      • 大學生의 讀書實態에 관한 調査硏究

        독서는 인류의 정신적 가치를 수용하는 행위이므로 독서의 필요성이 강조되며 독서를 통해 보다 많은 정보를 받아 들여야 급변하는 시대에 뒤지지 않는다. 학문을 탐구하는 대학생이 독서를 통해 기초교양과 전공영역에 관한 지식을 받아들이는 일은 가장 중요한 일이다. 인쇄미디어를 통한 인간의 사유가 전파미디어를 통한 직각적 반응의 형태로 대치되어 가므로 인간은 사유하기 보다는 수동적으로 반응하는 방법에 익숙해져 가는 시대적 상황에서 독서를 통해 기성의 업적과 연구방법을 받아들여 새로운 학문적 체계를 탐구해야 하는 대학생들은 어려운 국면에 처하고 있는데, 본 연구는 대학생들이 독서현장에서 겪는 실정을 파악해 보다 나은 독서의 방향을 찾아보려고 한다. 본 연구의 조사대상은 무작위로 선정된 대학 2,3학년 학생으로 하였으며 학문의 계열별 특수성을 감안하여 인문, 사회, 자연, 법상, 예체능계열의 5영역으로 학생집단을 분류하여 설문지를 통해 조사하였다. 본 연구의 통계자료의 분석을 통하여 특징적으로 드러나는 점을 요약하면 다음과 같다. 대학생들의 독서량이 매우 부족하며 독서습관이 정착되지 못했다. 전체학생의 67%가 3천원이상 1만원미만의 돈을 1달 책 구입비로 쓰고 있다. 책을 구입하게 되는 계기는 학생 스스로에 의한 것이 75%로 대부분이다. 대부분 학생이 집에서 주로 책을 읽는데(76%) 도서관의 이용(13%)이 확대되어야 한다. 독서를 저해하는 가장 큰 요인은 독서 습관의 부족(34%)과 과중한 과제물(31.5%)이다. 대학생들의 독서수준은 그들의 전공과는 거의 무관하게 이루어지며 영웅담이나 처세술등을 담은 책들이 인기가 높으며 사회과학 분야의 관심을 담은 책들이 많은 학생들에게 선택된다. 그리고 쉽게 접근해 읽을 수 있는 독서물들이 인기가 높으며 대학생들의 독서수준이 초보적인데 머물고 있다. 따라서 체계적인 독서지도가 필요하며 대학이 지성의 산실이라면 보다 높은 수준의 사유를 가능케 할 책들이 선택되어야 할 것이다.

        Comminuted calcaneal fractures involving posterior facet can be bring out complications as prolonged severe disability. Lots of different methods have been tired for the treatment in order to search for better results. The purpose of this study is to demonstrate the effectiveness of the open reduction and internal fixation with H-plate via the extensile lateral approach for the treatment of the intraarticular calcaneal fractures. Twenty-two calcaneal fractures of 19 patients were treated by open reduction and internal fixation using H-plate via an extended lateral approach from July, 1998 to May, 2002. We analyzed only 7 type Ⅲ and 15 type Ⅱ cases classified by Sanders after routine preoperative CT scan. These patients were evaluated from 6 to 39 months (average 16.5 months) after surgery. Final results were assessed by the ankle-hindfoot scale designed in American Orthopaedic Foot and Ankle Society. Among the 22 cases, excellent results were obtained in 11 cases, good in 8 and fair in 3. There were no remarkable complications except for a local infection at the latest follow-up. Critical importance to patient outcome in the restoration of the morphologic structure of the entire calcaneus, including the relationship between the articular surfaces and overall lenght, width and height. Open reduction and internal fixation with H-plate via the extensile lateral approach is the preferred treatment for displaces calcaneal injuries, especially type Ⅱ and type Ⅲ classified by Sanders, because it allows superior acess to the anterior process, posterior facet, and tuberosity and to able to broad contact surface for fixation.

        The Capital Market and Financial Investment Business Act set out to achieve control and investment efficiency by reinforcing investor protection for ordinary investors and minimizing unnecessary regulations for professional investors. According to that purport, the Act imposes explanatory obligation of financial investment business entity only to ordinary investors. However, there should be more detailed discussions about the specific objects of its application. The study provided opinions on interpretations as to whether financial investment business entity could be exempted from explanatory obligation when ordinary investors refused its explanation and whether the explanatory obligation of financial investment business entity could still be recognized as obligation for client protection. Even if ordinary investors refuse the explanation of financial investment business entity, its explanatory obligation cannot be exempted. Armed with investment professionalism and risk taking capacity, professional investors cannot be subject to the same obligation for client protection as ordinary investors. The Capital Market and Financial Investment Business Act stipulates that financial investment business entity should be liable for damages resulting from the violation of explanatory obligation to alleviate the burden of proof among ordinary investors when there is damage because of the violation of explanatory obligation on the part of financial investment business entity. The provision presumes causal relations between damage amount and damage occurrence, contributing to the stronger protection of ordinary investors` rights. Reinforcing the protection of ordinary investors and encouraging responsible investments among professional investors through the clear interpretations of explanatory obligation are critical for sound development between financial investment business entity and investors in the rapidly changing capital market.

        In real estate development, fund-raising methods through project financing have been established as a common approach. In the old practice of real estate project financing, contractors offered credits such as joint surety, takeover of debt, completion guarantee, and sales guarantee for the debt of the project company for financial institutions. When a contractor offers credits for the implementation of a project, the project can be propelled in a stable and fast manner. However, many projects were carried out through the credit enhancement of contractors, it worked to deteriorate the financial soundness of the contractors. It even had negative impacts on financial institutions that had nothing to do with the projects via the contractors. Those problems have recently led to attempts at structuralization through new and diverse methods of credit enhancement including condition takeover of debt, secured loan commitment for unsold estate, and advance subscription and rent instead of the old credit enhancement method that imposed all the project risks onto contractors. However, there are no specific discussions about the legal effects of those new methods of credit enhancement. In addition, there are many cases in which a contract is concluded with the concerned parties having no clear perception of legal effects. Contractors are still burdened with ultimate risks with the possibilities of expediency and illegitimacy. Real estate development through project financing seems to continue its expansion, but the current practice of real estate project financing is nothing but an altered version of the old financing approach. The limitations of real estate project financing dependent on contractors should be overcome by searching for an investment structure proper for projects through structured financing and new institutions.

        신탁업자의 정비사업 시행참여에 관한 법적 연구

        Rearrangement projects make a contribution to the higher quality of housing life for people by improving deteriorated and faulty housing environments in urban areas. There are, however, many cases in which rearrangement projects are postponed in their processes due to the lack of professionalism and morality of the partnership, conflicting interests among the members of partnership, and low feasibility. In an effort to resolve those problems, they are preparing a plan to allow trust business entity to do rearrangement projects. If there are some institutional complementary measures taken, trust business entity will be capable of doing rearrangement projects in a professional and transparent manner and carrying out their affairs objectively, which means that there is a need to allow them to do such projects. Currently the Act on the Maintenance and Improvement of Urban Areas and Dwelling Conditions for Residents is being revised (plan) to allow trust business entity to be entrusted with the direct implementation right by the property owners and do rearrangement projects on their own. However, the idea seems difficult to be realized for the following reasons: first, trust business entity have their limitations with the implementation of rearrangement projects as the subjects of public interest proj-ects; second, it is difficult to coordinate the interests of all property owners and carry on rearrangement projects only with trust agreements and rearrangement project implementation regulations; third, the Act on the Maintenance and Improvement of Urban Areas and Dwelling Conditions for Residents has basic provisions only for the cases in which trust business entity do rearrangement projects, which does not correspond with the flow of project propulsion method through the establishment of partnership; finally, inefficiency can be caused in the propulsion of rearrangement projects by trust business entity. In other words, the need for trust business entity to participate in rearrangement projects is recognized, but it will be difficult to apply the method of getting trust from the property owners directly in the early stage of rearrangement project and working on the project. If that is difficult, the approach will not be much different from the loan-type (development-type) land trust. It is thus needed to revise the provision about the implementors of rearrangement projects in the Act on the Maintenance and Improvement of Urban Areas and Dwelling Conditions for Residents and allow trust business entity to participate in the implementation of rearrangement projects. There should be discussions about the ways how trust business entity should be appointed and the scope of job delegation to them in order to allow them to participate in the implementation of rearrangement projects. It is important to select trust business entity for rearrangement projects in an objective and transparent manner and set a clear boundary of job delegation to the selected ones. It is also needed to have discussions about financing when trust business entity participate in the implementation of rearrangement projects. When trust business entity participate in the implementation of rearrangement projects, funds can be raised in diverse ways. However, financing issues should be resolved in the early stage of such projects. Furthermore, it is also required to define relations between trust business entity and professional management enterprises for rearrangement projects that have been managing rearrangement projects clearly and establish regulations about the limits on trust business entity`` liability for damages.

        A Legal Study on The Act Bill for Establishing The Game User Committee

        본 연구는 게임제작업자등에게 게임물이용자위원회를 두도록 하는 게임산업진흥에 관한 법률(안)에 대한 개선방안을 제시한다. 이 법안은 행정형벌에 있어서 불명확한 용어의 사용으로 인한 죄형법정주의 위반, 게임물이용자위원회 위원의 비밀 유지의무 규정의 미비 등으로 인한 헌법상 직업선택의 자유(영업의 자유) 및 재산권을 침해, 중복 규제제도로 인한 게임산업 발전을 저해 등 많은 문제점을 가지고 있는데, 선행연구와 판례를 분석하여 세 가지 개선방안을 도출하였다. 첫째 특별한 사유의 구체적인 내용은 시행령, 시행규칙 등 하위법령으로 위임하여 정하도록 하고, 징역, 벌금을 과태료 부과로 전환을 고려하거나, 둘째 제출받은 자료에 대한 게임물이용자위원회 위원의 비밀유지의 의무 및 벌칙에서의 공무원 의제 규정을 마련하며, 셋째, 현행 게임산업법상 게임물관리위원회에서 확률형 아이템 관리를 하거나 확률형 아이템 판매 시 콘텐츠분쟁조정위원회의 분쟁 조정제도의 고지 등 현행 제도를 활용할 수 있도록 하는 방안을 제시한다. In this paper, we suggest the Measures to improve the Act Bill for establishing the Game User Committee. The Act Bill has a lot of problems which are violations of criminal legalism due to unclear terms in administrative punishment and violations of The Human Right enjoying freedom of occupation and guaranting property due to not defining provisisons about The Duty of Confidentiality or The Legal Fiction as Public Officials for Purposes of Applying Penalty Provisions. also the duplicate regulations in the Act Bill disrupt game industry development. we have three results that were derived through analysis of Prior studies and precedents. The First is to define details of special reasons in enforcement ordinance and enforcement regulations. The Second is to define The Duty of Confidentiality or The Legal Fiction as Public Officials for Purposes of Applying Penalty Provisions in the act bill. The Third is to address managing the random reward items in the Game Rating and Administration Committee or is to give game user advance notice about the Comntent Dispute Mediation system.
