        자금세탁방지제도로서의 혐의거래 보고 및 고액 현금거래 보고

        Money laundering is referred to as the process of disguising the illegal origin of funds in order to make them appear legitimate. Since the Proceeds of Crime Act and the Financial Transaction Reports Act, the two anti-money laundering laws, were enacted in 2001, Korea has well established the AML system, meeting the international standards. The Proceeds of Crime Act is designed to criminalize money laundering and block criminal proceeds, while the Financial Transaction Reports Act stipulates administrative actions financial institutions should take to prevent money laundering activities. According to the latter Act, the Suspicious Transaction Report and the Currency Transaction Report systems are set up to make sure that financial institutions report suspicious transaction information to the Korea Financial Intelligence Unit. The Suspicious Transaction Report system requires financial institutions to report suspicious transaction information if there are reasonable grounds for suspicion, with the reporting threshold of KRW 20 million or USD 10,000. This system is applied to all forms of financial transactions, including cash transactions, based on subjective and professional judgement of employees in financial institutions. The Currency Transaction Report system requires financial institutions to report physical transfer of currency, exceeding a reporting threshold, to supplement the STR system that relies on subjective decisions. Its current reporting threshold is KRW 50 million, but the threshold will be gradually lowered to KRW 30 million in 2008 and to KRW 20 million in 2010. The Korea Financial Intelligence Unit is working as a central AML/CFT agency, analyzing suspicious transaction reports and currency transaction reports, filed by financial institutions, and disseminating the results to law enforcement agencies, such as the Public Prosecutor's Office, National Police Agency, and National Tax Service.

        비용 제약을 갖는 컴퓨터 네트워크의 최적화

          This paper considers a topological optimization of a computer network design with a cost constraint. The objective is to find the topological layout of links, at maximal reliability, under the constraint that the network cost is less or equal than a given level of budget. This problem is known to be NP-hard. To efficiently solve the problem, a genetic approach is proposed. Two illustrative examples are used to explain and test the proposed approach. Experimental results show evidence that the proposed approach performs more efficiently for finding a good solution or near optimal solution in comparison with a simulated annealing method.

        여러 링크 유형이 고려된 트리형 컴퓨터 네트워크의 경제적 설계

        In this paper, we deal with the design problem of tree computer networks that addresses many of the practical concerns associated with local access network design. The design problem of tree computer networks can be defined as finding the tree network topology minimizing cost subject to mean packet delay and sub tree maximum traffic capacity constraints. So for the design problem has been studied for a single link type in the design of the network. In practice, it seems unreasonable to assume that only a single link type is available to the network planner. In this paper, we consider the design problem of tree computer networks, in which there are multiple link types with different capacities and costs that can be installed between two nodes in the network. To solve the design problem, a genetic algorithm approach is proposed. Two illustrative examples are used to explain and test the proposed approach.

The objective is to find the topological layout of links, at minimal cost. This Problem is known to be NP-hard. To efficiently solve the problem, a scatter search algorithm is proposed. An illustrative example is used to explain and test the proposal approach. Experimental results show evidence that the proposal approach performs more efficiently for finding a good solution or near optimal solution in comparison with a genetic approach.

        금융투자상품 포괄주의 규율체계에 대한 입법적 보완에 관한 연구

        This paper aimed to evaluate issues resulted from the comprehensive regulatory framework on financial investment products under the Financial Investment Service and Capital Market Act (FISCMA). Specifically, it focused on the policy intent and the principles of comprehensive regulatory framework, the comprehensive legal definition of financial investment products, the distinction between securities and derivatives, and the definition of derivatives combined securities and investment contract securities with a particular emphasis on the practical application. The policy intent of the comprehensive regulatory framework under the FISCMA was expanding the business scope of financial investment services providers while strengthening investor protection simultaneously. However, the principal limit, which governs the issuance and transfer of securities inscribed in the statutory law restricted the business scope of financial investment services providers. Further, the introduction of comprehensive regulatory framework saw a little deterioration in investor protection due to the increased level of issuances in long-term commercial paper. In addition, accomadative policy options for the ease of corporate funding were not fully addressed in the enactment of the FISCMA, which will increasingly necessitate further discussion. Despite some criticism from the academic world, the comprehensive legal definition of financial investment products was rather well received in the government practice. However, the lack of exemptions, which were witnessed in the US, the UK, Australia, etc from certain clauses requiring interpretation and application of the comprehensive legal definition increased regulatory uncertainties and burden on both the regulators and the regulated entities. The obligation for additional payments, which was the only criterion provided to distinguish derivatives from securities under the FISCMA, caused difficulties in the practical setting, particularly in the area of options and warrants. It was noted that the single criterion approach has been facing challenges due to the increasing demand on clear distinction between securities and derivatives as the regulatory requirements on derivatives has been heightened since the Global Financial Crisis. Various issues raised from derivatives combined securities and investment contract securities were also considered in relation to the application of the comprehensive legal definition of securities under the FISCMA. A particular consideration was given to the issuance and sales of derivatives combined securities as separate regulations govern them with different policy intent. It was noted that investment contract securities and the likes can cause further issues when combined with crowdfunding due to the lack of transferability. Finally, the contents and policy intent of the amendment to the FISCMA in 2013 along with the revised bills and its subordinate regulations, which aimed to clarify and supplement the comprehensive regulatory framework on financial investment products, are detailed with referece to the changes in the definition of financial investment products and in the classification criterion between securities and derivatives. Further, some issues arising from the amendments in the scope of the derivatives combined securities, investment contract securities, etc with reference to the amendment to Commercial Law in 2011 and the new legislation on crowdfunding, which is currently being discussed in the National Assembly, are also considered.

To efficiently solve the problem, a tabu list coupled genetic algorithm approach is proposed. Illustrative examples are used to explain and test the proposed approach. Experimental results show evidence that the proposed approach performs more efficiently for finding a good solution or near optimal solution in comparison with a genetic approach.

        Scatter Search 접근방법을 이용한 LAN 확장을 위한 경제적 설계

        At the initial deployment of local area networks, it is very difficult to design with considering fast growing demand. To meet this new demand, a local area networks is gradually expanded with addition of new hubs and new users. In this paper, the design problem of local area network expansion is defined as minimizing the network cost subject to reliability constraint. The design problem includes issues such as choices of link type for each possible link, multiple choices of hub type for each hub, and allocation of the users to the hubs. This problem is known to be NP-hard. To efficiently solve the problem, a scatter search approach is proposed. Two illustrative examples are used to explain and to test the proposed approach. The experimental results showed evidence that the proposed approach performs more efficiently for finding a good solution or near optimal solution in comparison with genetic algorithm approach.

        21세기를 위한 정보 기술 프로젝트 관리

        날로 치열해 지는 글로벌 경쟁과 e-비즈니스의 도래와 함께 정보 기술 프로젝트의 관리도 새로운 패러다임이 요구되고 있다. 종래의 비용이나 일정에 맞추어 개발된 프로젝트 관리방법은 주로 관리 기법에만 의존하던 나머지 잦은 프로젝트 실패의 한계를 벗어나지 못하고 있다. 따라서 이와 같은 한계를 극복하기 위한 전략으로 21세기의 지식사회에서는 새로운 접근방법이 절실해 지고 있다. 본고에서는 최근에 새로운 조직관리의 관점으로 대두되고 있는 자원 기반 관리이론을 정보 기술 프로젝트의 새로운 접근 방법으로 도입하여 사회-기술적 통합 시스템으로서의 프로젝트 관리 방법론을 제시해 보고자 한다. 아울러 이에 따르는 전략적 과제를 살펴 보고 미래의 프로젝트 관리자들에게 새로운 프로젝트 관리의 패러다임을 제시하고자 한다.
