Protective Effect of Decursinol on Mouse Models of Sepsis: Enhancement of Interleukin-10

The effects of decursinol on various models of sepsis were investigated. Intra-peritoneal pretreatment of mice with various doses of decursinol (1∼100 mg/kg) effectively suppressed lethality induced in three mouse models of experimental sepsis, i.e., lipopolysaccharide (LPS)/D-galactosamine (GalN), high-dose LPS (20 mg/kg), and cecal ligation and puncture (CLP). Intra-peritoneal pretreatment of mice with decursinol (50 mg/kg) markedly enhanced the LPS/GalN-induced increase of plasma interleukin-10 (IL-10) levels, without affecting plasma TNF-α , IL-6 and IL-12 levels. These results suggest that decursinol could be effective for prevention or treatment of sepsis. The effects of decursinol on various models of sepsis were investigated. The Constitutional Court adjudged a decision of violation of the constitution for adultery that had to be unconstitutional four times the sentencing. In the decision it was 7(violation of the constitution) : 2(constitutionality) and there are three different opinions on unconstitutionality. As one of the unconstitutional opinions with instruction, the judge Kim I Soo and Kang Il Won’s opinions are whether can be considered unconstitutional opinion. In order word, the Judge Kim’s opinion is not all adultery article is not unconstitutional because it is valid punishing both the violator of adultery with marriage in-law and sexual duty to his/her partner and the violator of fornication having partner, but it is unconstitutional that punishing all of the violator. The judge Kang’s opinion is the adultery rule itself is not unconstitutional too. For the adultery rule does not violate constitutional law when the adultery rule should be reformed to be selectively imposing a lighter penalty than imprisonment and the concept of coax and pardon should be clearly. These all judged unconstitutional can not be considered valid judges. I strong believe that the constitutional court should have to make a decision incompatible with the constitution or a partial decision on unconstitutionality. 헌법재판소는 종래 4차례 합헌결정을 하였던 간통죄에 대하여 위헌결정을 선고하였다. 이 에 대하여는 ‘7(위헌) : 2(합헌)’으로 위헌결정이 선고된 것으로 되어 있으나, 구체적으로 살 펴보면 위헌의견은 모두 세 가지로 나뉘어 있고, 위헌의견의 하나로 설시되어 있는 김이수 재판관의 의견과 강일원 재판관의 의견이 실제 위헌의견이라고 볼 수 있는지 의문이 있다. 즉 김이수 재판관의 의견은 모든 간통⋅상간행위자를 처벌하는 것이 위헌이라는 취지일 뿐, 혼인관계가 정상적으로 유지되고 있어 배우자에 대한 성적 성실의무를 부담하고 있는 자의 간통행위 및 배우자 있는 자의 상간행위의 경우는 처벌대상으로 함이 타당하고 따라서 간통 죄 조항 전체가 위헌이라는 것은 아니라는 취지이고, 강일원 재판관의 의견도 간통⋅상간행 위를 징역형 외에 그보다 경한 다른 형벌을 선택적으로 부과할 수 있도록 개정함과 동시에 소극적 소추요건인 종용과 유서 개념을 명확히 할 경우에는 간통죄 규정이 헌법에 위반되지 않는다는 것이므로 이 역시 간통죄 규정 자체가 위헌이라는 것은 아니라는 취지라는 점에서 이들 의견을 모두 전부위헌의견으로 판단한 것은 타당한 판단이라고 볼 수 없다. 헌법재판소 는 간통죄에 대하여 헌법불합치결정 혹은 일부위헌결정을 선고하였어야 한다고 생각한다.

The ideal of the Military legal system to guarantee the commanding right and secured the military personnel's right should be pursued with the harmony. However, it is true that the commanding right has been esteemed more that the military personnel's right. Among the system to guarantee the command rights, the convening authority confirming procedure violates the Constitution and should be abolished because it infringes the principle of the division of power in the Constitution or the organization system of the Court. In addtion, lay-officer also violates the Constitution article 27 which provide the right to be tried by the judiciary according to the Constituion and the Code. In order to solve this problem, the military jury system should be introduced. As a feasible plan dividing the military prosecutors function and the military courts function separately, it is suggested that the military courts should be separated from the current JAG officers' organization. And also it should be forbidden that the judical staff has the influence on the court martial.
