ICANN Inc.: Accountability and Participation in the Governance of Critical Internet Resources

This paper assesses the relationship between public participation and accountability in ICANN. It shows that ICANN tries to combine three distinct organizational models as a result of its global governance responsibilities: it combines elements of a private corporation, a bottom-up standards body and a government regulatory agency. The paper shows that the private corporation model has come to dominate the other two; however, ICANN lacks the normal forms of accountability to which private corporations are subject. ICANN has responded to accountability concerns by creating new opportunities for public comment, review, and participation. This paper questions whether participation is an adequate substitute for accountability. It analyzes three distinct reforms in ICANN’s history to show how participation can displace accountability rather than improve it.
국제 거버넌스 제도에 대한 잔여지역(Rest of the World)의 참여에 대한 연구

이 논문은 인터넷주소관리기구 (ICANN: The Intemet Corporation for Assigned Names and Numbers)에서 활동하는 북미 및 유럽 지역 이외의 국가 대표들의 참여 및 정책 안건의 형성과 그 효과에 대해 고찰한다. ICANN은 정부간국제기구의 대안으로 1998년에 설립된 민간기구로서 사적부분의 주도와 사적 자치를 지향하고 있는 실험적인 시도라고 할 수 있다. 따라서 ICANN은 어떻게 인터넷 및 전자상거래의 발달이 국제 거버넌스의 새로운 형식을 확립해가고 있는지를 보여주는 중요하고 재미있는 예가 될 수 있다. 논문에서는 북미와 유럽을 제외한 나라 대표들의 ICANN 과정에 대한 참여, 정책 의제 설정 및 그 효과를 분석함으로써, 국제적 거버넌스 관련 문제에 대한 ICANN의 독특한 접근이 이들 잔여지역에 어떤 영향을 미치는가를 고찰하고자 한다. 특히 시민 사회가 참여할 수 있도록 통로를 열어두고 민간 부분의 조직들에 의존하는 이러한 방식이 잔여지역의 필요와 이익을 더 쉽게 대표하도록 하는가 아니면 더 어렵게 만들고 있는가, 지금까지 잔여지역의 행위자들은 ICANN에 얼마나 효과적으로 참여하여 왔는가, 어떤 절차와 실제적 정책들이 ICANN 과제에서 잔여지역 국가들이 받을 수 있는 이익을 증진시켜 줄 것인가 등의 문제를 조사하기 위한 경험적 근거로서 본 논문은 한국의 사례를 분석한다. This paper explores the participation, policy agendas, and effectiveness of representatives from outside of North America and Europe in ICANN (The Internet Corporation for Assigned Names and Nurnbers)'s processes. ICANN is an important and interesting example of how the Internet and e-commerce are creating new forms of international governance. ICANN is a private corporation, newly created at the end of 1998. How does the unique ICANN approach to an international governance problem affect the rest of the world (ROW) than the U.S.? Does the reliance on a private sector organization with some channels open to civil society participation make representation of ROW needs and interests easier or harder? How effectively have ROW actors participated in ICANN's regimes? What procedures and substantive policies would improve the benefits received by the ROW in the ICANN process? Relying on the case of South Korea for empirical evidence, the paper attempts to establish a general framework for analyzing this problem.
