주택법은 쾌적한 주거생활에 필요한 주택의 건설 건설·공급·관리와 이를 위한 자금의 조달·운용 등에 관한 사항을 정함으로써 국민의 주거안정과 주거수준의 향상에 이바지함을 목적으로 한다. 주택법에 의하여 주택을 건설할 경우 수분양자의 입주권을 보장하기 위하여 주택법 제40조 이하에서 사업주체의 채권자에 의한 강제집행 등을 방지하기 위하여 저당권설정 등을 제한하는 금지사항을 부기등기의 방식으로 공시하도록 하고 있다. 그런데 주택법 제40조 제11항에서 사업주체는 같은 법 제 항에서 제16조 제11항의 규정에 의한 사업계획승인을 얻어 시행하는 주택건설사업에 의하여 건설된 주택 및 대지에 대하여는 입주자모집공고승인 신청일 항의 신청일(주택조합의 경우에는 사업계획승인 신청일을 말한다)이후부터 입주예정자가 그 주택 및 대지의 소유권이전등기를 신청할 수 있는 날 이후 60일까지의 기간 동안 입주예정자의 동의 없이 해당 주택 및 대지에 저당권 등을 설정할 수 없는 것으로 규정하고 있다. 그리고 같은 제22항에서 제11항의 "소유권이전등기를 신청할 수 있는 날"이라 함은 사업주체가 입주예정자에게 통보한 입주가능 일을 말하는 것으로 규정하고 있다. 그런데 이에 대하여 첫째, 소유권이전등기를 신청할 수 있는 날 의 구체적인 해석을 놓고 건축법에 의한 사용승인을 의미하는지, 부동산등기법에 의한 소유권보존등기 일을 의미하는지, 둘째, 『60일까지의 기간 동안 입주예정자의 동의 없이 해당 주택 및 대지에 저당권 등을 설정할 수 없다』 일까지의 라는 규정은 60일을 경과하면 부기등기의 말소절차를 거치지 않고도 저당권 등을 설정할 수 있다는 의미인지, 60일을 경과한 경우에도 말소절차를 거치지 않고는 저당권 등을 설정할 수 없다는 의미인지, 말소절차를 쳐야 한다면 사업주체의 채권자가 대위로 말소신청을 할 수는 없는지, 셋째, 금지사항 부기 등기가 말소되지 않은 상태에서 입주가능일로부터60일이 경과한 후 압류 일이 압류, 가압류의 촉탁이 있는 경우 이를 각하하여야 하는지 등이 문제된다. 주택법의 이러한 문제들은 국민들에게 미치는 영향이 큰데도 불구하고 깊이 있는 연구가 되어 있는 것은 아니다. 주택법은 지난 2010. 5. 31 법률 제10331호로 일부 개정되었고 호로 정되었고, 이에 따라 같은 법 시행령과 시행규칙이 차례로 개정되었지만, 위와 같은 문제점은 여전히 남아있다. 본 논문에서는 이러한 문제점들을 중점적으로 연구하였다. Housing construction method can be largely divided into the method by the Housing Act and by the Housing Renewal Act. Housing construction by the Housing Act is required to notice publically the prohibit affairs of the Housing Act limiting the settlement of mortgage in the registration of an additional entry to prevent forcible execution by creditor of the construction operator under Clause 40 of the Housing Act. This is an appropriate measure taken to guarantee the right of occupant-to-be. However, in the Housing Act, Clause 40, Article 3, it is defined that mortgage cannot be settled for the house and land without consent by the occupant-to-be during 60 days after the day to apply for the registration for transfer of the ownership of the house and land by the occupant-to-be recorded in the registration of an additional entry for the prohibit affairs. On the above regulation there are three issues stated below: First, does the day to apply for the registration for transfer of the ownership mean the approval date for use by the Building Act or the registration date of ownership by the Registration of Real Estate Act? Second, does the regulation that "mortgage cannot be settled for the house and land without consent by the occupant-to-be during 60 days" mean mortgage can be settled without cancellation procedure of the registration of an additional entry after 60 days?, or mortgage cannot be settled without cancellation procedure even after 60 days?, or if cancellation procedure is required, does the creditor of the construction operator can apply for the cancellation by subrogation? Last, if there is a request for attachment or provisional attachment after 60 days from the occupation date in the state that the registration of an additional entry for the prohibitions is not cancelled, is the attachment or provisional attachment to be dismissed? The regulation of the Housing Act on the above has considerable influences on people but the researches have not been made in depth. The Housing Act was revised, in part, on May 31, 2010 (No. 10331), and the enforcement ordinance and rules have been revised in turn, but still Clause 40, Article 3, the subject of this research has not been revised. I hereby suggest a reasonable criterion for authorized construction by the interested parties.
