      • 폐합형수계 모형에 의한 부정류 해석

        Loopnet은 폐합형수계에서 물의 흐름에 관한 시간적 공간적 변화를 계산할 수 있는 부정류 해석프로그램이다. 본 연구에서는 이 모형이 적용하고 있는 Looped Solution 알고리듬을 유도하고, 폐합형수계의 시험하도를 구성하여 이 모형의 안정성 및 정확성을 시험해 보았다. 또한 굴포천 유역을 대상으로 이 모형을 적용하여 수공 구조물, 서해측의 조위와 유역의 홍수 유입 등을 고려한 홍수위를 산정하였다. 그 결과 모형의 안정성 및 정확성 시험에서 신뢰할 만한 결과를 얻을 수 있었으며, 운하의 운영수위는 굴포천 본류와 방수로구간 모두 홍수위 변화에 큰 영향을 미치지 못하였으나, 조도계수는 홍수위 변화에 중요한 물리적 요소 중 하나로 분석되었다. Loopnet model was developed to simulate unsteady flow in the looped network channel, considering change of the time and space. In this study, the looped solution algorithm was derived and the accuracy and stability of the model was tested. The Gulpo river system was used to calculate the flood water levels considering the hydraulic structures, tidal effect and inflow hydrographs. The result of the simulation showed that the accuracy and stability of this model was reliable. The change of flood water level of the Gulpo River system and the spillway section were not greatly affected by the operation water level of the navigation channel. But this analysis showed that roughness was one of the very important physical factor in changing flood water level.

        외국인수형자 실태와 처우개선 과제

        The prupose of this study is to examine the current status of the treatment for foreign prisoners and probationers and to suggest alternatives for treatment improvement. The aim is to solve these problem and to improve the treatment of foreign prisoner's through the reform measure of treatment. At present, there are two exclusive charge prisons for Men foreigners Daejeon and Cheonan. Women foreign prisoners are kept in Cheongju Women Correction. Therefore, there are many practical difficulties in treating foreign prisoner's such as poor facilities, high density, and restriction on religion activities. There are many Specifically, there are many obstacles to rational treatment of foreigners such foreign prisoners values, customs, language, culture, religion. These differences would inevitably cause conflict and mistrust between foreign prisoners. In order to take care for increasing number of foreign prisoners and more importantly for dealing with the implementation of institutionalized treatment for them, a systematic and practical improvement in institutional treatment in corrective action period is required. This aim is how to reach observe and performance of UN Standard Minimum Rules the treatment of foreign prisoners correction.

        일본의 폭력단에 관한 연구

        The means of committing the crimes, it is becoming more skillfull and concerned in order to extend the business, and the means are more vicious when it comes to smaller organized crime groups. Crimes regarding illict traffic of drugs, firearms and cash forgery are evolving in link with international crime groups. The first treaty to fight organized crimininal groups around the world is now a part of international law. It is called the United Nations Convention against Transnational Organized Crime. The UN Office on Drugs and Crime says about 150 nations have signed the treaty. So far, 48 of the countries have gone the next step and approved the treaty. They are now expected to include the rules of the agreement in their local laws. The treaty requires countries to approve a series of measures. One measure is to make it illegal to take part in an organized criminal group. Such groups are defined in the agreement as at least three people working togather to carry out serious crimes for profit. The treaty also includes agreements for protection against trafficking in people. The UN says criminal groups are using new transportation and communication technologies to make huge profits from their activities, these include moving immigrants illegally across borders. They also include transporting women and children for use in the sex trade or as servants. The new UN treaty also requires that countries approve measures to fight dishonesty by public officials. And nations will have to cooperate against money laundering. They will have to work togather to find hidden money earned through criminal activities. The treaty also sets new rules for countries to surrender suspects for trial and to carry out joint investigations, in addition, countries must work to fight illegall trafficking in firearms.

        경찰의 범죄피해자보호에 관한 패러다임의 전환

        그 동안 가해자의 인권을 강조해 온 사회적 분위기로 인해 수사에서 재판에 이르는 형사사법의 절차에서 범죄피해를 입은 피해자의 인권은 상대적으로 소홀하게 다루어져 왔다. 이러한 사회적 분위기 속에서 경찰에서는 그동안 소홀하게 다루어져 왔던 범죄피해자에 대한 보호와 지원 방안 등에 관하여 체계적인 시스템을 마련하기 위해 각종 제도 등을 시행하고 있으며, 이를 좀 더 효율적으로 추진하기 위해 경찰청에 전담기구를 설치하고 전문 인력을 배치하는 등 적극적인 변화를 추진하고 있는 중이다. 범죄피해자에 대한 경제적ㆍ사회적 또는 정신적ㆍ심리적 지원이 수사기관에서도 관심의 대상이 되고 있다. 수사기관에서도 경찰수사의 단계는 범죄피해자가 최초로 접하게 되는 형사 절차의 과정으로 피해자의 육체적ㆍ심리적 충격이 가장 큰 단계이기 때문에 피해자보호에 있어서 경찰의 역할은 매우 중요하다고 할 수 있다. 본 논문은 범죄와 관련된 1차적ㆍ2차적 피해에 관한 패러다임의 전환이라는 관점에서 접근하여 이를 정당화 할 수 있는 적합한 이론을 도출하고, 아울러 바람직한 경찰의 범죄피해자보호개선방안을 모색하는데 중점을 두고 있다. 형사절차상 범죄피해자의 권리와 이익을 존중하고 수사절차에서 이중의 피해를 당하지 않도록 피해자의 인권을 보호하는 한편 피해자가 신속히 사회생활에 복귀할 수 있도록 사회 각 분야의 지원체계를 연결함으로써 경제적ㆍ정신적으로 지원하고 형사절차상 권리와 이익을 존중함으로써 피해자의 인권을 보호하는 것은 국가와 사회의 의무이자 경찰의 의무라고 할 수 있다. This study is about the Paradigm shift of crime victims protection in police. By analyzing and finding the problems of victim protection system of the police, this study was performed with victim protection system as the center to search for the protect measures. We try to protect and support the crime victims in the investigative institutions and the support centers for crime victims, but these systems are not firmly established due to the lack of understanding about the crime victim protection. As the criminal investigation stage is generally the gate to criminal procedures which the victim may encounter first with biggest physical and psychological shocks, the role of the police is very important in victim protection. This article describes the reactions to the crime-victim protections by the police as mechanisms of Criminal Justice System for the purpose of protecting the victims. The purpose of this paper is to discover an improvement scheme to support the first and second crime victims. The theoretical background is theories on the crime victimization of social minority owing to social power inequality. The postmodernism criminal theory are adequate to explain the crime victimization of social minority. For crime victims protection in police, we must to understand current status and problems of crime victims protection in police, and to improve them. To this end, this study aims to review the development and the current status of the currently on going protection plans of the police for the criminal victims and a variety of systems and to examine the improvement directions to protect the rights and interests of the criminal victims.

        공무원뇌물범죄와 대응방안

        한국의 공무원사회는 부정부패가 만연하여 공무원들이 자신의 행위가 범죄사실이라는 정을 잘 알면서도 관행상 또는 축재할 목적 등으로 뇌물범죄행위를 저지르고 있을 뿐만 아니라, 공무원에게 뇌물수뢰죄의 기회를 제공하는 국민들 역시 불법이라는 사실을 알면서도 자신의 반사이익 때문에 공무원에게 계속 뇌물을 공여하고 있어 정부의 강력한 단속정책에도 공무원범죄는 좀처럼 감소되지 않고 있는 실정이다. 공무원범죄는 전반적으로 특정업무분야와 특정직급의 공직자에 의해 일어나고 있으며 고위공직자일수록 수뢰의 규모가 크고 하위직일지라도 평균적인 비리규모가 결코 생계유지차원이라고 단정할 수 없을 정도로 큰 편이라는 점이 지적되며 대외적인 업무수행과정에서 발생하고 있다는 점이다. 공무원범죄는 좀처럼 쉽게 척결되지 않고 있다. 공무원범죄를 감소시킬 수 있는 방안으로는 공직기강을 확립하고 각종 행정규제를 대폭완화하며 감찰기관이 지속적인 감시와 예방활동을 주력하고 공무원의 공정한 인사와 처우를 보장해주고 정부의 강력한 의지와 국민의 신뢰를 바탕으로 하는 정책만이 공무원범죄를 해결할 수 있다. It is not simple to define what is civil servent bribe crimes and what they mean. Although civil servent bribe crime has been regarded as significant social problem through all the time and space. The regulation on bribery crime was gradually reinforced so that criminal methods of the crime tended to be advanced and specialized. Therefore, a comprehensive and systematic countermeasure against the crime was required. In particular, in the Korean society having dual structure on bribery, the one who gave bribe voluntarily was thought to be the one who made causes of corruption, so that not only the one giving bribe but also the one taking bribe was responsible for bribery crime. Bribery is criminalized to protect the people’s trust in the integrity of the civil servent. Continuing efforts have been made to eradicate bribery in the dimension of corruption prevention. Corruption is one of the oldest and most difficult problems to solve. And the Anti-Corruption Act is established to serve to create the clean climate of the civil service and society by preventing and regulating the acts of corruption efficiently. Corruption deepened a vicious circle of a business-politics relation, speculation and privilege, expansion of unearned income, etc. that have been habituated in the Korean society. Conclusively, countermeasures to the corruption crime should help the civil servent to perform their job responsibly in a healthy environment by changing the policies that cause the corruption instead of the negative regulations focused in punishment.

      • 건설 현장 관리 자율 및 무인화 시스템을 위한 SPOT 로봇 하드웨어 및 소프트웨어 성능 분석

        The purpose of this study is to analyze the applicability and limitations of SPOT robots in the construction industry. The SPOT robot, which is being introduced to construction sites for smart construction with the progress of the 4th industrial revolution, is shaped like a four-legged dog and is equipped with various sensors for data collection and autonomous driving. In this study, hardware and software were analyzed, such as the size of the SPOT robot, mobility on slopes and heights, operating environment, and software functions that can collect data with a sensor weighing up to 14 kg. In addition, while the SPOT robot operates in a construction environment, performance such as stability, accuracy, signal connection distance, and obstacle avoidance are evaluated, and the applicability and limitations of the SPOT robot in the construction industry are analyzed. Based on this analysis, the purpose of this study is to evaluate when and how SPOT robots can be effectively used at construction sites, identify limitations, and derive contributions and improvements for the construction industry.

        성폭력범죄자의 성충동약물치료에 관한 법률의 헌법적·형사정책적 검토

        아동성폭력범죄는 사회적으로 상당히 심각한 문제이며, 피해자의 정신적 고통이나 가족들과 국민들의 불안감을 생각한다면 효과적인 해결책을 찾아야만 한다. 그리하여 2010년 국회는 화학적거세를 주요내용으로 하는 법안을 통과시켜 2011년 7월24일부터 시행되고 있다. 화학적 거세는 의과학적으로 제안되는 약물을 주입하여 성충동을 억제시키는 방안이며, 일부외국에서는 이미 시행되고 있는 제도이다. 그러나 성충동약물치료는 인권을 무시하고 침해한 졸속정책의 일환으로 본다. 그것은 치료명령부과의 주체, 초범자에 대한 약물치료의 허용, 심신상실자에 대한 약물치료의 허용, 약물치료대상자의 동의없이도 강제적으로 시행할 수 있으며, 화학적거세의 부작용 및 실효성문제와 화학적거세가 대체형벌이 아닌 중복형벌로 가능하다는 헌법적·형사정책적 문제점이 제시되고 있기 때문이다. 헌법적으로 보면 이중처벌금지의 원칙위반에는 해당되지 않겠지만 그 구체적인 집행에 있어 치료목적의 심리치료를 병행하지 않는다면 과잉금지 원칙에 위반할 것으로 보이며, 기존의 수형자에 대한 동의를 통한 치료명령은 그 동의의 적절성에 위헌의 소지가 있다. As a measure to prevent recurrence of sex crime, “Act on Medication Treatment of Sexual Impulse of Sex Offenders” was enacted on July 24, 201l. the researcher is able to reach a conclusion that the foundation of the Sexual Impulse Medication Treatment Act is insecure, and includes a number of unconstitutional factors. As long as people understand this act with such significance, it seems that there are almost no grounds for the Sexual Impulse Medication Treatment Act. Therefore, the Sexual Impulse Medication Treatment Act needs to be revised rather than being enforced under the situation where the issues related to human rights abuses have not been completely resolved. Castration may be performed in two ways: through medication or through the surgical removal of the testes. chemical castration has ml issue of infringing upon light to self-determination in one’s body or reproduction, light to be not impaired in one’s body. If the administration of chernical castration is based on informed consent, castration doesn’t infringe upon the rights. chemical castration has been criticized as inhuman critical policy, in the consideration of constitutionality. As the law shows, a mandatory injection without consent could be unconstitutional. Although chernical treatments can decrease the aggressive fantasies of male offenders, it should be reviewed in line of criminal rationality and specific data-analysing. chemical castration is not the perfact solution to inhibit child molestation, additionally it discourages the rationality of criminology which dignifies human rights. sugical castration can not be considered as a reliable treatment for sex offenders. This raises the question whether the treatment can be considered legally permissible. It is also questionable if the procedure can pass the constitutionality test with regard to the prohibition of cruel, inhuman, or degarding treatment or punishment, the fundamental rights to marry and found a family as well as to human dignity and integrity. The government should also by to give much safer options for them and invest many resources for solving their psychopathic problems.
