편의치적은 선박소유자가 선박의 국적취득이 용이하고 선박의 운영에 대해 거의 규제하지 않는 국가에 서류상의 법인을 설립하고 그 명의로 선박을 등록하는 것을 말한다. 이러한 편의치적과 관련하여 실무상으로는 계약의 상대방이 형식적인 법인이 아닌 선박의 실제소유자에게 책임을 지우게 하기 위하여 법인격의 남용을 주장하거나 형식적으로만 등록이 이루어진 선적국의 법률이 선박과 가장 밀접한 관련이 있다고 보기 어렵다는 이유로 다른 법률을 준거법으로 주장하는 경우가 많다. 대법원에서도 편의치적 선박을 위하여 설립한 형식상의 법인의 법인격을 부인한 사례가 있는데, 다만 이러한 사례들의 경우 외국적 요소가 있는 법률행위로서 법인격부인에 대한 판단을 위한 준거법의 지정이 선행될 필요가 있고, 또한 편의치적을 위하여 설립된 법인의 법인격부인을 위한 요건에 관한 판례들이 축적될 필요가 있다. 또한 편의치적과 관련하여 선박우선특권에 관한 준거법의 지정이 문제되는데, 최근 대법원은 2013다34839 판결을 통하여 편의치적의 경우 준거법 지정의 예외조항인 국제사법 제8조 제1항을 적용하여 선박우선 특권의 준거법을 결정하기 위한 준거법으로 선적국법이 아닌 ‘그 법률관계와 가장 밀접한 관련이 있는 다른 국가의 법’을 인정하였다. 다만, 이 판결에서 설시한 요건들만으로는 실질적인 소유자가 대한민국 법인인 편의치적의 경우 대부분 예외조항이 적용될 수 있는 것으로 해석될 여지가 있어 앞으로 그에 관한 추가적인 판례의 축적을 통하여 국제사법 제8조를 적용하여 선박우선특권의 준거법을 결정하기 위한 보다 구체적인 요건이 제시될 필요가 있다. 또한, 위 대법원 판례의 법리를 확장할 경우 법적 안정성을 해칠 가능성도 있어 장기적인 관점에서는 선박우선특권의 준거법에 관한 국제사법 규정의 개정도 논의할 충분한 가치가 있다고 보인다. ‘Flag of convenience’ refers to a case in which a ship owner establishes paper company and enrolls a ship in the country thet allows easy acceptance of the enrollment of a ship and does not involve in the management of a ship. In terms of practical cases related to ‘flag of convenience’, there are a case of claiming piercing the corporate veil to lay an obligation on a real ship owner and a case of applying to laws other than that of the flag state as an applicable law concerning maritime lien. Regarding piercing the corporate veil, there have been previous judgements of Supreme Court that has denied the corporate entity of the paper company. However, in determining the denial of the corporate entity of the company for flag of convenience, it is necessary to decide on the applicable law. By the accumulation of cases, the conditions of piercing the corporate veil need to be clarified. And regarding an applicable law concerning maritime lien, Supreme Court recently sentenced the judgement that admitted laws other than that of the flag state as an applicable law concerning maritime lien by applying article 8 of private international law. However, it is necessary to clarify the conditions of it by the accumulation of cases. Finally in the long term, the discussion on an amendment on the article related to an applicable law concerning maritime lien in private international law is required.

유리섬유복합관은 지중에 매설되기 때문에 토압 및 상재하중 등의 외력에 충분히 안전하게 설계되어야 하며, 관의 변형 및 침하에 대해서도 안정성을 확보하여야 한다. 이에 본 연구에서는 내압 및 외압에 대한 안정성 평가를 위하여 실내시험을 통한 GFRP관 재료의 역학적 성질을 규명하여, GFRP관의 해석과 설계에 필요한 역학적 성질을 제시하였다. 아울러 수치해석기법을 이용하여 전 구간 및 일부구간에 상재하중 작용 시 흄관과 GFRP관의 변형 및 부등침하 관계를 비교분석하여 수치해석을 통한 GFRP관의 적용성을 평가하였다. The GFRP(Glass-Fiber Reinforced Plastic) pipe is designed to behave safely against the external forces and to secure stability of deformation and settlements of pipe, since it is laid under the ground. In this study, the evaluation for the pressure stability was carried out by performing the laboratory experiments to figure out the mechanical properties of Glass-Fiber Reinforced Plastic pipe, take a theoretical approach, and suggest the mechanical properties necessary for the analysis and design of GFRP. Numerical analysis is also conducted to evaluate on the field application through the comparison concerning relations between deformation and differential settlement in the GFRP and hume pipes when all and half sections are under the surcharge load.
