After the real estate subsequent purchaser performs provisional injunction against disposal by subrogation, the ownership transfer registration sequentially completed, from the name of transferer to that of transferee and from that of transferee to that of a third person, does not violate the injunctive effect of debtor by the effects of exercising the subrogation right of creditor. Further, the subsequent purchaser cannot claim invalidity of the stated-above ownership transfer registration as he or she does not infringe on the preserved right of a provisional injunction against disposal. Eventually, the subsequent purchaser ends up not completing the ownership transfer registration under his or her name, which was intended to achieve through a provisional injunction. In regards to the countermeasures to preserve the right of the subsequent purchaser, the Supreme Court's attitude is so passive, which can bring out many problems. Hence, to preserve the right of subsequent purchaser, according to positive interpretation of Article 305 Clause 1 and 3 of Civil Execution Act, the court can issue not only a provisional injunction against disposal by subrogation in accordance with the subsequent purchaser's application but also a provisional injunction to prohibit transferer from performing on transferee. Concerning a provisional injunction, it is appropriate to acknowledge erga omnes effects by filling in the court's issuance on the register of targeted real estate and officially notifying the court's issuance.
기판력(旣判力)의 물적범위(物的範圍)에 관한 소고 -소송물이론을 중심으로-

기판력은 소송물에 대해 행한 일정시점의 판단으로써 일정한 사항에 대하여 일정한 사람을 구속하게 되는데, 기판력이 어떠한 사항에 관하여 미치는가 하는 것이 기판력의 물적 범위 문제이다. 이에 관하여 우리 민사소송법은 기판력은 상계항변의 경우를 제외하고 판결주문에 포함된 판단에만 생기는 것이 원칙임을 밝히고 있다. 그런데 판결주문에는 본안판결의 경우 소송물의 존재 또는 부존재에 관한 판단이 표시되므로 결국 기판력은 소송물의 존부에 관한 판단에 한하여 발생하게 된다는 것이 된다. 종래 우리나라의 판례와 일부 학자들은 구소송물이론에 입각하여 소송물의 개념을 실체법적으로 파악함으로써 기판력의 인정 범위가 지나치게 협소해 지게 되었다. 그 결과 법적 안정성과 분쟁의 1회적 해결은 물론 소송경제 역시 도모할 수 없게 된다는 비판을 받아왔다. 이에 반해 소송물의 개념 내지 단복·이동을 소송법적 요소에 의해 파악하여야 한다는 신소송물이론에 의하면 소송물의 크기가 확대된다. 그 결과 기판력의 범위 역시 확장됨으로써 법적 안정성 및 분쟁의 1회적 해결을 통한 소송경제를 도모할 수 있게 된다는 장점이 있다. 다만, 신소송물이론을 따를 경우 필연적으로 확장되는 기판력에 의하여 당사자의 신소 제기권 또는 권리구제의 기회가 부당하게 박탈되지 않도록 당사자는 가능한 모든 공격방어방법을 변론에서 주장할 것이 필요하고 법원 역시 석명권 내지 지적의무를 적극적으로 행사하여야 할 것이다.
다방향 접합철물 삽입형 기둥-기초 접합부 모멘트 저항성능평가

The purpose of this paper is to evaluate the moment resistance of glulam post-to-base connections by applying quasi-static cyclic loads. The connectors consisted of inserted plates and drifted pins according to the load direction. The connection types employed in this study were total three including two unidirectional types (H, V) and the multi-directional type (M). The moment resistance of 8 mm-plate M-type is compared to 6 mm plate. Total four types of Post-to-base connection are prepared and tested under pseudo-static reversed cyclic loading. Test results showed that the yield moment of multi-directional connection is about 2 times higher than that uni-directional connections. The ductility ratio of multi-directional connection determined by EEEP was higher that that of uni-directional connection. It was becoming higher as the thickness of plate is increased. The Finite Element Analysis was conducted to estimate the stress distribution behavior of tested connections. Results showed the failure of multi-directional type were caused by the split of pined hole and the shear failure of lifted part of post.

In the procedures of real estate auction, priority repayment claims which are acknowledged by the laws other than civil law and commercial law includes rights or claims of security deposit return on lease for house tenants or commercial building tenants, wage claims, tax claims, public imposition claims etc. Even though these priority repayment claim holders don’t have auction application rights, they become the interested parties in real estate auction procedures, and in order to preferentially receive such repayments or claims against other creditors, requests of such claims should be made definitely prior to the termination of such requests. According to recent precedents, priority repayment claim holders who didn’t request their priority rights or claims cannot execute return claims against unfair profits which were already repaid to other creditors.
