을 적용할 것이 아니라 상품거래소를 포함한 모든 종류의 거래소에서 체결된 계약에도 적용되어야 한다고 주장되고 있다. 소비자계약과의 관계에 있어서 Rome I 의 소비자계약의 준거법 결정원칙은 일정한 범위의 금융투자상품에 대해서는 적용되지 않는다(제6조 제4항 (d), (e)호). 기관 및 개인의 해외 직접 투자와 외국인의 국내 주식시장에의 투자가 점증하는 상황에서 외국적 요소가 있는 금융투자상품거래분쟁시 준거법결정을 위한 기준을 정립하여야 할 것이다. 이 논문에서 다룬 금융투자상품거래의 계약적 측면에 대한 준거법결정원칙의 도입에 관하여 살펴보면 금융투자상품거래에 대하여는 단일법에 따라 처리하여야 할 필요성이 크고, 우리나라를 포함한 각국은 거래소에 대하여 거래소자체의 규정을 두고 있다. 당사자자치가 허용되는 영역에서는 거래소 차원의 표준거래약관이 사용되므로 국제사법상 금융투자상품거래에 관한 별도의 준거법결정원칙의 도입은 불필요하다고 볼 수도 있으나, 법제의 정비라는 측면에서 금융투자 상품거래의 준거법결정기준을 국제사법에 두는 것이 바람직하다. 증권거래소에서 체결된 계약에 서로 다른 법들이 적용된다면 주식·사채 및 기타 금융투자상품의 효율적 거래 및 그러한 계약으로부터 발생하는 채무의 청산은 불가능할 것이고 따라서 증권거래소에서 체결된 계약은 하나의 동일한 법의 적용을 받아야 하기 때문이다. 이와 함께 현재의 국제사법상 용어(무기명증권, 유가증권)를 자본시장법과 연계하여 정리할 필요가 있고, 금융투자상품계약과 소비자계약과의 관계 정립이 필요하며, 자본시장법에 상거소개념을 도입하는 것이 바람직하다. This article deals with the rule of determination of the law applicable to a contract for the financial instruments under the European Union Law based on the Regulation (EC) 593/2008 on the law applicable to contractual obligations (‘Rome I’). Rome I has new independent paragraphs (Art.4(1)(h), Art.6.4(d)& (e)) regarding a contract for the financial instruments. For the purposes of Rome I, financial instruments and transferable securities are those instruments referred to in Article 4 of Directive 2004/39/EC. According to Rome I, a contract for the financial instruments shall be governed by the law chosen by the parties (Art.3). A contract shall be governed by the law chosen by the parties. The choice shall be made expressly or clearly demonstrated by the terms of the contract or the circumstances of the case. By their choice the parties can select the law applicable to the whole or to part only of the contract. A contract concluded within a multilateral system which brings together or facilitates the ringing together of multiple third-party buying and selling interests in financial instruments, as defined by Article 4(1), point (17) of Directive 2004/39/EC, in accordance with non-discretionary rules and governed by a single law, shall be governed by that law. Paragraphs 1 and 2 of Article 6 regarding consumer contracts of Rome I shall not apply to (i) rights and obligations which constitute a financial instrument and rights and obligations constituting the terms and conditions governing the issuance or offer to the public and public take-over bids of transferable securities, and the subscription and redemption of units in collective investment undertakings in so far as these activities do not constitute provision of a financial service and (ii) a contract concluded within the type of system falling within the scope of Article 4(1)(h). Rome I is said to have chosen the predictability instead of giving up the flexibility provided by the EC Convention on the Law Applicable to Contractual Obligations 1980 (‘Rome Convention’). The rules deciding the law applicable to the financial instruments under Rome I will be a guide to the discussion regarding the necessity of an independent article or articles for the law applicable to the financial instruments, the relationship between the contract for financial instruments and the contract for a consumer contract etc. of the Private International Law of Korea and the necessity of adopting the notion of habitual residence into the Law for the Capital Market and Financial Investments of Korea.
