상성전자와 애플, 롯데제과와 해태제과, 캐논과 니콘, 농심과 삼양$\ldots$ 이들 업체 간의 공통점은 무엇일까? 바로 오랫동안 업계에서 승승장구하며 서로 라이벌 관계를 형성해 왔다는 점이다. 라이벌 업체 간에는 제품, 서비스 면에서의 경쟁 구도만 존재하는 것이 아니라 제품과 서비스에 사용하는 상표 간에도 복잡하고도 미묘한 관계로 얽혀 있기도 하다. 이번 호에서는 국내 라이벌 업체 간에 실제로 상표권 분쟁이 생겼던 사례, 또는 향후 상표로 인한 분쟁이 일어날 가능성이 조심스럽게 점쳐지는 사례들을 다뤄보고자 한다.

'소녀시대' 상표를 의류 식품 미용 통신판매업 등의 9개 분야에 대해 A씨가 2007년 출원하여 현재 상표권을 보유한 상태로 알려졌다. A씨는 자신의 상표권을 기초로 하여 무단으로 온라인 쇼핑몰에 '소녀시대' 상표권 침해 금지 경고장을 보냈으며, 이 사실이 SM측에 알려지면서 '소녀시대' 상표권을 둘러싼 문제가 야기되었다. 소녀시대가 데뷔할 즈음에 '소녀시대'를 출원한 A씨의 상표권은 그대로 유효할까? 아니면 무효화시킬 수 있을까? 끊임없이 문제가 되고 있는 타인의 상표 선점 문제를 어떻게 해결할 것인지에 대해 다시 한번 살펴보고자 한다.

성인 비장애형제자매의 생애 경험과 관계 경험이 미치는 가족인식에 대한 이해 및 지원방안 모색

This study aims to understand how adults in early adulthood who have siblings with severe disabilities perceive their family, how the perception of family appears in the present and future their nuclear family, and to explore counseling approaches for them. The study was conducted through in-depth interview with six selected participants over a period of six months, with each participant being interviewed averaging two to up to four times. The data were analyzed using Giorgi’s method, resulting in the identification of 53 central units of meaning and 17 thematic clusters. These clusters represented participants’ perception of their families, categorized into five themes: ‘strong bond’, ‘reciprocal relationship’, ‘deep-seated emotions,’hopeful light in the shadow of fear’, and "wish". Based on these findings, suggestions and recommendations are proposed for understanding and counseling support for the perceptions of adult siblings without disabilities toward their families, and for future research. 본 연구는 중증장애인을 형제자매로 둔 성인초기의 비장애형제자매가 자신의 생애 경험과 관계 경험을 통하여 원가족과 핵가족을 어떻게 인식하고 있는지 살펴보고 이들을 향한 상담학적 지원방안을 모색하고자 한다. 연구 진행은 6개월간 집중적으로 자료를 수집하여 최종으로 선정된 6명의 참여자와 평균 2회에서 최대 4회에 걸친 심층 면담을 진행했고 이를 Giorgi의 방법으로 분석했다. 분석 결과 53개의 중심의미단위와 17개의 주제모음으로 나뉜 참여자들의 가족에 대한 인식은 ‘견고한 인연’, ‘교환적 관계’, ‘켜켜이 묵힌 애증’, ‘두려움의 그림자를 안은 희망의 빛’, 그리고 ‘염원’이라는 5개의 범주로 구분되었다. 이를 토대로 성인 비장애형제자매의 가족에 대한 인식 이해와 상담학적 도움의 방안을 제안하고 추후 연구를 위하여 제언하고자 한다.

지난달 편에 이어서 상표의 유사 여부를 판단할 때 가장 중요한 기준이 되는 '칭호'의 유사 여부 판단기준에 대해 이번 달에 좀 더 자세히 알아보고자 한다. 상표의 유사 여부를 판단할 때에는 상표의 칭호만 고려하는 것이 아니라, 상표의 외관, 칭호, 관념을 함께 고려해야 하는 것이 사실이나 상표가 일반수요자 사이에서 '칭호'로 전달되는 측면이 많다는 점에서 '칭호'의 유사 여부가 가장 중요한 기준이 된다. 칭호의 유사 여부는 거래 실제에 있어서 경험칙에 비추어 자연적, 구체적으로 판단해야 하는데, 두 개의 상표를 호칭할 때 두 개의 상표가 구별되어 들리지 않고 들릴 가능성이 있다면 두 개의 상표는 칭호가 유사하다고 판단된다. 이러한 칭호의 유사 여부는 일반수요자를 기준으로 판단하나 막상 두 개 상표의 칭호가 유사한 지 여부를 대비할 때에는 상당히 많은 가능성들을 고려하고 판단해야 하므로 출원 전에 상표의 칭호 유사 여부를 가늠하기 어려울 때가 많은 것이 사실이다. 따라서, 상표를 네이밍하기 전에 또는 출원하기 전에 상표 칭호의 유사 여부를 대비하는 데 가장 보편적으로 적용되는 기준들을 이하에서 먼저 소개하고자 한다.

미강 단백질 가수분해물로부터 Ca, Fe 결합된 peptide 제조

탈지 미강으로부터 미강단백질을 추출하고 상업용 단백분해 효소로 가수분해하고 한외여과하여 얻어진 미강단백질 가수분해물을 Sephadex G-15로 분리하여 얻어진 peptide fraction에 칼슘, 철분을 binding하여 칼슘, 철분 함유 peptide를 제조하였다. 추출된 탈지 미강 단백질의 분자량은 10~66 kDa에 분포하고 있었다. 추출된 단백질을 Flavourzyme으로 가수분해 시, 최적 가수분해 시간은 6시간이었으며, 5 kDa 이하로 한외여과 하여 얻어진 peptide를 Sephadex G-15로 분획한 결과 4개의 major peak를 얻었는데, 각 fraction의 칼슘, 철분을 binding한 결과 Ca/peptide는 F1에서, Fe/peptide는 F2에서 가장 많은 함량을 나타내었다. 본 연구 결과 얻어진 칼슘, 철분 binding peptide는 biomineral 기능성 식품의 소재로써 식품산업에 활용될 수 있다고 판단된다. Calcium and iron binding peptides were prepared by enzymatic hydrolysis and ultrafiltration of rice bran protein (RBP), which was isolated from defatted rice bran by phytase and xylanase treatment and ultrasonication. The isolated RBP had a molecular weight in the range of 10-66 kDa. The extracted proteins were hydrolyzed using Flavourzyme for 6 hr. After ultrafiltration under 5 kDa as molecular weight, the peptides were fractionated into 4 peaks by Sephadex G-15 gel permeation chromatography, and each fraction was determined for calcium and iron binding activity. As the result, F1 and F2 fractions were the best candidate for calcium and iron chelation, respectively. These results suggest that the calcium and iron binding peptides can be used as functional food additives in food industry.

Objective : This study is a survey research that investigates the kinds of medicinal herbs actually used in Yaksun(medicianal food) restaurants, the frequency and the way of using herbs in Yaksun. Through this study, we assumed that it will be used basis data on further Korean Yaksun research. Method : We conducted survey targeting for 26 Yaksun restaurants and Temple food restaurants serving Yaksun cuisine(medicinal food) menu from July 2012 to January 2013. The questionnaire was composed of several parts including the kinds of medicinal herbs that was used in Yaksun, medicinal food types that use a lot of medicinal herbs, medicinal herbs criteria used in the selection of medicinal food, and education experience learning Yaksun cuisine. Results : Only 11 restaurants answered the questionnaire among the targeting restaurants of survey objects. The number of Herbs was investigated in each restaurant was maximum 65 kinds and minimum 7 kinds (average 32 kinds). All restaurants used Angelicae Gigantis Radix in their restaurant. And Nelumbinis Semen, Zingiberis Rhizoma, Glycyrrhizae Radix, Acanthopanacis Cortex, and Gardeniae Fructus are well used medicinal herbs in Yaksun. Types of medicinal food using a lot of herbs were rices porridges rice cakes, both vegetables salads and stews soups. Almost chefs or restaurant's representatives learned cooking medicinal food at temples, food research centers, university attached institutions, and cooking schools. Conclusion : Medicinal herbs used in Yaksun restaurants are familiar with Korean and easily available. These herbs has better efficacy, taste, scent, color in comparison of the others. For the development of Korean Yaksun, further research of divers parts in Yaksun materials should be conducted.
