金範禹와 그의 가계

This paper studied on the Kim Beom-u (金範禹) and his lineage who was first persecuted in 1785 for his belief in Roman Catholicism (天主敎). Followings are results of the research in this paper: First, the Kim Beom-u's ancestors began to separate themselves from YangBan (兩班) lineage and to form Chungin (中人) lineage in the early 17th century. From that time on, some of the Kim's ancestors passed not only Mugua (武科) but also Japgua (雜科). Although they passed Mugua, their social status as Chungin were unchanged. The existing arguments that Kim's lineage was changed from Muban (武班) status into Chungin status must be reexamined because their social status was never changed since they had became Chungin in the early 17th century. Second, though Kim Beom-u's father Kim Ui-seo (金義瑞) had four legitimate children from his wife who had been still alive, he had more children from a concubine. He also paid some funds for publications of his lineage books, ChogPo (族譜). Such actions were very popular practices in Chungin society. On the contrary, the fact that Kim Ik-han (金翊漢), Kim Beom-u's great-grandfather, after passing the YugGua (譯科), became active in a chief interpreter of a diplomatic envoy to Beijing (北京) illuminated that Kim Beom-u's lineage seems to be quite open to the outside world. Third, the existing research emphasized that Chungin accommodated Catholicism because of their resistance to the discrimination by YangBan. But Chungin also must be giving up desires for getting public offices or concubines to receive Catholicism. Kim Beom-u, as the member of a powerful Chungin lineage, must have more determination than other Chungin members become a Catholic believer because Kim Beom-u could easily get those advantages such as public offices or concubines. Fourth, Kim Beom-u was intimate with Yi-Byeok (李檗) because they were related by marriage. Their in-lawships were formed by Kim Ssi (金氏) who was Jeong Yak-yong (丁若鏞)'s father's concubine. But the most important reason for their intimate relationships was the fact that Kim Beom-u was a man of great knowledge. The fact that Yi-Byeok was a great scholar and Kim Beom-u propagated many people such as not only Chungin but also YangBan make me surmise their close relations. Fifth, the Kim Beom-u's descendants still had married with Chungin after 20 years of his persecution. Kim Dong-yup (金東曄), Kim Beom-u's grandson, who resided in Mil-Yang (密陽), associated with YugGuan (譯官) who kept high ranking public offices in Seoul. The purpose of his intimate relations with them was to maintain his social position for his family. Kim Dong-yup kept the relationship by marriage and the scop of the relationship was very wide. Through this fact we can conclude that interrelationship in the late ChoSon (朝鮮) society was very powerfully influenced by not only blood but also marriage. Sixth, through this research I can notice that the most important qualification of Chung in was kept in the blood, and Chungin must marry Chungin and reside in Seoul or suburb to maintain it's status.

어음ㆍ手票의 不渡에 관한 法的考察 : 不渡事由를 중심으로

어음·수표의 부도와 관련하여 어음·수표법상에는 부도사유가 구체적으로 명시되어 있지 않지만 실무처리의 통일성과 편의성을 도모하기 위하여 어음교환소규약과 은행약관에는 부도사유가 구체적으로 명시되어 있다. 그러나 어음교환소규약과 은행약관상의 부도사유는 제한적으로 열거되어 있고 어음·수표법의 법리에 배치되는 경우가 있어 이의 적용상 여러 가지 문제점을 제기하고 있을 뿐만 아니라 이에 대한 연구가 거의 없어 그 이해에 어려움이 많다. 이에 이 논문은 실무상 부도사유의 내용을 구체적으로 살펴보고 이의 적법성과 타당성을 검토하여 그 개선방안을 제시한다.

責任保險에 있어서 被害者의 地位

이 논문은 책임보험에 있어서 특별히 보호받아야 할 피해자의 지위에 관한 현행법상의 내용과 문제점을 중심으로 다음과 같은 내용으로 구성하였다. 제1장에서는 연구의 목적과 방법에 관하여 언급하고, 제2장에서는 책임보험의 일반법리로 책임보험의 개념과 기능, 책임보험계약의 요소와 책임보험계약의 구조적 특성을 살펴보고, 제3장 피해자의 지위에서는 첫째, 책임보험에서의 피해자 지위의 문제점을 검토하고 둘째, 피해자란 과연 누구를 의미하는 것인가 하는 피해자의 개념을, 셋째, 보험계약의 당사자가 아닌 피해자가 보험자와 어떠한 관계를 가지고 있으며 법규정 및 판례 등은 이를 어떻게 파악하고 있는가를 검토하고, 넷째, 피해자의 보호를 위한 피해자의 보험자에 대한 직접청구권을 중심으로 그 법적 성질과 근거, 직접청구권에 대한 보험자의 항변권제한문제, 보험자의 가해자에 대한 청구권, 직접청구권의 소멸 시효 등에 대한 문제점을 살펴보고, 다섯째, 임의책임보험에 있어서의 피해자의 피보험자에 대한 보험금청구권의 대위행사가 가능한 것인가 하는 점을 검토하였다 그리고 제5장 결언부분에서는 현행법체계로서는 미흡한 피해자의 지위를 강화하기 위한 방안을 결론적으로 제시하였다.

融通어음의 法律關係

이 논문에서는 융통어음의 개념, 융통자의 피융통자의 법률관계, 융통자와 제3자의 법률관계, 융통자의 피융통자의 어음수수의 원인관계에 대한 책임 등을 종합적으로 검토하였다. 이를 요약하여 보면, 제1장 에서는 연구의 필요성과 방법에 대하여 언급하고, 제2장 융통어음의 개념에서는 융통어음의 의의를 최광의설 입장에서 정의하고, 융통어음과 구별될 개념으로서 전도금어음·대부어음·보이기어음, 융통어음의 종류로서 전문적인 금융기관이 상품으로서의 융통어음과 호의어음, 그리고 융통어음의 남용을 기승어음과 허무어음을 중심으로 살펴보고, 제3장 융통자와 피융통자의 법률관계에서는 융통계약의 법적성질을 위임계약으로 파악하여 융통자의 피융통자에 대한 항변에 관한 원칙과 예외를 논의하고, 제4장 융통자와 제3자의 법률관계에서는 융통어음의 법률관계를 체계적으로 이해하기 위한 방안으로 법률관계의 형태를 짚어 보고 융통어음의 항변의 법적성질을 어음법 제17조가 적용되지 않는 인적항변으로 파악하고 융통자의 제3자에 대한 융통어음의 항변에 관한 원칙 및 특수사안의 법률관계를 검토하였다. 그리고 제5장 융통자의 피융통자의 어음수수의 원인관계의 책임에서는 이에 대한 학설과 판례를 검토하여 부정하는 입장에서 견해를 정리하고, 제5장 결언부분에서는 이 논문의 중요한 내용을 요약하고 융통어음에 관한 법률관계를 정확하게 이해하는데 필요한 몇가지 유의할 점을 지적하였다.

합성 Mellin Radial Harmonic필터를 이용한 위치 및 크기불변 물체인식

The proposed composite MRH(Mellin radial harmonic) filter, which is derived from a single MRH with shift- and scale- invariance. even recognizes the objects of scaled and/or similar shapes. The proposed composite MRH filter also can recognize inputs with the additive with nonzero mean gaussian noises by constant correlation threshold. Since the composite MRH filter is realized by CGH(computer- generated- hologram) which has amplitude and phase informations of the object. The light efficiency of this CGH filter is as high as the Wai-Hon-Lee CGH filter, which has only phase informations of the object.

<P>Reaction-based fluorescent probes for monoamine oxidases A and B are developed based on a new two-photon absorbing compound and its precursor. Linear stratified approach using full geometric constraints for 3D scene reconstruction and camera calibration.

<P>This paper presents a new linear framework to obtain 3D scene reconstruction and camera calibration simultaneously from uncalibrated images using scene geometry. Our strategy uses the constraints of parallelism, coplanarity, colinearity, and orthogonality. These constraints can be obtained in general man-made scenes frequently. This approach can give more stable results with fewer images and allow us to gain the results with only linear operations. In this paper, it is shown that all the geometric constraints used in the previous works performed independently up to now can be implemented easily in the proposed linear method. The study on the situations that cannot be dealt with by the previous approaches is also presented and it is shown that the proposed method being able to handle the cases is more flexible in use. The proposed method uses a stratified approach, in which affine reconstruction is performed first and then metric reconstruction. In this procedure, the additional constraints newly extracted in this paper have an important role for affine reconstruction in practical situations.</P>

In vivo imaging of human burn injuries with polarization-sensitive optical coherence tomography.

<P>The accurate determination of burn depth is critical in the clinical management of burn wounds. Polarization-sensitive optical coherence tomography (PS-OCT) has been proposed as a potentially non-invasive method for determining burn depth by measuring thermally induced changes in the structure and birefringence of skin, and has been investigated in pre-clinical burn studies with animal models and ex vivo human skin. In this study, we applied PS-OCT to the in-vivo imaging of two pediatric burn patients. Deep and superficial burned skins along with contralateral controls were imaged in 3D. The imaging size was 8 mm 6 mm 2 mm in width, length, and depth in the air respectively, and the imaging time was approximately 6 s per volume. Superficially burned skins exhibited the same layered structure as the contralateral controls, but more visible vasculature and reduced birefringence compared to the contralateral controls. In contrast, a deeply burned skin showed loss of the layered structure, almost absent vasculature, and smaller birefringence compared to superficial burns. This study suggested the vasculature and birefringence as parameters for characterizing burn wounds.</P>
