최근의 한국사회는 모든 분야에 있어 개혁을 추진하고 있다. 이러한 개혁은 문민정부라는 국내 정치변화도 한 요인이지만, 지구촌 시대로 들어서는 국제적 환경 변화도 큰 요인이다. 이제 교육 분야, 특히 대학은 외부세계와 단절되어 오직 진리만 추구하던 '상아탑'적 전통에만 안주할 수 없게 되었다. 대학도 환경의 변화에 능동적으로 대처하여 조직 체계와 그 운영에 있어 개방성을 추진하여야 한다. 대학의 최고 정책 결정기구인 대학이사회의 구성과 기능 그리고 집행기관인 총장의 선출과정 및 리더십에 대해 개방성이 강조되고, 행정의 운영에 구성원의 참여와 공개가 보장되는 것은 대학행정의 민주성을 확립하는 필수적 요소이다.

논문(論文) : 한국 학교에서 아동권리협약의 적용과 과제: 체벌,징계절차,표현의 자유를 중심으로

본 연구는 상대적으로 소홀했던 한국의 초·중등학교 학생들의 인권 보호 문제를 아동권리협약과 관련하여 다루었다. 유엔아동권리위원회의 권고사항인 학생체벌 금지 문제를 주된 주제로 분석하였다. 체벌의 교육적 찬반논거, 체벌관련 법령, 법원과 헌법재판소의 최근 판례를 분석하였다. 아동권리위원회에서 권고한 학생징계와 적법절차 문제, 표현의 자유의 제한 문제도 살펴보았다. 그밖에 학교영역에서의 차별문제, 교육을 받을 권리, 학교폭력과 학교환경의 안전성 문제, 사생활을 비밀과 자유의 문제도 언급하였다. 학생의 인권신장을 위한 정책적 과제로 체벌을 금지하는 법령개정, 학생들이 소중한 존재임을 인식시키는 교육, 지나친 경쟁위주의 교육풍토 개선, 법원에서 국제법규를 수용하는 적극적인 태도 변경, 권리 인식과 동시에 책임의 강조, 교사와 학생의 불신해소를 위한 소통의 원활화 등을 제의하였다. Korea has developed rapidly in the political areas as well as the economic areas. The rights of students in schools, however, has been relatively ignored. The reasons could be the closed system of school organization and the `in loco parentis` doctrine. Korean government has ratified the Convention on the Rights of Child in 1991. It means the Convention is valid in Korea. The UN Committee of Rights of Child pointed out in its concluding observations to prohibit the corporal punishment in Korean schools, and to enforce the due process in the discipline of students. It also suggested to protect the students` rights of expression. This study analyzed the Korean statutes and legal cases of Korean Constitutional Court related with the corporal punishment, due process, and students` rights of expression. The other issues, such as the discrimination, the rights of education, school violence and safety problem, and the privacy were referred briefly. This study suggested several tasks to implement the major issues relating with the Convention on the Rights of Child. First, students should be conscious of the dignity of human beings including himself. Second, the Statutes of Education should be amended to prohibit the corporal punishment in schools. Third, the excessive competition for higher education entrance examination should be changed. Fourth, the Korean courts and Constitutional Court need to be more positive in accepting the international treaties including convention on rights of child. Fifth, the responsibilities which students must observe should be emphasized together with their rights. Finally, the communications between the students and teachers should be increased to clear up the distrust between them.

본 논문의 목적은 미국 교육법 연구의 최근 동향과 쟁점들을 분석하는 것이다. 최근의 연구동향 및 주요 쟁점은 미국 교육법연구의 대표적 학회인 ELA의 2006년도 학술대회 발표주제들, 그리고 미국 교육법의 대표적인 논문집인 「West`s Education Law Reporter」와 「Journal of Law & Education」에 게재된 2005-2006년도의 논문주제들을 종합 분석하여 선정하였다. 이러한 분석 결과 최근의 핵심적인 미국 교육법 쟁점으로 첫째, 장애아동의 교육(IDEIA)에 관한 관계 법령의 주요내용과 쟁점이 되고 있는 판례를 살펴보았다. 둘째, NCLB(No Child Left Behind Act of 2001)의 주요내용과 원칙을 살펴보고, NCLB의 위헌성 문제를 분석하였다. 셋째, 학교환경의 안전성과 학생지도 문제로 학교에서의 폭언과 폭력, 괴롭힘, 수색과 체포의 법적 문제들을 살펴보았다. 마지막으로 이러한 쟁점들이 한국의 교육법 연구에 주는 시사점을 몇 가지 지적하였다. This article analyzed the recent trend of studies in American education law and the current issues. The current issues were selected from the comprehensive analysis on the topics of the 52nd National Conferences of the Education Law Association (2006 Year), and the whole articles published during the 2005 and 2006 in the 「West`s Education Law Reporter」 and 「Journal of Law & Education」. As the first current issue, this article analyzed the brief contents, legal issues and related legal cases of IDEIA(The Individuals with Disabilities Education Improvement Act of 2004). The legal issue was focused on the evidence of IEP(Individual Education Program) under the IDEIA. Second, this article analyzed the brief contents and the four principles of NCLB (No Child Left Behind Act of 2001). The current issues and legal cases were focused on the unconstitutionality of conditions such as adequate early progress under NCLB. Third, this article covered the issues of the school security such as threat, fighting word, verbal assaults, bullying and sexual harrassment. The T.L.O. case was also referred in the contexts of search and seizure in the school campus. The author suggested several implications to Korean education policy makers from the four issues of the American education law.
