政府契約制度의 改善方案에 대한 硏究 : 韓國電力公社의 契約制度를 中心으로

’97. 1. 1 부터 政府調達市場이 開放됨에 따라 國內企業들은 外國企業들과 함께 無限의 競爭時代로 突入하게 되어 國內産業 保護보다는 競爭과 市場經濟原理에 立脚한 競爭力 强化가 절실히 要求되는 狀況이다. ’91年度 以來 電氣工事業 免許 要件완화로 공사량의 增加에 비해 電氣工事業 免許業體數가 훨씬 크게 增加하여 業體當 平均 受注實績의 減少로 業體의 零細化가 가속화되었고 이로 인하여 技術開發에 대한 投資 및 技術人力 確保 등에 疏忽하게되어 結局不實工事의 原因이 될 수밖에 없다는 問題點이 擡頭되었으며, 또한 ’95년 6월의 廣域自治團體長 選擧를 起點으로 地方自治時代가 本格的 으로 始作된 현상황에서 地方業體의 育成을 통한 地域經濟의 活性化 側面과 人口의 서울 집중화 現象은 深刻하게 考慮되어야 할 사안이다. 이러한 國內外的 環境變化에 對應하기 위한 方案으로 한국전력공사의 계약制度를 考察하여 契約制度의 問題點을 導出하고 그 改善方案으로 韓國電力公社의 契約制度중 예정가격제도의 개선, 계약이행 수단 강화, 發電所 주기기의 구매방법 개선, 韓電의 送配電 공사계약의 개선 방안 등에 중점을 두고 연구하였다. 이러한 硏究를 위하여 第Ⅱ章에서는 契約制度의 일반적槪念, 韓國電力公社의 契約의 節次 및 主要 國家의 國家別 契約制度를 理論的으로 考察하였으며, 第Ⅲ章에서는 1건 工事의 入札에 1,156개 業體가 參加 하는 등 과당競爭으로 國家的인 次元에서 볼 때 불필요한 人的 및 物的浪費가 深化되고 地方化時代에 電氣工事業體의 42%가 首都圈에 偏重하여 所在하는 등 問題點이 있어 이러한 問題點을 解決하기 위하여 韓國電力公社의 지역제한 入札에대한 改善方案으로 3억원 未滿에 한하여 지역제한이 可能한 現行制度를 10억원 未滿으로 上向 調整하여 124개 業體가 參與토록하여 人的 및 物的浪費를 줄이는 方案을 提示하였으며 廣域市 및 道單位로 地域을 制限하도록 규정된 現行 基準을 電氣工事業體의 首都圈 集中化를 地方化時代에 副應하도록 경기도를 모델로 시․군 單位로 制限할 수 있는 方案을 提示하였다. 이러한 方案은 首都圈 地域에 편중된 電氣工事業體를 地方으로 移轉하는 契機가 될 수 있을 것으로 사료되며 이는 地方自治時代를 맞아 地方業體 育成을 통한 地域經濟活性化 方案으로 바람직하다고 본다. 그러나 본 論文에서 提示한 地域制限 入札制度의 改善은 地方에 所在한 電氣工事業體에게는 바람직한 方案으로 歡迎할 것으로 豫想되나 서울 및 首都圈에 所在한 대부분의 業體들은 반대할 것으로 예상된다. 또한 豫定價格制度의 개선, 契約履行의 手段 强化, 發電所 主機機의 購買方法에 대한 개선방안, 契約節次의 투명성 確保를 위한 공개성 강화, 價格決定 制限 要素의 撤廢를 제시하였다. 특히 정부가 電氣工事業體에 대한 受給限度額제도 廢止를 추진하고있어 이에 대한 개선방안을 提示하고 제Ⅳ장에서는 結論으로 매듭지었다.
