본 논문은 동아시아 대표적인 불교계 종단의 종헌을 비교 연구한 것이다. 한국, 일본, 대만의 불교계 종단의 종헌에 나타난 정신과 교단구조, 그리고 각각의 특징을 살펴보았다. 무엇보다도 종파적 특징을 지니고 있는 만큼, 종교법으로서의 각 종단의 성격이 잘 드러나 있다. 일본의 경우에는, 교단의 전통과 정신을 강조하는 종헌 외에 국가의 종교법인법에 따른 교단의 운영에 관한 법규를 두고 있다. 대만이나 한국의 경우, 종헌에 교단의 역사적 발원에 관한 언급을 시작으로 전체적인 조직, 운영 등에 관한 사항이 총체적으로 반영되어 있다. 동아시아 불교종단의 공통점은 대체로 종단의 역사적 연원, 법의 계승, 종조의 깨달음, 소의경전 등을 명기하는 등 自宗의 전통을 드러냄으로써 정체성을 확보하고자 하고 있다. 대승불교라고 하는 전체적 이념을 공유하는 동시에 자종의 전통을 강하게 드러내기 때문이라고 할 수 있다. 또한 종단 최고지도자의 역할에는 법의 계승, 해석을 통한 종단의 구심적 역할이 강하게 드러나고 있다. 원불교의 경우는 최고 지도자를 중심으로 한 집단 지도체제가 이러한 역할을 하고 있는 것으로 나타난다. 조직적 측면에서는 불법의 가르침에 입각한 종단의 정책 결정, 행정 등이 최고지도자와의 관계를 합리적으로 분리해가는 면이 나타난다. 근현대 사회의 조직적 분화 또는 권력의 분권적 영향을 받고 있다고 본다. This study compared and studies charters of sects of monastic orders in the East Asian Buddhism Circles. It examined the spirit of Buddhism, structures of religious bodies, and each characteristics shown in the charters of sects of the monastic orders in the Korean, Japanese, and Taiwanese Buddhism circles. First of all, character of each monastic order as the religious laws is well reflected as they have sectarian characteristics. In case of Japan, there are laws and regulations regarding operation of religious bodies according to the national religious corporation act except the charters of sects that emphasize their tradition and spirit. In case of Taiwan or Korea, the details about the entire organizations and their operation are generally reflected in the charters of sects starting with the mention of the historical origin of the monastic orders in it. For a common point of the monastic orders in East Asian Buddhism they typically tried to secure their identity by showing tradition of the sects of religious order that they belong to sect of one"s own including specifying their historical origin, succession go Dharme, enlightenment of the founders of sects, the main texts of Buddhist schools, etc. It"s because they share an idea called Mahayanist Buddhism and at the same time, strongly showed tradition of the sects of religious order that they belong to. And the supreme leaders of the monastic orders strongly show their central roles in the monastic orders through succession to and interpretation of Dharma. Won-Buddhism has found that the collective leadership system that centers on the supreme leaders plays this role. The organizational aspect has found that policies, decision, and administration of the monastic orders based on the teaching of the Buddha-dharma are reasonably separated from the relationships with the supreme leaders. It is thought to be influenced by systematic differentiation or decentralization of power of modern and contemporary society.
